That the House agree to the amendmentsnumbered 1 and 2 of the Senate to the bill (H.R. 5281) enti-tled ‘‘An Act to amend title 28, United States Code, to clarify and improve certain provisions relating to the removal of liti-gation against Federal officers or agencies to Federal courts,and for other purposes.’’ and be it further
 Resolved,
That the House agree to the amendment num- bered 3 of the Senate to the aformentioned bill, with the fol-lowing 
HOUSE AMENDMENT TO SENATE AMENDMENT:
 At the end of the matter proposed to be inserted by the Senate amendment numbered 3, add the following:
SEC. 4. SHORT TITLE.

 Notwithstanding section 1, sections 5 through 16 of 
2
this Act may be cited as the ‘‘Development, Relief, and Edu-
3
cation for Alien Minors Act of 2010’’ or the ‘‘DREAM Act
4
of 2010’’.
5
SEC. 5. DEFINITIONS.
6
 In this section and sections 6 through 16 of this Act:
7
(1) I 
 N GENERAL
.—Except as otherwise specifi-
8
cally provided, a term used in this section and section
9
6 through 16 of this Act that is used in the immigra-
10

tion laws shall have the meaning given such term in
1
the immigration laws.

(2) A
 RMED FORCES
.—The term ‘‘Armed Forces’’
3
 has the meaning given the term ‘‘armed forces’’ in
4
 section 101(a) of title 10, United States Code.

(3) C
ONDITIONAL NONIMMIGRANT 
.—

(A) D
 EFINITION 
.—The term ‘‘conditional
7
 nonimmigrant’’ means an alien who is granted
8
conditional nonimmigrant status under this Act.
9
(B) D
 ESCRIPTION 
.—A conditional non-
10
immigrant—
11
(i) shall be considered to be an alien
12
 within a nonimmigrant class for purposes
13
of the immigration laws;
14
(ii) may have the intention perma-
15
 nently to reside in the United States; and
16
(iii) is not required to have a foreign
17
residence which the alien has no intention
18
of abandoning.

(4) I 
 MMIGRATION LAWS
.—The term ‘‘immigra-
20
tion laws’’ has the meaning given such term in sec-
21
tion 101(a)(17) of the Immigration and Nationality
22
 Act (8 U.S.C. 1101(a)(17)).

(5) I 
 NSTITUTION OF HIGHER EDUCATION 
.—The
24
term ‘‘institution of higher education’’ has the mean-
25

ing given such term in section 102 of the Higher Edu-

cation Act of 1965 (20 U.S.C. 1002), except that the
2
term does not include an institution of higher edu-
3
cation outside the United States.

SEC. 6. CANCELLATION OF REMOVAL OF CERTAIN LONG-

TERM RESIDENTS WHO ENTERED THE

(1) I 
 N GENERAL
.—Notwithstanding any other
11
 provision of law and except as otherwise provided in
12
this section and sections 7 through 16 of this Act, the
13
Secretary of Homeland Security may cancel removal
14
of an alien who is inadmissible or deportable from the
15
United States, and grant the alien conditional non-
16
immigrant status, if the alien demonstrates by a pre-
17
 ponderance of the evidence that—
18
(A) the alien has been physically present in
19
the United States for a continuous period of not
20
less than 5 years immediately preceding the date
21
of the enactment of this Act and was younger
22
than 16 years of age on the date the alien ini-
23
tially entered the United States;
