Initial Case Narrative by C. 1. Berry #1088 on 09/23/04 at 1409 hrs. Total Dictation Time = 5:16 mins.

No charges are going to be pressed in this case at this time as the victim, Jared Loughner, did not want to pursue charges until he talks to his parents.

NARRATIVE:

On 09/23/04, at approximately 1230 hours, I was contacted by the assistant principal of Mountain View High School, Susan Sloan. She stated a student, Jared Loughner, had reported that someone had stuck him with a pin, a stolen type needle, today in the cafeteria. I asked if I could speak with the victim.

The victim, Jared, stated he was in the cafeteria talking with some friends when another student identified as Anthony "Tony" Kurz had walked by him and came towards him and poked him with something sharp. Two other kids said, hey, he just poked you with a needle. He stated as soon as he figured out that he was poked with a needle, he started to become pale, got dizzy, could not stand and had to be helped to a nurse's office by another friend.

You could see that on his right arm between his elbow and his shoulder, that there was a prick mark. I asked Jared exactly how it had happened. He stated Tony had had an insert from an ink pen and through the top of the plastic part of the ink pen, he had taken a needle and pushed it all the way through one side to come out the other side and in a flicking motion made it into like a hammer that slapped into his arm and poked him.

He stated he had talked to his parents and that they do not want to press charges at this time; however they do want Tony tested to see if he has HIV or any other kind of diseases.

I asked if I could speak with the suspect. The suspect, Anthony Kurk AKA Tony was advised of his Miranda Rights at 1320 hours and stated yes, he would talk to me. He stated that his friend, Daryl Eskridge,

had made this hammer type needle through the top of a plastic pen. He stated if you hold the bottom pen where the writing part is and then

use your hand to pull it backwards and flick it in a hard motion, that the needle coming out the side would poke people. Tony stated he had poked himself a couple of times with the pen and tried to poke a couple of other friends; however. it did not go through their

clothing. He stated he does not particularly remember poking Jared with the pen but it is possible that he could have. He stated he did not know where the needle is now as he had lost it somewhere. He

stated he was sorry and he knew what he was doing was wrong but he was not thinking at the time.

I advised him the victim, Jared, did not want to pursue charges at this time; however, the next couple of days it is possible that he could be arrested for Assault.

Due to the fact the victim does not want to pursue charges, this concluded my activity in this matter at this time.

On 05/12/06 at approximately 0900 hours I was contacted by the assistant principal of Mountain View High School, Susan

Ms. Slong advised me that a student identified . was

at the nurse's office currently under the influence of some type of intoxicant most likely Vodka. She advised that he was so extremely intoxicated that he had to be transported to Northwest Hospital to the Emergency Room.

I responded to the Emergency Room where I contacted ~ He advised that he drank appropriately 350 milliliters of Vodka between the hours of 0130 hours

and 0900 hours. He advised he drank the alcohol because he was very upset as his father yelled at him. I could see his eyes were very red and he was

crying and had a strong odor of intoxicants coming from his body and

breath. I was advised by the the nursing staff that he had stolen the

alcohol from his father's liquor cabinet.

His parents, Mr. and Mrs. Loughner arrived at the hospital. I explained the situation to them and advised he was under Arrest for Consuming Alcohol. They signed the paper referral and remained at the hospital.

The following items were placed into Evidence at the Foothills District Office in evidence lockers:

1. EV 1 : Qty. 1: Marijuana roach.

2. EV2: Qty. 1: Multi-colored marijuana pipe.

3. EV3: Qty. 2: Packages of zig zag rolling papers.

These items were placed into Locker #F19 at 0050 hours on 09/10107.

NARRATIVE:

On 09109107, at approximately 2316 hours, I responded to a suspicious vehicle ~ *************************************

had seen a white van bearing Arizona license plate #905DYE parked near her wall. I responded to the area and began looking for the white van. I was

unable to locate any white van parked near the reportee's address or wall. I began to broaden my search and expand out to the nearby streets. I turned onto Soledad and began northbound from Red Wing when I observed a white minivan drive passed me with two occupants. The vehicle was northbound on Soledad. I turned around and began to follow the vehicle. The vehicle turned eastbound onto Red Wing and then northbound onto Northaire. At that time, I was able to get a look at the license plate which was Arizona license plate #905DYE, the same that the reportee had called in.

