Contact: Sheila MannAdministrative Office of the CourtTwentieth Judicial Circuit(239) 533-1723smann@ca.cjis20.orgThe courts of the 20th Circuit willimplement two new programs in July2010 to reduce the backlog of civil andforeclosure cases created by theeconomic downturn over the past twoyears.Starting July 15th, all new homesteadedresidential foreclosure cases will bereferred directly to the Conant Mediation Center, a local serviceprovider that will offer services in all five counties within the circuit.The Conant Mediation Center was selected by Chief Judge Cary fromseven mediation firms that filed proposals. This program will allowhomeowners an opportunity to receive credit counseling and todetermine if a modification to their mortgage is a viable option.According to G. Keith Cary, 20th Circuit Chief Judge, "The newhomestead mediation program will attempt to have the lenders filingforeclosures meet and try to resolve homesteaded foreclosures at anearly stage. We have made great progress, but we are still diggingout from a backlog of 40,000 civil and foreclosure cases filed overthe past 3 years. The new programs will enhance our ability toexpedite the resolution of these cases."A new civil and foreclosure backlog reduction effort is underway in allfive counties in the circuit as well. Local civil case managementcommittees, consisting of Bar leaders, court staff and civil judgeshave worked together to create a process for handling these cases.

Since January, Collier and Lee counties began setting older cases forreview before magistrates, senior judges and case managers toresolve pretrial problems and move them to resolution. Charlotte,Hendry and Glades are also planning similar reduction efforts.
The goals are ambitious and seek to reduce pendingforeclosure cases by 60% and older civil cases by 10-20% inone year. Some of the key strategies of the program are:
All homestead foreclosure cases filed on or afterJuly 15, 2010 will be referred to the ConantMediation Center;As of July 1, 2010 part time magistrates and senior judges will be added to assist with the effortsalready underway in expedited foreclosure docketsand civil backlog reduction in Collier, Charlotte andLee Counties;Older backlogged foreclosure and civil cases will beset for trial and case management conferences toresolve delay issues;New circuit case management time standards andprocedures to establish early case managementplans will go into effect in January 2011.
