Thisisacaseinwhichawell-knowncompany,StephensMedia,hasbeenneedlessly

addedasapartytoasimilarlyneedlesscounterclaim,despiteitsutterdisconnectiontothe

pertinentfactualandlegalissuesatissueherein.StephensMedia'sinvolvementwith

Righthaven,aswellasitsinvolvementwiththislawsuit,islimitedtoitsroleastheassignor
of

thesubjectcopyright.StephensMedia'sinvolvementwithDemocraticUndergroundisvirtually

non-existent.
As
apracticalmatter,thefactsclearlydemonstratetheimpropriety
of
Democratic

Underground'sefforts:StephensMediadid
not
filetheoriginalcopyrightactionagainst

DemocraticUnderground,StephensMediaisnottheholder
of
thecopyright,andStephens

MediahasdonenothingtoprecipitatethependingCounterclaim.

DemocraticUndergroundlacksstandingtobringthependingCounterclaimagainst

StephensMediabasedonthesimplefactthat
no
justiciablecaseorcontroversyexistsbetween

theparties;
nor
isthereanythreat
of
animminentcaseorcontroversy.

StephensMedia,ownstheexclusiverightto

seekredressforpast,present,andfutureinfungements

thesubjectcopyright,StephensMedia

isnottherealpartyininterestandisthusbarredfrompursingactions
of
thisnature.

Accordingly,DemocraticUndergroundcannotlegitimatelyclaimtofeelthreatened
by
imminent

legalactionbrought
by
StephensMedia.

Additionally,theCounterclaimshouldbestricken,ordismissedforfailuretostateclaim

becausethejudgmentsought
by
DemocraticUndergroundisamirrorimage
of
thereliefsought

in
theoriginalComplaint.Thecourtshaveconsistentlystrickenordismissedcounterclaims

whichraisethesamefactsandlegalissuesasthoseasserted
via
affirmativedefenses,or

counterclaimswhichmerelypursuetheoppositeeffect
of
theoriginalcomplaint.Such

repetitious,superfluousclaimsaddnothingtothepleadingsandmustyieldtoconsiderations
of

practicalityandefficientjudicialadministration.Ultimately,theCourtshouldavoidexpending

itsresources
on
DemocraticUnderground'sCounterclaimasallclaimsanddefensesraised
in

saidCounterclaimwillbefullyadjudicatedasthenaturalandinevitableconsequence
