To amend sections 1.60, 102.01, 102.02, 102.022,117.01, 121.01, 121.22, 121.41, 121.60, 121.67,122.011, 124.01, 145.012, 149.011, 2921.01, and4117.01 and to enact sections 187.01 to 187.12 ofthe Revised Code to authorize the Governor to forma nonprofit corporation that would perform suchstate economic development functions as directedby law and pursuant to a contract with theDepartment of Development, and to make anappropriation.12345678910
BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1.
That sections 1.60, 102.01, 102.02, 102.022,117.01, 121.01, 121.22, 121.41, 121.60, 121.67, 122.011, 124.01,145.012, 149.011, 2921.01, and 4117.01 be amended and sections187.01, 187.02, 187.03, 187.04, 187.05, 187.06, 187.07, 187.08,11121314
 
187.09, 187.10, 187.11, and 187.12 of the Revised Code be enactedto read as follows:1516
Sec. 1.60.
As used in Title I of the Revised Code, "stateagency," except as otherwise provided in the title, means everyorganized body, office, or agency established by the laws of thestate for the exercise of any function of state government. "Stateagency" does not include the nonprofit corporation formed undersection 187.01 of the Revised Code.171819202122
Sec. 102.01.
As used in this chapter: 23(A) "Compensation" means money, thing of value, or financialbenefit. "Compensation" does not include reimbursement for actualand necessary expenses incurred in the performance of officialduties.24252627(B) "Public official or employee" means any person who iselected or appointed to an office or is an employee of any publicagency. "Public official or employee" does not include a personelected or appointed to the office of precinct, ward, or districtcommittee member under section 3517.03 of the Revised Code, anypresidential elector, or any delegate to a national convention."Public official or employee" does not include a person who is ateacher, instructor, professor, or other kind of educator whoseposition does not involve the performance of, or authority toperform, administrative or supervisory functions.28293031323334353637(C) "Public agency" means the general assembly, all courts,any department, division, institution, board, commission,authority, bureau or other instrumentality of the state, a county,city, village, or township, the five state retirement systems, orany other governmental entity. corporation, township, or other governmental entity that functionsexclusively for cultural, educational, historical, humanitarian,advisory, or research purposes; that does not expend more than tenthousand dollars per calendar year, excluding salaries and wagesof employees; and whose members are uncompensated. "Public agency"does not include the nonprofit corporation formed under section187.01 of the Revised Code.45464748495051(D) "Immediate family" means a spouse residing in theperson's household and any dependent child.5253(E) "Income" includes gross income as defined and used in the"Internal Revenue Code of 1986," 100 Stat. 2085, 26 U.S.C. 1, asamended, interest and dividends on obligations or securities ofany state or of any political subdivision or authority of anystate or political subdivision, and interest or dividends onobligations of any authority, commission, or instrumentality ofthe United States.54555657585960(F) Except as otherwise provided in division (A) of section102.08 of the Revised Code, "appropriate ethics commission" means:6162(1) For matters relating to members of the general assembly,employees of the general assembly, employees of the legislativeservice commission, and candidates for the office of member of thegeneral assembly, the joint legislative ethics committee;63646566(2) For matters relating to judicial officers and employees,and candidates for judicial office, the board of commissioners ongrievances and discipline of the supreme court;676869(3) For matters relating to all other persons, the Ohioethics commission.7071(G) "Anything of value" has the same meaning as provided insection 1.03 of the Revised Code and includes, but is not limitedto, a contribution as defined in section 3517.01 of the RevisedCode.72737475
