What is the main issue under
PCPNDT
•The Issue
The child sex ratio is a powerful indicator of social
health of any society. Calculated as number of girls per
1000 boys in the 0-6 years age group, the ratio has
shown a sharp decline from 976 girls to 1000 boys in
1991 to 927 as per the 2001 census. In certain parts of
the country, there are less than 800 girls for every 1000
boys.
Where is it Happening

According to the 2001 census,


this ratio has declined to less
than 900 girls per 1000 boys
in States such as Punjab,
Haryana, Delhli, & Gujarat

Registration Genetic Counseling
Centre/Clinic/Lab.
No person shall open any Genetic Clinic, Counseling
Centre or Genetic Lab- using USG Machine/any
imaging machine /Scanner/any technology-which is
capable of detection of Sex/ Selection of sex or
render any services after the commencement of act
(Regulation & amendments)Act 2003. Unless such
Centre is registered under PNDT Act.
Procedure for Registration.

III- Documents to be submitted at the time of


application along with Form A in duplicate.
1. Invoice/Bill of USG Machine- Machine make/No.
with octroi paid.
2. Undertaking on Stamp Paper of Rs. 100/-
notarized stating Sex Selection/detection will not
be done in the Centre. & the message in English &
the local language will be displayed.
3. Qualification Certificate of
Sonologist/Gynaecologist/MMC registration etc.
4. Ownership document of place, name, address of
place documents.

5. Addl. No. of Machines/No.of Doctor visiting


their names & Certificates, their invoices.
- Every Centre, i.e. GCC/Genetic Clinic/Genetic
Lab. Conducting PNDT techniques shall apply
for registration within 6o days of
commencement of centre.
Contd…
-Centre should cease to act within 6 months of
commencement if not registered or till application
is processed whichever is earlier.
-No. Centre shall be registered under the Act unless
A.A. is satisfied that centre is in position to provide
such facilities.
-After A.A. authority is satisfied.
-A.A. will put up application to Advisory Committee
Meeting which in turn approve /disapprove
application.
Section - 19
If approved then A.A. will grant Certificate of
Registration in form B under PNDT Act in
prescribed form which will be issued in Duplicate
(as original 2 copies).
- 1 copy to be displayed by centre at counter to be
seen by patients visiting the Centres.
-2nd copy to be displayed as original in USG
room/Lab.
-Copy of Act book to be kept handy for
reference/queries raised by patients.

SECTION – 2 – DEFINITION UNDER ACT
a) Appropriate Authority– means the A.A. appointed under
Section 17. In Mumbai- Exe. H.O. & All M.O.Hs. Of 24
wards are appointed A.A.
b) Genetic counseling Centre – Any place or Nursing
Home/Maternity Home/Hospital/Institution which provides
genetic counseling.
• Genetic Clinic – Any place as above or vehicle / Residence of
Sonologist used for conducting any sonography / PNDT
procedures / Techniques, ie., USG Centres, Ammocentesis,
• Explanation- (Amended in 2002) Genetic clinic includes a
vehicle, where USG Machine/ scanner or any other equipment
which is capable of determining the sex of foetus or a portable
equipment which has the potential for detection of sex during
the pregnancy or selection of sex before conception, is used.

e) Genetic Lab.- Any lab or place where facilities are
provided for conducting analysis or tests of samples
received from Genetic Clinic.

pregnancy or selection of sex before conception.

ON AND FROM COMMENCEMENT OF ACT

shall conduct/associate/help in conducting activities or
procedures under PCPNDT Act.

shall conduct / Aid in conducting any technique(USG) /
procedures unless centre is registered.

the person/cause to be employed/take services of person on
payment or honorary unless well qualified as per Act &/his
or her name reported to concerned A.A.& Registered
Pt. No person / Specialist – in field / infertility – shall
conduct or cause to be conducted / Aid by himself/herself
or by any person for sex selection on man/women or both
or any tissue embryo, conception or fluid / gametes derived
from any one of them.

5) No person/Company- shall sell USG


machine or any imaging machine/scanner/any
equipment which is capable of sex
selection/detection to any unregistered centre /
ie every centre has to register even before
purchase of machine ie., no company will sell
the machine until centre is registered.

person is qualified to do so & unless following conditions
are fulfilled.
If any age women more than 35 years
BOH (2 or more than spot abortion or
foetal loss)
History of exposure to teratogenic
drugs,radiation, infection, chemicals etc.
History of mental retardation.
Fetal growth monitoring or deformities.

2) Complete record of patient should be maintained as


prescribed in act.

3) No person / Patient / relative shall encourage the


conduct of any sex selection /detection techniques on
him/her except the indication as specified.

be used for that place only Certificate of
registration in non transferable, machine make
mentioned in application-duly registered should use
same machine & not any machine and used by none
other than a person or qualified Sonologist
/Gynecologist/RMP whose name is registered in
Certificate.

