1 tnp surrounding the weekend of Sept 16th. The details have not yet been worked out, but the trip will likely leave CONUS the

that made them competitive to begin witti.Bl in contrast, in prolongedconflicts such as the Cold War. in wh'ih the United States
adapted a strategy that gave equal weight to preservingthe nation's competitive advantagesandstanding fast against an
enduring threat, the U S. not only prevailed, but thrived emerging more powerfulandjust as free as when the stand-offwiththe
Soviet Union began.

The lessons of the Cold war suggest that there are four elementsto a good long war strategy:[3]

I want to highlightthe elements of long war strategy, becausethe successful prosecutionofthree of them-providlng security,
protectingcivil society, and winning the war of ide-l depend in part on well Congress moves forward after in Hamdan v.
Rumsfefd.Congressshould authorize military commissions in a manner that respects equally all three of theseaspects of fighting
the long war.

Satisfying National Sammy

There are three issues at stake in ensuring fte nation has the right instrumentsfor fightingthe long war. First, military
commissions must be conducted in a manner that optimizes meeting national security interests. Second, the principleof law that
protects both U.S. soldiers and civilians on the battlefield must be preserved. Third, the cower oflhe Executive Branch to adapt
and innovate to meet the challenges ofwar should not be encumbered.

In order to optimize nationalsecurity interests, iwould argueagainstusing the U n h Code of MilitaiJustice (UCMJ) as a basis
for authorizlna rnilirv commissionsfor Wma unlawful combatants. The UCMJ is structured as a traditional teoal system that outs

Finally, the ExecutiveBranch's power to wage war ought not to be unduly encumbered. If there is one truism in war, it is that
conflict is unpredictable.Carl von Ciausewitz, the great 19th century Prussian military theorist called it the "frictionof battle."
Ciauswitz also said mat 'everything in war Is simple, but In war even the simple is difficult." That is why in drafting the
ConstiMton,the framers gave wide latitude to the Executive Branchm the conduct of war. They recognizedthat the president
needed maximum flexibility In adapting the Instrumentsof power to me demands of war. in bounding the president's traditional
war powers, Congress should take a minimalist approach.

Respectingthe Rule of Law

After September 11.the Bush Administration's criticsIrarred a %debate that indicated that citizens had a choice between
being safe and being free, arguing that virtually every exercise of executive power is an infringement on libertiesand human
rights. The issue of the treatment of detainees at Guantananm Bay has been framed in this manner. i t is a false debate.
Government has adual responsibility to protect the individual and'to protect the nation. The equitable exercise of both is
guaranteed when the government exercises power in accordancewith the rule of law.

In the case of the military tribunals, the Suoreme Court has outlined a rather narrow agenda for Congresstoensure that the rule

Thus there is no reason for Congressto require courts-martial under the UCMJ, to draft guidelines for new commission
procedures, or to partially overrule or repeal our ratification of the Geneva Conventions. Congress also appears to have approved
the president's military commissionsin the Detainee Treatment Act In Decemberof2005,although thecourt has ruled this
authorization Is not sufficiently specific. Iwould suggest that nothing has changed in the past few months that should alter the
sense of Congress

own countries won't take hack.
Host: If 100 are going to be sent back, that leaves roughly about 360.14 were sent back
to Saudi Arabia When they are sent back to their country,are they jailed or set free?
Reeder: The whole ganunit -everything you said ... it depends on the country. But my
point is that their host countries won't even take them back. Tells you something about
who you're dealing with. They are very dangerouspeople.
Host: Will Gitmo be forced to close or do you keep it open as you look for some sort of
legislativeagreement?