I activated my emergency equipment and performed a traffic stop on the vehicle as it neared Orange Wood on Northaire. The vehicle pulled to the right. I approached the driver's side of the vehicle and made contact with the driver.

I was able to detect a strong odor of burnt marijuana. I requested a backup unit to respond which Deputy K. A. Atwell #4970 responded.

Once Deputy Atwell arrived, I asked the driver to step out of the vehicle. The driver was very apprehensive about getting out of the vehicle. I informed him that if he did not step out of the vehicle, I would forcefully remove him from the vehicle. The subject, by this time, had been identified with his Arizona

driver's license as Bryce Howard Tierney ( DOB **********and finally stepped out of the vehicle. I asked him where was it at. He stood there staring at me and

I asked him again where is it at. He then said, where is what at. I then placed him in handcuffs and detained him until I completed my investigation.

I advised Deputy Atwell to have the passenger step out of the vehicle as well. See Deputy Atwell's supplement for further information.

I walked Bryce back to my vehicle and read him his Miranda Rights verbatim at 2335 hours. I asked Bryce where was the marijuana, He stated there was a marijuana joint in the ashtray. I asked him if there was any other marijuana items in the vehicle. He stated it was just a joint. I asked him if he had

been smoking the marijuana. He stated he had, both he and the other occupant had been smoking the marijuana joint on the way back from the Circle K.

I placed Bryce in the back of my patrol vehicle and informed Deputy Atwell that I had one subject who was being detained.

I went back to the vehicle and began to search for the item that had been emitting the burnt odor of marijuana. Since Bryce had said it was in the ashtray, I looked to see if I could see an ashtray, at which point, I could

not. I began opening different compartments that were part of the dashboard in hopes of finding the ashtray. While searching for the ashtray compartment, I opened up a large compartment down near the floorboards which looked to be some sort of bin, at which time, I found a package of zig zag rolling papers. I

continued to look some more working my way up from the floor going up the center console and I was then able to find a multi-colored glass marijuana pipe

that was on the roof and the center console which would have been for a pail' of sunglasses 01' the garage remote.

Continuing the search, I moved to a Big Gulp Thirstbuster style plastic cups

out of the cup holders and I was able to locate the ashtray. I then retrieved

a burnt marijuana roach. Another package of zig zags was located under the passenger seat in the storage compartment that was closed when I went up to the vehicle. There were no other illegal items found in the vehicle. All the

items were taken back to my patrol vehicle, secured in a plastic bag and placed in my trunk.

I filled out a citation citing Bryce for violation of ARS13-3415, Possession of Drug Paraphernalia for the marijuana roach, the multi-colored marijuana pipe

and the two packages of zig zags. I went back and asked Bryce what he uses the zig zags for. He sat there quietly and stared at me, I asked him again what

he uses the zig zags for, He stated for that. I asked him what that was, He said, "you know for that", I again asked him what that meant. He then stated "for smoking marijuana and rolling joints".

I conducted a search incident to arrest of Bryce finding nothing of an illegal nature on him. It was at that time that he was taken out of handcuffs, signed his citation and given back any items that were his that were not of an illegal nature and sent on his way.

Supplement Dictated By K. A. Atwell #4970 on 09/10107 at 0518 hrs. Total Dictation Time = 4:48 mins.

On 09/09/07, I responded as a backup unit for Deputy J. Garcia #5794 at the intersection of Northaire and Orange Wood.

Upon my arrival, I saw that Deputy Garcia had the driver out of the vehicle and questioning him. I went up to the passenger side and asked the passenger who was later identified as Jared Lee Loughner to step out of the vehicle.

When he stepped out of the vehicle, I asked him if he had any contraband on him and he stated no. I asked if I could search him. He said he had a right to

say no. I advised him that he did; however, he never stated no, he just

advised me that he had the right to say no, which I informed him that he did. Due to his vague answer, I decided not to push the situation any further; however, while I was standing there at the vehicle and I closed the vehicle

door, I then smelled a strong odor of burnt marijuana coming off of Mr. Loughner's person. I then advised him of the situation and I informed him that the smell of marijuana was not coming from the vehicle as I has closed the door and the window, was up and I knew the smell was coming off of his person.

