MISSISSIPPI LEGISLATURE                        REGULAR SESSION 2009 By:  Representatives Dickson, Whittington               HOUSE BILL NO.  658   AN ACT TO CREATE THE JOINT PERMANENT LEGISLATIVE OVERSIGHT1COMMITTEE ON CRIME AND CORRECTIONS AND TO PROVIDE THE MEMBERSHIP2AND DUTIES OF THE COMMITTEE; AND FOR RELATED PURPOSES.3BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:4
SECTION 1.
(1)  There is created the Joint Permanent5Legislative Oversight Committee on Crime and Corrections.6(2)  The committee shall consist of the following twelve (12)7members:8(a)  The Speaker of the House of Representatives who9shall serve ex officio;10(b)  Five (5) members appointed by the Speaker of the11House of Representatives, which shall include at least one (1)12member of the House Ways and Means Committee or the successor of13such committee;14(c)  The Lieutenant Governor who shall serve ex officio;15and16(d)  Five (5) members appointed by the Lieutenant17Governor which shall include at least one (1) member of the Senate18Finance Committee or the successor of such committee.19The committee shall select from among its membership a chair20and vice chair who shall not be members of the same chamber.21Members shall be appointed for three-year terms.  Appointments and22vacancies on the joint committee shall be filled by the respective23selecting and appointing authorities.24(3)  The duties of the joint committee shall be as follows:25

(a)  Make recommendations from time to time to the26Legislature to facilitate the efficient and effective operation of27the Department of Corrections; and28(b)  Diligently inquire and fully examine the state's29present and long-term needs in regard to the Department of30Corrections and file reports of its findings and recommendations31to the Legislature no later than the fifteenth legislative day of32each regular session.33(4)  The joint committee may regularly examine all aspects of34the operations of the Department of Corrections.  The committee,35upon request, may examine any proposed correctional facility36telephone contract at least thirty (30) days prior to the37beginning of the initial contract agreement or renewal contract38agreement.  If the committee requests the Department of39Corrections to submit proposed telephone contracts for review, the40department shall provide the proposed contracts and related41contractual documents at least forty-five (45) days before the42beginning of the contractual period.43(5)  The joint committee or any of its individual members or44any consultant employed by the committee may make announced or45unannounced inspections or visits to the Department of Corrections46and its operations and facilities at any time.47(6)  Upon request of the chair of the joint committee, the48Secretary of the Senate and the Clerk of the House shall provide49necessary clerical and legal staff employed by the Legislature as50well as any assistance made available to it by any state agency51for the work of the committee.52(7)  The joint committee may use two (2) individuals, one (1)53from the Department of Public Safety and one (1) from the Office54of the State Auditor, to assist the committee in evaluating55potential problem areas of the Department of Corrections.56(8)  The joint committee may contract with and provide57compensation for any consultant or person not presently employed58