cow-mania]. And that's what the whole case comes down to. The Supreme C o m said,
first the Geneva Conventions awlv to the whole war on terror. what's eoine on at
C i ~ l a n a m oBay and everywhereh u n d the world. And the Geneva Convention says
the following. You can't set up a temporary penal tribunal, as they call it, iust to try one
set of You have to use a regular, preexistingcourt system, like the dis district
courts or regular court-martials.It then said the other reason you have to use regular
court-martiis or a US.district court is because they provide the protections akinst
hearsay and use of secret evidence that the commis&ns permit, but the U.S. Constitution
and Geneva Conventions wont allow.
GIBSON OK. So, explain what it is they warned to do. They wanted to say, look. we
have gut this evidence against you. We will show it to the judge, but we arenot going to
show vou.
NAPOLITANO: Right, or they wanted to say, so and so told us, when they arrested Mr.
Mohammed, that had a uun in his hand. even though the so and so is now dead, so, he
obv.ously can't testify. And the Supreme Court said the Uniform Code of Military
Justice, the federal military rules, the US. Constitution, and the Geneva Conventions
prohibit those things. They prohibit hearsay and they prohibit the use of secret evidence.
So, now the presiaent is left with this very, very difficult choice. He must decide between

revealing declassifyingclassified evidence and revealing its source, and using it in a

courtroom to convict someone. or not Wine that mrson and lettine them to. He has to
decide which of those awful choices is iess&ful to the country.-
GIBSON: OK, explain this, if you can. Apparently, Justice Breyer writing in a
concurringopinion -that is, he agreed with the majority opinion -said the ruling only
applies to Hamdan, and not others, and that there's nothing to stop the president from
approachingCongress to seek the authority he thinks is necessary to do what he wants.

NAPOLITANO: I 1can't explain it, because the majority opinion, which he signed,
disagrees with that. The majority opinion says it applies to everybody at Guantanamo
Bay. And the maiority opinion says, because the Constitution and the Geneva Convention
require that you &';use secret evidenceand you have to use a regular court-martial.and
Congress cant change the Conslitutionor the Geneva Convention, no legislation that the
Congress can write can accommodate this decision.

said to the president, you got special-ops in a back alley in Baghdad, Geneva Convention
applies. You got the CIA in the basement of a safe house in Afghanistan, the Geneva
Convention applies. The government, the Justice Department has been arguing before
every federal court that wants to hear this in the country for the past four years that the
Geneva Convention does not apply. And the Supreme Court has rejected that. That adds
to the president's burdens in prosecuting the war on terror.

The government's chief lawyer and those working for him conceded to me that they do
not have enough evidence to get a conviction before a military commission, which is the
easiest, before a court-martial,which is the next most difficult, before a federal district
court jury, which is the most difficult.
But they are satisfied, and they persuaded me from the evidence that they showed me.
that these are such bad, evil human beings that to release them into soci&, whether in
the Lnitcd States or outside the Umted States. would be suicidal, because these guys
would for sure return to kill their CaDIOIS. to attack the families of the captors, or to wane
war against us again in the Middle EM.
GIBSON: You have been an opponent ofwhat is going on in Oiuno. You havespoken
out again* it. And i think you have even written aboutit.
NAPOLITANO: 1have written extensively about it.
GIBSON: In both your books,
You saw interrog&ons. Did you see anything objectionable?
NAPOLITANO: Oh, no, no, not at all. The people conductingthe interrogationsfreely
admit that the procedures that they used before 2004 were more aggressive than now.
When the Supreme Court came down with its 8-1 decision, saying the Constitution
applies, the treaties apply, and the law applies, and the federal courts ofjurisdiction, they
stopped using the methods that about five FBI agents had complained about.
So, the interrogationsthat we saw, John, were about as mild as you and I conversingnow.

It's one interrogator. It's excuse me. It's one detainee. It's three interrogators,one of
whom is a translator.

of prisons in my prior life as a judge and I walked through this one. This is about as good
as they get in terms of facilities for the inmate, as prisons go, comfort for the inmate and
high-tech ability to do what you have to do in a prison. They spent a lot of money on it.
They spent $2.5 million last week on a fence to keen out local oeoole that were -

GIBSON: You know,we hear from the human rights community that one of the reasons
that Gitmo should be closed is the sense of hopelessnessthat detainees have because thev.