Deputy Garcia advised me he detained his subject and was moving him back to the rear of my patrol vehicle I asked him if he had anything on him again; however,

I was not asking of I could search him, I was just simply asking if he had any items that I needed to know about before he sat in the rear of my patrol

vehicle. The subject then advised me he had a marijuana pipe in his front,

left pocket. I removed the pipe and it had residue inside of it. It was approximately three inches and glass. I at a later time placed that evidence

into Locker F21 at the Foothills Substation and gave it an Evidence Item #KAl.

After I removed the pipe from Mr. Loughner's pocket, I put it on the hood of my patrol vehicle and placed him in the rear of my patrol vehicle. .A short time later while searching the vehicle, I located a glass marijuana pipe up in the center console region; however this center console is on the roof of the

vehicle. It was where various items could be stored in a container above on

the roof, which pulls down when one press on it, i.e. for holding a garage door opener or sunglasses. When I opened it up the (inaudible) fell off and a glass 'marijuana pipe with residue fell onto the floor. I advised Deputy Garcia of

what I had found.

I then read my subject Mr. Loughner his Miranda Rights and asked him if the pipe in his pocket was his. He stated it was. I asked him about the pipe in the center console. He stated it was not his. I asked him if there was

anymore marijuana or contraband inside the vehicle. He stated no there was not as he had already smoked it, meaning him and the driver who was his friend.

Based off of those facts and circumstances, I cited Mr. Loughner for ARS 13-3415, Possession of Drug Paraphernalia, which is a Misdemeanor 1, reference Complaint # or Citation #502957. I gave him a court date of 10104/07, at 0830 hours. Once my investigation was done, I removed Mr. Loughner's handcuffs that were double locked behind his back and I had him sign his citation. I told him

he was not admitting guilt, he was just going to be promising to appear on his court date. He stated he understood and he signed the citation. I then gave

him a copy of his citation.

Once Deputy Garcia was done with his investigation, all parties were free to leave.

On 03/22/08 I was dispatched to a vandalism call at ************************************* hours. Upon arrival, I made contact with Randy Loughner ( DOB ********** Mr.

Loughner stated that between the hours of 0030 and 1100, there were rocks

thrown to the back of his Chevy Nova breaking the back window. Damage to the

window was approximated at about $200. There were no items taken from the

vehicle.

I provided Mr. Loughner with the case number along with Victim's Rights information. I explained Victim's Rights information to him. Mr. Loughner stated he did not have any suspects in mind, but when he did or if he had any leads, he would call and advise.

This concludes my involvement to this case.

On 1 0/02/08~ at approximately 1548 hours, I handled an identify theft in reference to a walk in report at the Foothills District Office. I identified Jared Loughner ( DOB **********through his Arizona driver's license.

Jared advised that today, minutes prior, he Googled his name on the Internet

and the first search results that popped up were a PeekYou.com where Jared indicated that someone had posted a picture of him when he had long curly hair when he was approximately 16 years old. The other information was a listing from New York. He indicated that there was another link on that website for a MySpace account which showed the name Jared as the profile name, but listed a female aged 29 years old in the city of Schenecthey and the last login was OS/21107. The profile user did not have any friends listed. It appeared that

they had not used the MySpace account. The MySPace e-mail was "myspacedotcomscrewupretard. II

Jared said he tried to contact Peek You about this. I asked him what

Peek Y ou.com was, since I did not have knowledge of it. He said he did not either. He said they sent him a reply back saying that he needed to contact the police in regards to this. He said he did not have any financial loss but he was hoping that MySpace could track the IP address to the account.

Jared advised me that he believed possibly an old school friend named Alex

.It _" who he believed was 19 years old, who lived somewhere off Hardy but he was not sure, had possibly created these accounts with Jared's name and picture. He still was not sure. I asked him to explain to me how he knew Alex since he indicated he was an old school friend.

I noted that Jared was slow to respond to my questions. He often hesitated as if he was trying to think of an explanation. I asked him where Alex lived. He hesitated for a long time. I advised him that if he did not know he could just say that and that was fine. Jared said he did not know but then indicated Hardy but did not know the cross street.

Jared said that he last had contact with Alex approximately four months ago.

