AMENDED DECLARATION OF COVENANTS, CONDITIONS, AND RESTRICTIONS FOR BRIDGEWATER HEIGHTS SINGLE-FAMILY LOTS ‘THIS DOCUMENT AMENDS DOCUMENT NO, 565831 BRIDGEWATER HEIGHTS SINGLE-FAMILY LOTS AHIS AMENDED DECLARATION OF PROTECTIVE COVENANTS, CONDITONS, AND RESTRICTIONS is made this_|3*" day of Auoust _, 2007 by Geiger Land Development, Ine., « Minnesota corporation and D.R. Horton, Ine, ~ Miunesot, ¢ Delaware Sorporation, ‘Sean Adams, and Edward and Cheryl Miller (hereinafter refered to as poelarants”), for the purpose of amending the Declaration of Covenants, Conditions and Restrictions for Bridgewater Heights regarding the following desckibed Propesty: SEE ATTACHED EXHIBIT “A” RECITALS: A. That the original Declaration of Protective Covenants, Conditions, and Restrictions for the Property were established by Geiger Land Development, Inc. pursuant to that Declaration of Protective Covenants, Condition, and Restrictions dated November 15, 2005, filed November 15, 2005 as Document No. 565831; B. Pursuant to Paragraph 12, the Declaration of Protective Covenants, Conditions, and Restrictions can be amended by a written document signed by 80% of lot owners, and Declatants are owners of _|02 lots, constituting ownership of 80% of the total number of lots, and therefore intend to exercise their right to amend said covenants through this written document; and C. The Declarants desire to amend the Declaration to amend certain provisions as set fotth NOW, THEREFORE, the Declarants hereby make the following Amendment to the Declaration pursuant to the Declaration as to divisions, covenants, restrictions, limitations, conditions and uses to which the Property may be put, hereby specifying that said Declaration shall constitute covenants which shall run with the land and shall be binding on the Declarants, their suecessors and assigns, and all subsequent owners of all or any part of said real property and improvements, together with their grantees, successors, heirs, executors, administrators, devisees or assigns, A. PROPERTY SUBJECE TO THE THIS AMENDED DECLARATION OF PROTECTIVE COVENANTS. Declarants are the owners of certain property in the City of Dundas, County of Rice, State of Minnesota, constituting ownership of over 80% of the single family lots located in the Plat of Bridgewater Heights, Rice County, Minnesota, which is more particularly described as: SEE EXHIBIT “BY ATTACHED HERETO. Declarants hereby declare that all of the Properties described above shall be held, sold and conveyed subject to that Declaration of Protective Covenants, dated November 15, 2005, filed November 15, 2005 as Document No. 565831; as amended by the Amendment to Declaration of Protective Covenants, Conditions; and Restrictions; and the casements, restrictions, covenants and conditions, which are for the purpose of protecting the value and desirability of, and which shall run with, the real property and be binding on all parties having any right, title or interest in the described Properties or any part thereof, their heirs, successors and assigns, and shall inure to the benefit of each owner thereof, B, AMENDMENT OF PARAGRAPH 1(b). DEFINITIONS. Paragraph 1(b) as written in the Declaration of Protective Covenants dated November 15, 2005, shall be replaced with the following paragraph for the real property legally described in amendment: 1(b). Declarant; “Declarant” is defined to include both Geiger Land Development, Inc., a Minnesota corporation and D.R. Horton, Tne, — Minnesota, a Delaware corporation, C. AMENDMENT OF PARAGRAPH 3. ARCHITECTURAL AND STRUCTURAL STANDARDS. Paragraph 3 as written in the Declaration of Protective Covenants dated November 15, 2005, is hereby deleted and shall be replaced with the following paragraph for the real property legally described in this amendment: 3. Architectural and Structural Standards: Fach Lot shall conform to the following: a. No structure shall be allowed on any Lot other than one single-family residential dwelling per Lot, not exceeding two stories high above the entrance level, b. Structures erected or placed on any Lot must be in harmony with the residential neighborhood in respect to workmanship materials and external design, Front clevations that do not include a porch shall not exceed 70% of any one material, texture or color unless that material is btick, stone or stucco. Furthermore, any house elevation adjacent to a public street shall be subject to the same 70% ctiteria, Materials of such design, character, and quality as the Architectural Control Committee deems appropriate may be allowed, ‘The roof line for all homes must have a minimum 6/12 pitch on ail gables and hips facing the front. ii A variance from the above requirement may be granted by the Architectural Control Committee upon a finding that the exterior material, design, character, and quality is appropriate and compatible with the surrounding neighborhood. Requests for variances will be considered on an individual case by case basis and granting of one or more variances does not in any way constitute a waiver of the future applicability of any Tequitement contained in these covenants or the enforceability thereof. iii, All Vinyl siding must have a minimum mil thickness of 40 siditig iv. Standard asphalt shingles that ate equal to 25 year shingles shall be used onall structures, so as to provide a consistent appearance. ¥. Construction of model homes is expressly petmitted as long as they conform to the restrictions hereby created, The model homes for Bridgewater Heights shall include a porch, vie Single family homes constructed on Bridgewater Parkway may have front porches, unless otherwise required by the City of Dundas pursuant to the planned unit development approval, vii, The same house elevation shall not be constructed ditectly across the street or next door to each other. c. The size of any building or structure, exclusive of one-story open porches, basements, garages, and three season porches, shall be: i, ‘The square footage of the ground floor of the main structure of single floor or rambler style home, exclusive of open porches and garages, must have a minimum of 1,350 square feet of finished living erea on the main floor above grade level, excluding basement.