I1 don't know how they would ever gel out if they're going. are they entitled lo hope"
NAP0LITA.W: Well, 11depends who you ask. That's a great question, John. In my
n e w on the American constitution and the treaties we've signed, they are entitled to a
trial And if the government cannot prove their guilt, they shouldnt be there The
government knows this. How do I know this? Because they haven? sent any detainees
there since the Supreme Court ruled 8-1 that the constitution applies. Where are all the
detainees from I&? They stayed in Iraq. They're under the custody of the Iraqi
authorities.There's no new people coming to Guantanmo Bay.
GIBSON: And the supreme court is going to decide something soon?
NAPOLITANO: Yes. the case is vew comolicated but boiled down. 400 detainees filed
applicationsfor habeas corpus, meaning they want the government justify to a federal
judee why they're incarcerated without acharge After that was filed the Congress
enacted a m & e saying they cant co it The g&nmcm now wants to arguethat that
stalute is miuaclive, which would wipe out the 400 applications. That's whm the
Supreme Court will decide. Are these 400 cases snll alive? If they are, J o h n , t h e ~will be
400 Inals before federaljudges in Washington, D C. Ifthey're not, there will just be
nuliwy commissions with the right to appeal only after the commission rules.

would believe that they are terrorists sworn to attack the United States, But under the
laws and the treaties, they're still persons entitled to trials.
GIBSON: There have been, as you know, many accusationsthat detainees are tortured at
Gitmo.
NAPOLITANO. Until the Supreme Court ruled 8-1 that the constitution applies and the
federal courts have iurisdiction, there were some aeeressive means used and all of those
were outlined by FBI agents who objected to themThey were things like great heat,
great cold, sleep and food deprivation.None of that, I'm told, has happened in the past
two years sincithe ~u~remecourl's ruling. And the interrogation I witnessed, as [said
earlier, was a conversationlike you and me are having.
GIBSON: Who is their best interrogator?
NAPOLITANO: Their best interrogatoris aNew YoA City homicide detective, who
volunteered to become an ensign in the Navy so he could go down there and show them
how to interrogateand he's a terrific guy.

Conventionsrequires a roof over their head, even though there's no heat or air

Steve: I'm glad you went down there and saw it with your own two eyes. Remember
those very famous early pictures of what it was like ai Gitmo, somebody squeezed off
some shots and vou saw those orisoners in the orange iumnsuits and their hands were
bound behind them, they were blindfolded.Any ofthat stuff? Are they still wearing the
blindfoldsdown there?
Andrew: the military has asked all the media to stop using that When the Supreme Court
mled in June of '04 that the constitution,the treaties, and the laws ofthe United States
apply, the military's treatment of the detaineeschanged dramatically.It is now gentle,
almost child-like the way they treat the detainees. It was not that way before, but the tape
you're talking about is the old way that they were treated, which hasn't happened in two
1 of that years.
E.D.: now, compared to how Americanprisoners are treated at American jails, here in the
United States, arc these people being treated equally, better, worse?
Andrew: Far better, far.bc&, far better Not even close in tenns of the quality of the
food, in terms of the medical treatment, education,and recreation available. I mean, one
of those pictures shows me using exercise equipment in the prison yard. That was just

one of the many pieces, there it is Steve it was 110. There was no roof over that
exercise.

to Gitmo. The facilities there are excellent.
E.D..: People claim people are treated so horrendously, it needs to be closed. is bener
than what we keep our own ~risonersin America in?
Andrew :No abouin The administrationhas p a t spent $30 million to build
indoor cells and that facility, which will be known as Camp Number Six. They each have
numbers, dependine upon the d e m e of security and lock down and that facility will be
the most modern, high tech facility with the b& creature comforts for prison&. It's a
jail. It's not too many creature comforts but the best for prisoners anywhere in the
I country.

