Sec.9101.  Scope of part.9102.  Declaration of policy.9103.  Construction of part.§ 9101.  Scope of part.This part relates to public-private transportationpartnerships.§ 9102.  Declaration of policy.(a)  Legislative findings.--The General Assembly finds anddeclares as follows:(1)  There exists a public need for the timelydevelopment and operation of transportation facilities withinthis Commonwealth which address the needs of Commonwealth,regional or local transportation by improving safety,reducing congestion, abating environmental pollution,advancing energy efficiency or conservation, improvinghomeland security and increasing capacity or enhancingeconomic efficiency.(2)  This public need may not be wholly satisfied throughthe use of currently existing methods of financing andprocurement in which transportation facilities are developedor operated.(3)  Authorizing private entities to develop and operatetransportation facilities may result in the availability ofthese transportation facilities to the public in a moretimely, more efficient or less costly fashion, therebyserving the public safety and welfare.(b)  Intent.--It is the intent of this part:(1)  to encourage investment in this Commonwealth byprivate entities to assist in the development and operation20090HB1510PN1870

of transportation facilities; and(2)  to accomplish the goal under paragraph (1), toprovide public entities and private entities with thegreatest possible flexibility in contracting with each otherfor the provision of the public services which are thesubject of this title.§ 9103.  Construction of part.(a)  Liberal construction.--This part shall be liberallyconstrued in conformity with and to accomplish section 9102(relating to declaration of policy).(b)  Sole authority.--This part provides public-privatetransportation partnership opportunities to public entities andprivate entities and shall be construed as the sole statutoryauthority enabling a public entity to participate with a privateentity in a transportation-related contract, project or activitygoverned by this part.CHAPTER 92PUBLIC-PRIVATE TRANSPORTATION PARTNERSHIPSSec.9201.  Definitions.9202.  Prerequisite for operation.9203.  Approval.9204.  Service contracts.9205.  Transfer and dedication of public property.9206.  Powers, duties and liability of private entity.9207.  Interim agreement.9208.  Comprehensive agreement.9209.  Multiple affected public entities.9210.  Federal, Commonwealth and local assistance.9211.  Financing.20090HB1510PN1870