He said a few days ago he called Alex and questioned him if he had created the profiles. Alex never answered him. I asked Jared if he questioned Alex

further. He said he did not. He then rephrased his statement saying he did

not ask Alex if he had created the fake profiles using his information but that he asked Alex ifhe had his own PeekYou.com profile.

Jared said Alex's cell phone number was ********. I attempted to call this number but there was no answer.

Jared said he had no further information on who could have possibly created the account using his picture. The MySpace account just had the user name Jared, it did not have any personal information. He said that the link came up with his picture from PeekYou.com. I provided case information to Jared. He told me he could not provide me with anything further in regards to this. His concern was that he wanted a police report because he was concerned about trying to get jobs and having employers pulled this up and see someone using his identity on their profile. This concluded my contact with Jared.

I then went to my patrol vehicle and ran Jared's name. It immediately showed his driver's license return. There was a small message underneath his

information showing possible ID theft TriWest, verifiy document. I called the number that Jared told me was his cell phone number, ************, but did not get an answer and there was no voicemail.

Mr. Loughner advised he made a report reference identity theft on 10/02/08. He advised that during the initial report, he suspected a male subject by the name of Alex •••• 1 as being the suspect placing his information on his Myspace account.

Mr. Loughner stated that on today's date at approximately 2315 hours, he received a phone call from Alex. Mr. Loughner advised that he spoke to Alex

and told Alex that he had contacted the police reference his Myspace account and that he believed that Alex was involved in placing that MySpace account.

He informed Alex that he is the only one that had pictures of him back when he was 16 years old. Mr. Loughner advised that Alex appeared to be confused and said he did not have any idea what he was talking about. Mr. Loughner stated that Alex appeared to be mumbling and therefore, he still believes that Mr.

'(_[1'. ~as involved in the incident, even though he made the statement to him that he had no idea what he was talking about and it appeared he had no idea what he was talking about. Mr. Loughner had no other information to add reference this matter.

On 01/10/11, at 0120 hours, I responded to ************************************* suspicious activity call. Initial information received said there was a large

truck parked in the roadway at the Laughner address. The reportee did not know if anyone was in the house; did not know if anybody was supposed to be at the address, but thought it may be a person by the name of Randy Laughner moving, but was not positive. The truck was driving around with lights off before parking.

Upon arrival, I saw a large Freightliner truck parked in front of ....... ~. On the side of it large writing was North American TV. The driver opened up his door as I pulled up. I asked him what he was doing out here parked in the side of the road as I had never seen that truck before. He

told me, I am employed by Good Morning America and I am here ready to set some things up for a TV broadcast this morning. He identified himself as Lawrence E. Maxin ( DOB **********

The vehicle was parked, as far as, possible off of the roadway and was not creating a traffic hazard.

The reportee, Wayne Smith, who lives at ,..was phoned and apprised of the

findings. .

NARRATIVE:

On 01110/11 at approximately 0125 hours, I responded to *************************************

reference a suspicious vehicle.

The reportee in this case was Curtis Smith ( DOB **********

Mr. Smith stated he saw a large truck with the letters NA on the side. It was parked in front of the incident location.

According to Mr. Smith he did not recognize who this truck belonged to and had not seen this truck before.

Upon arrival along with Deputy B. R. Davis #1159, I saw a large, white, cargo-type truck with a Caucasian male sitting in the driver's seat. The vehicle. had. the large letters NA on the side of the driver's door. I noticed a satellite dish on top of the vehicle indicating to me it was some sort of communications-type truck.

Deputy Davis made contact with the driver of the truck and asked him if he was affiliated with any news agency. The driver stated he was part of the advance team for Good Morning America. There was going to be a story at the location here at the house.

I went over to **** ** ********** * **** ** ** ** **********

called 911 because he was concerned about the truck. He said he had never seen

the truck before and it did not have any markings to indicate that it was a news vehicle. He stated he was concerned and called 911 to have us examine the vehicle.

I explained to Mr. Smith the truck belonged to Good Morning America pel' the driver's statement to us. I told him it did, in fact, appear to be a communications-type truck.

Mr. Smith stated that he will keep an eye out for any additional vehicles that appear to be suspicious.

I told Mr. Smith per the driver's statement there was probably going to be more media vehicles out in front of the residence again today. He stated he was prepared for the media to back again today.