Andrew: It was a one day trip, down in the morning, five hours there, back to Andrew
Air Force base

from our judge earlier about what he saw on his trip yesterday to that infamous detention
facility. Former CIA operative Wayne ~immonsw& also on that trip. He joins us now
with his thoughts.
So, Wayne, the judge, you know, has always said that these guys should get some sort of
trial. Isn't quite sure about whether you should close i t But he also described a situation
where it seems like the interroeationtechniques are so watered down. YOU wonder if
they're getting anything out ofthese people at all I mean, he described an interrogation
technique that looked a little like Tony Soprano talking 10 his shrink What do you get out
of that?
WAYNE SIMMONS, FORMER CIA OPERATIVE: Listen, and the judge is
absolutelycorrect. I had the very good fortune and the honor ofbeing on the first
contingent to go to GuantanamoBay a year ago, and when I came back, I wrote some
pretty scathing things about the interrogation methods, which I found much, much too
soft. I thought we should use much harsher methods to get the time sensitive intcl.
I can tell you now, after a year I've changed in my position, and I'll tell you why. What is
happening is the command and control face on the battlefield is changing, and what we
now see happening, John, is that we're able to go back to some of these detainees and
secure informationabout who we believe is now the new face of the command and
control in the battlefield, and get a descriptionof these individuals and where they are
and where their families are.

So would I like to see harsher conditions not torture but stronger conditions in
interrogation?Absolutelv. But ...
GIBSON:But I mean. iou know, the judge described it as three people in there, a guy
sits on a couch, the) talk to him. Nobody else. There's no sleep deprivation, no food
deprivation It's not 100 hot. It's not too cold He's not b c i g water boarded. He doesn't
have snarlma does. He's iust chattine with them. What dothev ret out of that?

And unfortunatelv. we're not allowed to stand UD on the mountain and scream at the too
of our lungs, look what we did or look what they've done, and that's unfortunate because
the American people would be proud of what they see the FBI having done.

SIMMONS: Well, listen, 1don't know if that's the case. But 1 can tell you...

I wish all of America, in fact all of the concerned world, would go because they could draw their own
conclusionsand stop asking me. The world, at least America, would be proud of Rear Admiral Harry Hanis, the
Joint Task Force Commander-GTMOand his troops. Thoughtful, articulate, professional,concerned, serious,
but with panache, a '78 L'SNA grad, Harris stayed whh us all day giving and participating in the briefingsand
answering questions, some very hard ones. Army Col. Mile Bumgamcr, in charge of detainee operations and 35
years as an MP. was the host of our tour through all the facilities,includinc individual cells, cellblocks.
kcreation areas, medical facilities and interrogation ops where we viewedm HVT (high value target)
interrogation ....and then there were other participants- briefs from the "other" agencies, law enforcement and

intellieence. Bumeamer could be a wnular countv sheriff - he is hometown America he could eet elected
anywhere - may happen as he is n&g the end of his career - he cares about his troops and the detainees -
even ihc ones that have threatened lo kill him and his family

We started with briefings over a halal meal at the Camp Delta mess hall. The meal was tasty and one of three
composing the 4200 da& calories offered each detainee. Special meals are also offered f~rve~etarians,
diabetics, etc.The food is good.

A professionalmedical staff with a fully-equippedhospital, including major surgical capabilities,mental health


and denial looks after the detainees. The docs and nurses wear "stab vests" as they provide care.. .tunnun.

Some important questions:

Did we drink the aovernment kool-aid? -of course - that was the purpose of the trip, 10 hear the U.S.
government side of the story, the other side is provided daily in the media, some informed, most by those who
have never been to Gitmo. A visitor is at the mercy of local officials, but one also has lots of time to argue,
inquire, question, disagree,exchange ideas, provide alternateviews, suggestions.It is a healthy environment for

an intellectual exchange. One has free access to talk to any of the staff

Did vou see anv evidence of mistremment?- of course not, nor would one expect to on an arranged visit, but
there is another important reason - no misireanwnt is going on. There may have been some nussteps and policy
confusions at the old Camp X-ray (long closed), bui GI'IMO has known for a long time that the eyes of the

world are on them. There is simolv too much su~ervision,too much professionalism.too much pride to make
anything bad intentionally happen. Additionally, all interrogators will tell you that mistreatment is counter-
productive.The only thing that works, they insist, is to establish rappon ovcr a long period of time and
eventuallyalmost everyonetalks, providing small pieces of big puzzles that can eventuallyamalgamate into a
useful portrait.

