TAYLOR AND YUDICHAK, JULY 16, 2010REFERRED TO COMMITTEE ON STATE GOVERNMENT, JULY 16, 2010AN ACTAmending the act of June 3, 1937 (P.L.1333, No.320), entitled"An act concerning elections, including general, municipal,special and primary elections, the nomination of candidates,primary and election expenses and election contests; creatingand defining membership of county boards of elections;imposing duties upon the Secretary of the Commonwealth,courts, county boards of elections, county commissioners;imposing penalties for violation of the act, and codifying,revising and consolidating the laws relating thereto; andrepealing certain acts and parts of acts relating toelections," providing for affidavits of candidates, fornomination petitions, for substituted nominations, forvacancies and for form of ballots.The General Assembly of the Commonwealth of Pennsylvaniahereby enacts as follows:Section 1.  Sections 630.1 and 910 of the act of June 3, 1937(P.L.1333, No.320), known as the Pennsylvania Election Code,amended May 12, 2006 (P.L.178, No.45), are amended to read:Section 630.1.  Affidavits of Candidates.--Each candidate forany State, county, city, borough, incorporated town, township,school district or poor district office, or for the office ofUnited States Senator or Representative in Congress, selected asprovided in section 630 of this act, shall file with the

nomination certificate an affidavit stating--(a) his residence,with street and number, if any, and his post-office address; (b)his election district, giving city, borough, town or township;(c) the name of the office for which he consents to be acandidate; (d) that he is eligible for such office; (e) that hewill not knowingly violate any provision of this act, or of anylaw regulating and limiting election expenses and prohibitingcorrupt practices in connection therewith; (f) unless he is acandidate for judge of a court of common pleas, the PhiladelphiaMunicipal Court or the Traffic Court of Philadelphia, or for theoffice of school board in a district where that office iselective or for the office of justice of the peace, that he isnot a candidate for the same office of any party or politicalbody other than the one designated in such certificate; (g) thathe is aware of the provisions of section 1626 of this actrequiring election and post-election reporting of campaigncontributions and expenditures; [and] (h) that he is not acandidate for an office which he already holds, the term ofwhich is not set to expire in the same year as the officesubject to the affidavit; and (i) that he is not a candidate fornomination for or election to more than one public office to befilled at the special election or any primary, municipal orgeneral election held on the same date.Section 910.  Affidavits of Candidates.--Each candidate forany State, county, city, borough, incorporated town, township,ward, school district, poor district, election district, partyoffice, party delegate or alternate, or for the office of UnitedStates Senator or Representative in Congress, shall file withhis nomination petition his affidavit stating--(a) hisresidence, with street and number, if any, and his post-office20100HB2653PN4111

address; (b) his election district, giving city, borough, townor township; (c) the name of the office for which he consents tobe a candidate; (d) that he is eligible for such office; (e)that he will not knowingly violate any provision of this act, orof any law regulating and limiting nomination and electionexpenses and prohibiting corrupt practices in connectiontherewith; (f) unless he is a candidate for judge of a court ofcommon pleas, the Philadelphia Municipal Court or the TrafficCourt of Philadelphia, or for the office of school director in adistrict where that office is elective or for the office ofjustice of the peace that he is not a candidate for nominationfor the same office of any party other than the one designatedin such petition; (g) if he is a candidate for a delegate, oralternate delegate, member of State committee, Nationalcommittee or party officer, that he is a registered and enrolledmember of the designated party; (h) if he is a candidate fordelegate or alternate delegate the presidential candidate towhom he is committed or the term "uncommitted"; (i) that he isaware of the provisions of section 1626 of this act requiringpre-election and post-election reporting of campaigncontributions and expenditures; [and] (j) that he is not acandidate for an office which he already holds, the term ofwhich is not set to expire in the same year as the officesubject to the affidavit; and (k) that he is not a candidate fornomination for more than one public office. In cases ofpetitions for delegate and alternate delegate to Nationalconventions, the candidate's affidavit shall state that hissignature to the delegate's statement, as hereinafter set forth,if such statement is signed by said candidate, was affixed tothe sheet or sheets of said petition prior to the circulation of20100HB2653PN4111
