Instead, this letter constitutes Buyer’s written notice to Seller under Section 5.1.1 that Buyer: (i) elects to terminate the Agreement and all further rights and obligations of both parties thereunder; and (ii) respectfully requests return of its eamest money promissory note per the terms of the Agreement.