Whv don't we avoid all this controversyand s i m l v declare the detainees as POWs and comply with the Geneva
Conventions?- because it isn't that simple - the detainees are not soldiers of a nation state, are not an organized
army and are not signatoriesto internationalconventions, nor do they comply with the Laws of Armed Conflict.
This may require some new legislation. This is a different sort of war in which the old rules and laws are not
adequate, many do not apply; thus, we are creating new processes and trying to insure justice and human rights
...
in the process - it is hard, real hard and incidentally we wmply with most of the provisions of the Geneva
Convention, the ones that make sense, especiallyhumane treatment. hi all wars we have detained
POWS and released them at the end of the war, and tried those suspected of heinous crimes - the same thing is
being attempted in this war

But vou must admit that the prisoners have no "due process" - wrong. One may not like the process (and the
Supreme Court will likely rule imminentlyon its leealiry), but there is a well-ordered due process, one that was
suggested by Supreme court Justice Sandra ~ a O?o&
y who encouragedthe US.to d&gn mechanisms that
wmply with Article V of the Geneva Convention. Article V states if there is plausible doubt of a detainee's

the U.S justice system. Those people havebeen &rested and tried for individual actsofterrorism deemed

infrastructure. War simply docs not fit that mold. The normd invesncabve processes used in U S criminal trials
- Miranda riehts. chainof custody of evidence, etc. is simolv imoraciical when amlied to a combat situation
Crime is from Mars,warfare is from Venus - the two simply don't mate. Those k ho cry for criminal
prosecution under thc US, justice system should read about the nature of war and how justice has been applied
over the years - the two systems are simply designed for entirely different scenarios

So. whv don't we use the military Court Martial system? - the militaryjustice system is theequivalent of the
U.S.civil justice system modified for military use. It is an extremely fair system with rights to free counsel,
juries of true peers and automatic review; however, the same rules apply to evidence, testimony, etc. as apply in
the U.S.civilian justice'system - the system is simply inadequate for warfare during which POWs are detained
and released after a war, or tried for war crimes under international statutes covering the Laws of Armed
Conflict. This is what the U.S. is attemptingto do with Gitmo detainees.

Aren't manv of the Gitmo detainees iust lowlevel foot soldiers that got sweet-up in battle? some are,some
aren't. 759 detainees have been sent to Gitmo. Almost all were detained in Afghanistan or Pakistan. Most were
suspected of being high-level or important Al-Qaedaor Taliban, or a significant threat as terrorists, thus their
transfer to Gitmo. None have been sent from Iraq. About 460 remain. The remainder have been released (13

have been captured or killed again in the GWOT after release) or transferred back to their home countriesor to a
third country that has agreed to abide by the international agreementsagainst torture. All detainees have
received CSRTs to determine their status and all will receive yearly ARBS (not required by Geneva
Conventions)to determine if they should continue to be detained or released.

So, what is going to happen to the remainine detainees?- it depends - the Supreme Court must rule. If the
administrationhas its way there will continue to be CSRTs and ARBS. Just like POWs at the end of mvious
wars, some detainees will be released to go home at theendof the GWOT. Others will be referred to"mililaty
commissions" for heinous crimes iust as they were in previous wan. And, when will the GWOT end? - beats
me, but certainlynot yet and the thought of releasing dangerous terrorists dedicated to doing us harm should be
chilling.

those (medical staff)who attempted to revive them. This was a devastatingexperience for ail involved. The staff
was truly saddened by the event. There have been over 40 previous attempts prevented. It should be no surprise
that amongst a crouv of people who recularl~see suicide as martyrdom fdailv events in Irau, Afghanistan and

defiant act of asymmetric warfare, not one ofdepressed prisoners who have come to the end of their rope.
Incidentally, there will also likely be attempts by detainees to kill guards - the detainees regularl! threaten the
guards and tell them they will kill them and their families when they get out. Expect other bad thing to happen at
Gitmo. This is not your run-of-the-mill collectionof compliant prisoners.