On 01110/10 at 9:37 A.M. I responded to ************************************* harassment call at that location. En route, I was advised via mobile data

computer that the owner of this residence had seen several persons hanging over

his back wall, trying to take pictures, and trying to come in the side gate.

Upon arrival, I made contact with L1. Theel on scene, who advised Deputy

Caudillo was in the vicinity with a suspect. I responded to Deputy Caudillo's

location, the intersection of Orangewood Dr. and Orangewood PI. He was out with two subjects, a Caucasian female, and a Caucasian male, All subjects were

standing in the vicinity of a silver 1996 Dodge van bearing Arizona license

ACB2442. Deputy Caudillo was making contact with the Caucasian female, later identified to me as Nicole Ullerich. I made contact with the male, identified

via a photograph on Arizona operator's licens~·. as Thomas Stuart

Gilmer, date of bhtha •• Mr. Gilmer stated he was a videographer

representing Gecko Broadcast Inc. The company was contacted the day prior by representatives from the television program "Inside Edition" requesting he

serve as a videographer for one of their reporters on scene.

Background checks of both individuals and the associated vehicle were negative. I stood by for security while Deputy Caudillo conducted interviews with both individuals and his investigation was complete. I then returned to the incident location and stood by for security until my presence was no longer required, N.F.I.

Upon arrival I stopped out with Deputy G. Caudillo #1452, who had two suspects detained on the side of the road. I asked him what he needed me to do. He

asked me to respond to the residence. I went on to ************************************* and met with Lieutenant D. E. Theel #860 and Sergeant P. V. Leonardi #632. I

was asked to get my camera and take photographs of the area where an individual

had entered Mr. Loughner's back yard, to take photographs of the foot prints

there.

I went to my patrol vehicle, grabbed my camera, went to the back yard and took photographs of where Mr. Loughner said the individual had walked in his yard. The photographs were later turned in for processing.

I was then instructed by Sergeant Leonardi to stand by and watch Mr. Loughner because they were going to take him to do a line-up. I stood by and waited for Deputy B. M. Joiner #5083 to retrieve his patrol vehicle, so we could walk Mr. Loughner straight out and put him into the car for the identification. Sergeant Leonardi then told me to bring Mr. Loughner out. I walked Mr. Loughner out and seated him in the back seat of Deputy Joiner's patrol vehicle. Deputy Joiner

then drove off.

I remained at the residence, waiting until they returned. Once they did so, I helped Mr. Loughner out of the patrol vehicle and walked him to his back yard, where I stood by with him. I was then instructed to get a taped statement from Mr. Loughner on the events that occurred today.

Deputy Joiner and I went into Mr. Loughner's house and conducted the interview. I taped his account of the events that took place today. See the CD copy for further information in reference to this statement.

I was informed there was another witness outside of the residence, in Mr. Loughner's front yard. I interviewed that individual. See the CD copy and transcription for that individual's eyewitness account of the events that took

place today. During that interview the subject identified two members of the press who were standing on the other side of Mr. Loughner's house, on the side of the road. I spoke with them. They stated they had no involvement. One indicated that he was in the back yard of the neighbor's house, but that is as close as he has gotten to Mr. Loughner's house. The other stated that he had never been in the alleyway behind Mr. Loughner's house and they did not have a female counterpart with whom they work. They stated they are freelancers for Fox News, knew the law and would not violate that because their bosses would have their "asses".

We continued to stand by as scene security while Lieutenant Theel gave a press conference. Once Lieutenant Theel was done, I left the scene.

When I arrived at the location, Deputy E. Barnes #5566 and I made contact with Lieutenant D. E. Theel #860, the Foothills District commander, along with Sergeant P. V. Leonardi #632, the Foothills Force Two supervisor, who were on scene speaking to a subject who lived at the residence named Mr. Loughner. I was quickly briefed by Lieutenant Theel that Mr. Loughner was stating he had been inside his residence and he had heard some noises and had seen a female subject in his backyard, apparently taking pictures of the backyard area. Mr. Loughner had told the lady to leave his house by opening a door and yelling at her and threatening to send his dog out that was inside with him.

According to Lieutenant Theel, the subject had then grabbed a nearby ladder in the backyard and climbed up the ladder and jumped over a brick wall on the far west side of Mr. Loughner's residence into a nearby alley. I was also advised

that Deputy G. Caudillo #1452 had stopped a female, who slightly matched the description given by Mr. Loughner, nearby in the area and an investigation was being conducted to see if she was the same female who Mr. Loughner had seen in the backyard of his residence.

