TaskForce
at
the
Washington
Field
Office.

served
asa
Special
Agent
for
over
four
years
and
have
conducted
numerous
investigations
of
terrorismthreatsdirectedattargetswithinthenationalcapitalregion.2.Thisaffidavitissubmittedinsupport
of
acriminalcomplaintandarrestwarrant
forAwaisYounis,alsoknownasSundullah,alsoknownasMohhanmeKhan,alsoknownas
Sunny.
Basedonthe
facts
containedherein,thereisprobablecausetobelievethat
Awais
Younishascommittedaviolation
of
federallaw.thatiscommunicatingthreatsusinginterstate
communications
in
violation
of
18
U.S.C.
875(c).

experience,andinformationobtained

requested
warrant

PROBABLE
CAUSE
4.Onorabout
11/28/2010,
FBI
New
OrleansOfficereceived
a
complaintregarding
apersonmakingseveralthreatstouseexplosivesintheWashington,D.C.area,toincludethe
WashingtonD.C.METROtransitsystem.TheinformationwassenttoFBIWashingtonField
Office.ComplainantidentifiedthesubjectasSundullah"Sunny"Ghilzaiandhadcontactwith
himthroughFacebook,anonlinesocialnetworkingsite.Thecomplainantrecountedthatduring
achatwithGhilzaiinNovember2010,Ghilzaidescribedhowtobuildapipebombandwhat
typeofshrapnel
would
causethegreatestamountof
damage.
Ghilzaialsostatedthathecouldplaceapipebombunderasewerheadin
Georgetown
(assumedtobeareferencetothe
neighborhood
in
Washington,D.C.)
at
rushhour
to
produce
thegreatest
number
ofcasualties.
GhilzaifurtherstatedthatthethirdandfifthcarsintheMETROtrainshadthehighestnumber
of
commutersonthemandhecouldplacepipebombsintheselocationsandwouldnotbenoticed.
Complainantresponded
by
saying
"youwouldn'tdo
that,"
and
Ghilzaireplied
by
saying,
"watch
me."ComplainantalsorelatedthatGhilzaihas
many
photographsonhisFacebookprofile.One
photographshowedGhilzai
in
Afghanistan
holding
an
AK-47
rifle
withhis
uncle
standing
in
frontofatentwithexplosivesinthetent.Thecaptionforthephotographread,"Myfamily
business."Aseparatephotographpostedon
12/01/2010
depictedahandholdingrifleroundsfor
amachinegunwiththecaptionreading"bulletbehindeveryrock."Also,accordingtocomplainant,subjecthadrecentlystatedonFacebookthat"Christmastreesweregoingtogo
boom."

548712700.
A
preservationrequest
was
sentto
Facebook
for
ID:
548712700
and
a
GrandJury
subpoena
was
issued
for
subscriberinformation
for
Facebook
ID:
548712700.
The
results
ofthe
GrandJury
subpoena
showed
thatthesubscriberprovidedemailaddress
sunnyisbeast22(a).hotmail.corn.
which
isthe
sameemail
addresslisted
on
Sundullah
Ghilzai's
Facebookprofile
and
provided
by
thecomplainant.On12/03/2010,asearchwarrantissuedbytheU.S.DistrictCourtforthe
EasternDistrict
of
VirginiawasservedonFacebookforFacebookID548712700.Areview
of
theresults
of
thesearchwarrantshowedthatthesubject,SundullahGhalzai,appearedtobethe
soleuser
of
theaccount.Furtherreview
of
theFacebookinformationshowedthatthesubject
listedhiscellphoneas(571)276-6427.Results
of
thesearchwarrantalsoshowedthata
majorityoftheInternetProtocol(IP)addressesthat
were
usedwhenSundullahGhalzai
logged
ontohisFacebookaccountwere69.143.164.219.IknowthatIPaddressisanacronymfor
InternetProtocoladdressandisacodemadeupofnumbersseparatedbythreedotsthat
identifiesaparticularcomputerontheinternet.A

Jurysubpoenawas
served
onComcast
Communications
for
subscriberinformation
forIPaddress
69.143.164.219.
The
results
show
thatthesubscriberis
Mohhanme
Khan
at