But what about the ~risonerwho was being force-fed? when detainees perform hunger strikes and those
actions become dangerous to health, the decision has been made to insert feeding tubes to preserve life - this is
the same procedure that has been approved and is used by the US. Bureau of Prisons and the same standard
equipmentused in U.S. hospitals. A small 118"' inch tube is inserted through the nasal cavity, down the throat -
the area is lubricated and &esthetized, the procedure not painful. Adm, H& had the procedure performed on
him to test the system.

What a b u t the Red Cross views of Gitmo? the Red Cross views are confidential and closely-held, lint the Red

Cross has full access todetainees at any tune and makes regular visits. They have made many suggestions
incomarated by the Gitmo staff. Prisoners receive regular mail and the home nations of all detaineesare
informed of th& whereaboutsand status and kept regularly informed by our State Department Some nations
are seeking extradition,some of those request have been approved.

on terrorism - Congress may have to act - this is a different war and old models don't fit. Many of the detainees
are dangerous, VERY dangerous, and will kill you, me and others tomorrow if released. They should not be put
blithely back on the streets in an emotional quest for justice - as an international communitywe MUST find a

way of handling These people - AND - 1 fully suspect that if detainees are transferred back to their home
countries, or other facilitiesconstructed in far-off lands, they will soon wish they were back at Gitmo.

If someone tells you Gitmo is a gulag - that is nonsense - they haven't been there.
Our solders, sailors and air men and womenat Guanianamo are doinga superb job around very dangerous
people in a long and difficult war - you can be proud of them.

Gitmo Trip Report

It was my second trip to Guantanamo, the last being a year ago. A collection ofmedia analysts, (CNNand Fox),
radio contributers. lawyers. writers. DoD deoutv assistant secretaries,it was another whirlwind adventure -out
ofthechocks at ~ n d ~ w ass guest a h O ~ D O Don Navy mil-air a t 7 3 0 AM; 3 15 en route to Cuba; land at
Gitmo Airfield,Navy launch to the windward side, visit the detention facility all day; receive briefs, lone water-
taxi back to the airfield, wheels up at 9 0 0 PM and back to Andrew by 8:15- whew!.

I wish all of America, in fact all of the concerned world, would go because they could draw their own
conclusions and slop asking me. The world, at least America, would be proud of Rear Admiral Hany Harris, the
Joint Task Force Commander-GTMO and his troops. Thouehiful. articulaie. professional, concerned, serious,

answering questions, some very hardones Army Col. Mike Bumgamer, in charge of detainee operations and 35
years as an MP,was the host ofour tour through all the facilities,including individual cells. ccllb!ccks,
recreation areas, medical facilities and interrogation ops where we viewedan HVT (high value target)

interrogation and then there were other participants briefs from the "other" agencies, law enforcement and
intelligence. Bumgamer could be a popular county sheriff- he is hometown America - he could get elected
anywhere -may happen as he is nearing the end of his career - he cares about his mops and the detainees-
even the ones that have threatened to kill him and his family.

We started with briefings over a halal meal at the Camp Delta mess hall. The meal was tasty and one ofthree
composing the 4200 daily calories offered each detainee. Special meals are also offered for vegetarians,
diabetics, etc. The food is good.

A professionalmedical staffwith a fully-equipped hospital, includingmajor surgical capabilities,mental health


and denial looks after the detainees. The docs and nurses wear "stab vests" as they provide care...lmmm.

The facilities are modem, resemblingany modem high security US. prison and expensive-and getting more
expensive, new ones being constructedto reduce manpower requirementsand provide for an extended stay, or
an expanded GWOT.