-Each centre /each machine/each doctor duly register
should use the facility at some place. No other
machine/No other qualified doctor or unregistered
doctor should use the machine.
-Any change in Machine/Doctor performing-should be
intimated to A.A. immediately.
-Any change in ownership of place/Change of
Management or Centre is closed or cease to
function- shall surrender original both copies of
registration certificates to A.A.
-If change in Ownership/Management shall apply
fresh.
Section – 20 – Cancellation or
suspension of registration

 Appropriate Authority may suo moto on inspection / on


complain issue showcause notice to centre to show the
cause why registration should not be suspended or
cancelled for reason mentioned in notice, if satisfied after
Reason being heard may even suspend/cancel the
registration or take advise of Advisory Committee.
Appropriate Authority under 20 (3) in public interest if
of the opinion that it is necessary to take action may even
suspend registration without using notice under 20(1).

Centers within 30 days of action taken for
suspension/cancellation under section 20 can
appeal against order to.
1) Central Government – If order of Central
Appropriate Authority
2) State Government – If order of State Appropriate

Under Section – 22 – Offences &
Penalties
Prohibition of advertisements –
Relating PC PNDT Act and Punishment for
contravention of Act.
Sub Section – I – No person shall publish, distribute,
communicate or cause to be issued, any advertisements
in any form including internet for sex related matters /
publicity of place by any means scientic / otherwise.
Advertisement – in form to appear – Print form internet /
any media.
Section 22 – Contd..

Any person contravenes the provision of sub


section of Section 22 – shall be punishable
with imprisonment for 3 years and fine of
Rs. 10,000/-.
Section – 23
(1) Any person/RMP/Gynaec./Geneticist who
contravenes any of provision of act/rules Punishable
for imprisonment for 3 years and fine of Rs.10,000/-
if subsequent conviction – imprisonment – for 5 years
– & Fine Rs.50,000/-.
(2) Name of RMP – to be reported to State Medical
Council – for suspension of registration.
If any charge framed by court – till case is deposed of
–his name to be removed from the register of council
for 5 years for 1st offence for subsequent offence –
removal – will be permanent.

(3) Any person who seeks Aid of any centre for sex
selection / detection – punishable with term for 3 years
and fine of Rs.50,000/- for 1st offence .
For subsequent offence – term of 5 years –
Rs. 1 Lac fine.
(4) – Provision 23(3) will not apply to woman who is
compelled to undergo such test.
Section – 27

Every Offence under this act shall be non-baillable

Non Cognizable & non compoundable.


Section – 28
No court shall take cognizance – or offence under act
- except - complaint by--
1) Appropriate Authority or officer authorized by
State/Central Government.
2) A person who has given notice to Appropriate
Authority of not more than 15 days & his intention
to make complaint to court.

3) No court other than metropolitan


Magistrate/Judicial Magistrate of 1st Class – shall
try any offences.
4) Court Can direct Appropriate Authority to produce
available and relevant records available with
concerned person.
Section 29

1) Records / Forms to be maintained for 2 years


If any case / complaint – may be preserved till case is
disposed off.
2) Appropriate Authority can inspect the premises at
any required time and inspect the available records
under the provision of act.
Section – 30 -Power to search/seal/seize the
machine/records.

Appropriate Authority is authorized to enter & search


at all reasonable times of any centre with or without
assistance and examine any
records/registers/documents/pamphlets, books,
advertisement - if feels any contravention of act
seal/seize the same.
Section – 31

No suit / prosecution / other legal proceeding shall be


against central / State Government/Appropriate
Authority /any officer authorized – which is done in
good faith/ public interest under provision of act.
Rule-11 (1) & (2)

Under Rule – 11 (1) – Appropriate Authority- Power to inspect the


centres at any time/make any surprise visit/asked for
documents/records maintained etc.

Rule – 11(2)
The Appropriate Authority or the officer authorized by it may seal
and seize any ultrasound machine, scanner or any other equipment,
capable of detecting sex of foetus, used by any Orgn.if the Orgn. has
not got itself registered under the Act, These machines of the
Organisation may be released if such Orgn.pays penalty equal to
five times of the undertaking that it shall not undertake detection of
sex of foetus or selection of sex before or after conception

12(1) – Seal & seize the machine. Charge penalty 5
times the registration fees for any contravention of
act/for any unregistered machine – in presence of 2
independent witness by giving reasons in writing in
notice.

7) Help the law enforcing agencies to bring in book
the culprits and violators of act and rules.
8) On no account conduct/allow/cause to be
conducted female feticide.
9) Don’t comment any act of professional misconduct.
10) To follow medical ethics, save nation of female
feticide.

