I, Officer Guedry was dispatched to 2997 Sabine Pass in reference to subjects trespassing at this location, Upon my arrival, | observed a two black male subjects sitting in lawn chairs directly in front of tis residence, There are several posted signs stating "NO TRESPASSING.” At this time, I was ‘wearing my Department issued uniform identifying myself as a Police Officer. I then commanced the subjects 0 ome here and identify themselves in a clear and loud voice. One of the subjects wearing a blue t-shirt and blue Jeans then disregarded my command and intentionally fled on foot Reading northbound on Sabine Pass. I then gave chase after the subject. The subject was later identified as Derrion Jackson b/m dob 05-16-85. Jackson then continued by turning westbound onto Prairie street. At this time, in the 700 block of Prairie, I abserved Jackson intentionally throw a bagey of "Marijuana" onto the ground using his right hand. Jackson then continued turning onto Atlanta where he was taken into custody at the 2600 block of Atlanta, Once I was able to catch up with Jackson, he took an aggressive stance and would not comply with my commands, therefore I used a short burst of sny Department Issued OC Spray and was able to bring him to the ground at which time he complied. Through my training and experience, I believe the baggy ofthe green leafy substance to be consistent with that of Marijuana. The suspected Marijuana was recovered and weighed approximately .70 oz and was logged into Beaumont Police Department Property Office, A Jefferson County Lab Form was completed and tured into Records. Jackson was then transported tothe Jefferson County Jail and booked in for Poss of Marij-2oz., and Evading Arrest Detention. Reporting OMieer: GUEDRY, J. At this time, we observed 3 Red Chevy Cobalt bearing TX LP (FZF949) fail to signal within 100 ft at the intersection, At this time, we initiated our emergency Tights to conduct a traffic stop to inform the driver of the violation he had just committed. The diver of the vehicle was Ieter identified as Brandon J. Miller b/m dob 4-20-90. Once we tumed on our emergency lights at Calder and Fifth Street Miller turned west onto Calder and intentionally accelerated to flee the scene, At this point, Miller tumed left sto Seventh Sircet heading southbound where J observed him run the stop sign at Seventh and Laurel, Miller then ontined turning west onto Rusk, accelerating ata high rate of speed with out regard for the safety of etizens walking along the roadway and other drivers, Miller then turned north on Jaguar where he almost lost complete contro} of the vehicle. Miller then went eastbound on South Street where he continued turning onto Fourth Steet. Once Miller was con Fourth Street he accelerated to a very high rate of speed until he tured onto Crockett Street. Continuing on Crockett, Mller disregarded the stop sign at Crockett and MLK, which isa heavily traveled intersection. Miller thea ontinyed east on Crockett where he turned north onto Willow, at which time Set. Shearer was able to catch up with Miller and continue the chase in his marked patrol unit. Sgt. Shearer continued the chase where eventually Miller stopped inthe 2500 block of Pecos. At tis time, Miller fled on foot behind an apartment complex where a perimeter tvas setup. I then observed Miler jump over a fence on the westside near Jaguar Street. I then observed Milles jump back over the fence and continued evading Officers. At this point, I observed Miller lying face first under neath a vehicle at which time I ordered the subject to show his hands and exit from underneath the veticle, As T moved closer to Miller be continually refused to comply with my commands to exit from under neath the vehicle. At this point, Miller began crawling out from underneath the vehicle. I did not observe Miller's hands at this point and was unsure if he had any weapon. It appeared that Miller may try to escape and fle from the scene once aga. 1 then attempted 12 place my left foot on Miller's upper back to stop him from further trying to flee. Miller tried te slip back towards the enter of the vehicle when I was able to stop his flee with my foot on his head. I then was able to grab hold of Miller's upper shoulder area and completely extract him from under the vehicle. Once Miller was out from under neath the \ebiele he began swinging his arms out widely and uncontrollably. I was stuck several times in my chest and shoulder rea from Miller's strikes. I then attempted to grab Millers left hand to place a handcuff when Miller persistently vr sjsed, ordered Miller repeatedly to Stop Resisting.