Some important questions:

-
Did we drink the government kool-aid'- of course thai was the purpose of the trip, to hear the U.S.
government side of the story, the other side is provided daily in the media, some i n f m e d , most by those who
have never been to Gitmo. A visitor is at the mercy of local officials, but one also has lots oftime to argue,
inquire, question, disagree, exchange ideas, provide alternateviews, suggestions.It i s a healthy environment for
an intellectualexchange. One has free access to talk to any of the staff.

Did you see any evidence of mistreatment? of course not, nor would one expect to on an arranned visit, but
there is another important reason no mistreatment is going on. There may have been some missteps and policy
confusions at the old Camp X-ray(long closed), but GITMO has known for a long time that the eyes of the
world are on them. There is simply too much supervision,too much professionalism,too much pride to make
anything bad intentionallyhappen. Additionally, all interrogators will tell you that mistreatment is counter-
productive. The only thine that works, they insist, is to establishrapport over a lone period of time and
eventually almost everyone talks, small pieces of big p&es that can eventuallyamalgamate into a
useful portrait

Why don't we avoid all this controversy and simply declare the detainees as POWs and comply with the Geneva
- -
Convaitions? because it isn't that simple the detainees are not soldiers of a nation state, are not an
organized army and are not signatoriesto international conventions, nor do they comply with the Laws of
Aimed Conflict.This may require some new legislation. Thisis adifferent sort of war in which the old rules
and laws are not adequate, many do not apply; thus, we are creating new processes and trying to insure justice
and human rights in the process - it is hard, real hard. ..and incidentallywe comply with most of the provisions
of the Geneva Convention the ones that make sense. especiallyhumane treatment. In all previous wars we have
-
detained POWS and released them at the end of the war, and &ied those suspected of heinous crimes the same
thing is being attempted in this war.

But you must admit that the prisoners have no "due 0rocess"-wrong. One may not like the process (and the
Supreme Court will likely rule imminently on its legality), but there is a well-ordered due pmcess, one that was
suggested by SupremeCourt Justice Sandra Day O'Connor who encouraged the US. to design mechanisms that
comply with Anicle V of the Geneva Convention. Article V states if there is plausible doubt ofadetainee's
-
slams are they, or are they not, enemy combatants - a process must be established to & m i n e that fact. Thus,
the administration establishedthe Combat Staius Review Tribunals(CSRTs) and Admiri'suauve Review
-
Boards (ARBS yearly case re-examinations) that review all available facts and information to determine: is the
detainee an enemy combatant,deserving detention, or not?

Why don't we just apply the US. justice system- lawyers,grandjuries, charges, trials?- sounds great, but it
does not work in war and that has been lone recoenized. There are about 1.000 foreign terrorists incarcerated in
the U.S. justice system. l'hose people havebeen arrested and tried for individual actsof terrorism deemed
criminal acts, mostly in the US.- it fits the way we do business -daily police work in an oitanized
.. - .
infrastructure. War &mdv does not fit that mold. The normal investi&t&e nrocesses used in^.^. criminal trials
- Mirandarights, chain of custody of evidence, etc. is simply impractical when applied to a combat situation.
Cnme is from Mars, warfare is from Vmw - the twosimply don't mate Those whocry for criminal
prosecution under the L' S, jU5ticc system should read about the nature of war and how justice has been applied
over the years - the two systems are simply designed for entirely different scenarios.

So. whv don't we use the military Court Martial system? -the military justice system is the eauivalentof the
US. c ~ l j u s u c esystemmodified for military us; It is an extrcmcb fair systemwith rights 10freecounse1,
Junes of true peers and automatic review; however, the same mles apply to evidence, testimony, etc. as apply in

the US.civilian justice system the system is simply inadequate for warfare dunng which POWs are detained
and released afler a war, or tried for war crimes under international statutes covering the Laws of Armed
Conflict. This is what the US.is attemptingto do with Gitmo detainees.

