Short title.This act shall be known and may be cited as the HealthInformation Technology Act.Section 102. Definitions.The following words and phrases when used in this act shallhave the meanings given to them in this section unless thecontext clearly indicates otherwise:"Clinical decision support system." An interactive computersystem that assists health care providers in applying new

information to patient care through the analysis of patient-specific clinical variables."Community-based health care clinic." A nonprofit healthcare center located in this Commonwealth providing comprehensivehealth care services without regard for a patient's ability topay and:(1) meets either of the following criteria:(i) serves a federally designated medicallyunderserved area, a medically underserved population or ahealth professional shortage area; or(ii) serves a patient population with a majority ofthat population having an income less than 200% of theFederal poverty income guidelines; and(2) includes any of the following:(i) a federally qualified health center as definedin section 1905(1)(2)(B) of the Social Security Act (49Stat. 620, 42 U.S.C. § 1396d(1)(2)(B)) or a federallyqualified health center look-alike;(ii) a rural health clinic as defined in 1861(aa)(2)of the Social Security Act (49 Stat. 620, 42 U.S.C. §1395x(aa)(2));(iii) a hospital outpatient clinic certified byMedicare;(iv) a free or partial-pay health clinic thatprovides medical home and primary care services byvolunteer and nonvolunteer health care providers; or(v) a nurse-managed health care clinic that ismanaged by advanced practice nurses, a federallyqualified health center or an independent nonprofithealth or social services agency.20090HB2106PN2936

"Department." The Department of Community and EconomicDevelopment of the Commonwealth."Fund." The Health Information Technology Fund establishedin section 503."Health care facility." A health care facility as definedunder section 802.1 of the act of July 19, 1979 (P.L.130,No.48), known as the Health Care Facilities Act, or an entitylicensed as a hospital under the act of June 13, 1967 (P.L.31,No.21), known as the Public Welfare Code."Health care provider." A person licensed by theCommonwealth to provide health care or professional medicalservices. The term includes, but is not limited to, a physician,a dentist, a pediatrician, a certified nurse midwife, apodiatrist, a certified registered nurse practitioner, aphysician assistant, a skilled nursing facility, nursing home,home health entity, a community-based health care clinic andcommunity mental health center."Health information." Information that:(1) is created or received by a health care provider,health plan, public health authority or health careclearinghouse; and(2) relates to the past, present or future physical ormental health or condition of an individual, the provision ofhealth care to an individual or the past, present or futurepayment for the provision of health care to an individual."Health information exchange" or "HIE." The electronicmovement of health-related information among organizationsaccording to nationally recognized standards."Health information technology."