Section 12 (4) - If any item/object is of punishable
nature I.e., if Genetic Lab/Material invasive,
Appropriate Authority shall seal/transport/preserve the
same in refrigerator.
12 (5) – Premises can be sealed by A.A. in case of
incomplete search/seizure operation.
Rule 13 – Intimation for any change in
place/equipment/person or employee to A.A. within 30
days of such change.

Rule – 14 – No Genetic Lab should accept the material
unless referred by Genetic Clinic.
Rule-17 – (1) Display notice /message in English/local
language / for information to Public that / disclosure of
sex prohibited under law.
2) Copy of Act & rules to made available as premises.
3) Publishing names of PNDT centres for use by experts
& public.
On This Platform
All of you will promise & take oath.
Each & every one of us will not conduct any sex
selection/sex determination and help the nation and
Mumbai, Thane in particular by informing the A.A.
Special Officer, F.W., Civil Surg. Thane the names of
culprits who are involved in this practice and who are
responsible for drop in sex ratio. Register in FORUM OF
DOCTORS AGAINST SEX SELECTION. Your name
will be kept secrete and as per orders, even awards /
incentives will be offered.
PCPNDT ACT - GUIDELINES
1. Register all the places wherever USG machine/any
imaging machine like Color Doppler/2D/3D/4D
machine is used, including medical/ surgical
Nursing Home/ICCU wherever USG machine is
used.
2. A machine is to be registered in all the centres
wherever it is used. If portable machine is used in
more than one place, then it should be noted in all
places of use as portable machine and number of
machines, company name & make of machine,
should be noted in PCPNDT registration
certificate.

3. All radiologist /sonologist / Doctors using
machines, their names to be entered in the
PCPNDT certificate or on the separate sheet to be
displayed along with PCPNDT registration
certificate.
4. No doctor other than registered in that particular
centre should use that machine. Other qualified
doctor may use that machine after notifying to
Appropriate Authority.
5. Display Registration Certificate in Original in
Waiting Area and USG room.

6. Display on notice board the message in English and
local language that
"Sex Selection and Detection is not done in this
Centre" and is punishable
under the act. This should be displayed in Waiting
Area and USG Room.
7. PCPNDT Act book copy should be maintained in
the centre.
8.      "D" form to be maintained by Genetic Counseling
Centres only.
9.      "E" Form to be maintained by Genetic
Laboratories.

10. "F" Form to be maintained by USG Centre / Genetic
Clinic as per PCPNDT Act book for pregnant patients
only.
a. All column mentioned in “F” form should be filled up, no
Column should be added/ deleted.
b. Previous Obst. History of patients with number of
children with sex of each child should be mentioned in
“F” Form.
c. ‘F” Form to be filled up in Duplicate and copy to be given
to Appropriate Authority i.e., (M.O.H. of the Wards.)
d.Name of referral doctor, indication, results of USG must
be mentioned whichever column is not required must be
filled up as not applicable.

e. “F” form should be signed by doctor conducting
sonography & not by the owner of the centre.
f. Declaration of the patient and doctor should be
signed before doing the Sonography and after
explaining the patient in her own language as per the
Act.

11. Monthly report should be sent in time by 1st of


month by all PNDT registered Centres to
Appropriate Authority / by 3rd of month by A.A. to
Special Officer, F.W. & M.C.H./M.I.S.
12. "H" Form to be maintained & updated time to time
by Appropriate Authorities & to be informed to
Special Officer, F.W. & M.C.H.

13. All records of all the patients to be maintained for
minimum 2 years or if any legal case against the centre
is pending then records to be maintained till the same
case is disposed off.
14 Any changes in centre - like machine / Doctor should be
intimated to A. A. within 30 days. Accordingly He/She
should do changes in registration certificate
immediately and inform Special Officer, F.W. & M.C.H. in
writing and also does the changes in "H" Register.
15. For renewal of Registration, apply one month in
advance to A.A. Otherwisecentre will be considered as
un-registered. Penalty of Rs.15,000/- will be charged.

16 M.O.H.(Appropriate Authority) should remind to
concerned centre regarding date for renewal at
least 2 months to the centre.
17.Application form "A" to be submitted in duplicate
along with documents of machine and
undertaking duly notarized stating Sex
Selection/ & Sex Detection is not done in Centre
and Centre will display the message in
English & Local language that Sex Selection &
Detection will not be done at the Centre which is
punishable under the act.

18. Declaration of pregnant woman
& declaration by doctor should be
signed in duplicate by patient &
doctor. One copy of it should be
handed over to the patient & another
copy to be maintained by the centre.
19.Advertisement of any sort is banned
even on internet, or coding form -
Punishable under the act - Rs.1 Lac
fine with 5 years imprisonment