Aren't many of the Gitmo detaineesJust low-level foot soldiersthat got swept'up in battle? someare, some
aren't 759 detainees have been sent to Gitmo. Almost all were detained in Afghanistan or Pakistan. Most were

suspected of being high-level or important Al-Qaeda or Taliban. or a significant threat as terrorists,thus their
transfer to Gitmo. None have been sent from Iraq. About 460 remain The remainder have been released (1 3
have been ca~turcdor killed again in the GWOTafter release)or transferred back to their home coiailries or to a
third counl&that has agreed toabide by the international agreements against t o m . All detainees hate
received CSRTs to determine their status and al! will receive vearly ARBS (not required by Geneva
Conventions)to determine if they should continue to be detained or released.

Many detainees have been there since 2002. Surely we have exhausted their intelligence value? not so,
accordingto intelligenceofficials and interrogators. Interrogations continue and important information on
national and internationalcells continue to emerge that have uncovered and prevented significantattacksand
taken down dangerous networks, especially in foreien countries. Additionally, many detaineesare cooperatine.

So, what is going to happen to the remaining detainecs? it depends the Supreme Court must rule. If the
administrationhas its way there will continue to be CSRTsand ARBS. Just like POWs at the end ofprevious
wars. some detainees will be released to eo home at the end of the GWOT. Others will be referred to "military
commissions" for heinous crimes just as they were in previous wars. And, when will the GWOT end? beats -
me, but certainly not yet and the thought of releasing dangerous terrorists dedicated to doing us harm should be
chilling.

and they are provided lawyer-client privileges.

What about the suicides? we saw where the suicides took dace. talked to those who found the victims and
those (medical staff) who attempted to revive them. This w& a devastating experience for all involved. The staff
was truly saddened by the event. There have been over 40 previousattempts prevented. It should be no surprise
that amongst a group of people who regularlysee suicide as martyrdom (daily events in Iraq, Afghanistan and
Israel) there will be more attempts, some likely successful. The Gitmo staff characterizesthe suicides as a
defiant act of asymmetric warfare, not one of depressed prisoners who have come to the end of their rope.
Incidentally, there will also likely be attempts by detainees to kill guards - the detainees regularly threaten the
guards and tell them they will kill them and their families when they gel out. Expcct other bad thing lo happen at
Gitmo. This is not your run-of-the-mill collection of compliant prisoners.

But what about the prisoner who was being force-fed? when detainees perform hunger strikes and those
-
actions become dangerous to health, the decision has been made to insert feeding lubes to preserve life this is
the same procedure that has been approved and is used by the US.Bureau of Prisons and the same standard
equipment used in L'S. hospitals. A small 118th inch lube is inscncd through the nasal cavity, down the ihroal-
the area is lubricated and anesthetized,the procedure not painful Adm Harris had the procedure performed on

him to test thesystem.

What about the Red Cross views of Gitmo? the Red Cross views are confidential and closely-held, but the
Red Cross has fall access to detainees at any time and makes regular visits. They have made many suggestions
incorporated by the Gitmo staff. Prisoners receive regular mail i d the home nations of all detainees &
informed of their whereaboutsand status and kept regularly informed by our State Department. Some nations
are seeking extradition,some of those request have been approved.

So, should, or should not, Gitmo be closed? I don't know. Oitmo has become an unfortunate political symbol
of an increasingly unpopular war. Some of the information spread in the media is wrong and written or relayed
by people who are misinformed,Gitmo is a modem, well-run prison where detainees are well treated, well-fed,
- -
and medically cared for - BUT whatever hanoens we must have a method of handling detainees inthe war
- -
on terrorism Congress may have to act this is a differentwar and old models don't fit. Many of the detainees
are dangerous, VERY dangerous,and will kill you, me and others tomorrow if released. They should not be put-
-
blithely back on the streets in an emotional quest for justice as an internationalcommunity we MUST find a
-
way of handling these people- AND I fully suspect that ifdetainas are transferred back to their home
countries, or other facilities constructedin far-off lands, they will soon wish thq were back at Gitmo.