Lieutenant Theel advised me to have Deputy Barnes take photos of the backyard area and of some footprints that were seen in some dirt next to the fence where the female was seen jumping over. See Deputy Barnes supplement for further information on that. However, as Deputy Barnes was taking photos of that area,

I was advised by Sergeant Leonardi that he wanted me to drive Mr. Loughner over to the area where Deputy Caudillo had stopped out with the female subject to see if Mr. Loughner could make a visual confirmation that it was in fact the same

subj ect he had seen.

Mr. Loughner's residence, I was advised by Sergeant Leonardi to back my patrol vehicle up as close to Mr. Loughner's backyard as I was able to, that he was going to shield him from the media and to see if we could him in the back my patrol vehicle as quickly as possible. He was going to place him in the back passenger side of my vehicle, but I was then to drive him over, just down the street, approximately a quarter of a mile away, to where Deputy Caudillo was with the female subject. I then went and retrieved my patrol car and backed it up to the area next to the fence surrounding the backyard area as Sergeant Leonardi had directed.

Once there, I unlocked the doors and waited until Sergeant Leonardi had placed Mr. Loughner in the backseat of my vehicle. I then drove Mr. Loughner over to the area where Deputy Caudillo was standing out with a female subject. See his initial case report for further information.

Mr. Loughner stated he was unable to make a complete match and wanted me to drive by again, slower, if possible. He also asked me if I was able to have a male subject, who was also seen with the female subject, stand near her so he could try to match both individuals which I advised Deputy Caudillo of over the radio. He also asked me if it would be possible for him to get a look at the camera that the female had with her because he stated he knows photography and had seen the camera she had been taking pictures with in the backyard area.

I advised him I would just be able to turn around and drive slowly past so he could see both individuals and would not be able to look at the camera at this time. He stated he understood. I then turned around and made a U'-turn and drove back by slowly again. Mr. Loughner stated as he looked at the female he thought he recognized her shoes and said he thought it was the same individual, however he stated this one had her hair pulled back into a ponytail and the subject he had seen had the same color hair, however she had her hair down around her face and did not have it back in ponytail. He also said he was unable to match the other description of the clothes she was wearing due to the fact she was wearing a large coat at this time.

I then advised Sergeant Leonardi that we were coming back to the residence and he made contact with us, again out in front of the residence, and escorted Mr. Loughner back inside his house. Once there, I was then directed by Sergeant Leonardi to standby with Deputy Barnes who conducted a taped interview of Mr. Loughner regarding the situation. Again, see his supplement for further information.

I also assisted Deputy Barnes as he went to speak to other members of the media who were standing across the street and might possibly be involved.

I then stood by while Lieutenant Theel briefed the media members on scene of what was occurring. All parties then left the scene.

On 12/21196 at 1310 hours I spoke by telephone to Amy Loughner, DOB ********** Ms. Loughner reported to me that her expiration tab was stolen from her license plate. Ms. Loughner told me she last noticed

her tab on 12/17/96 when she was getting gas in her car. She told me she noticed the tab missing today at approximately 1230 hours. She said the tab was from her 1972 Chevrolet, license plate GNL882. It was a 1997 tab, the month was August although only the year tab was taken.

Ms. Loughner says she does not know the exact location where her tab was taken from or exactly when. She has no suspect information. Ms. Loughner also advised the tab had been placed on top of expired tabs making it easier for removal without tearing. Ms. Loughner lives at *************************************

Initial Case Narrative by PSSS O. M. LaPare #1631 at 06:50:57 10/11/2002.

While working in the Telephone Reporting Center on 10/11/2002 at 0645 hours, I made telephone contact with Randy Loughner in reference to a V ANDALISM report. The following is what Randy told me.

Randy told me that on todays date at approximately 0600 hours, he noticed that the passenger side window on his 1966, Chevrolet truck, white, bearing Arizona license plate 407CZD had been smashed

out. Randy told me that the truck was parked in his front yard. Randy told me that on 10/10/2002 in the evening hours, he had parked the truck and the window was fine. Randy told me that he did notice any other damage, or anything missing from the truck. Randy had no suspect information.
