A regular meeting of The Board of Chosen Freeholders of the County ofMorris, State of New Jersey, was held on February 9, 2011, in the FreeholdersPublic Meeting Room, Administration and Records Building, Morristown, NewJersey. The meeting began at 7:30 p.m. Clerk of the Board Diane M. Ketchum announced that adequate notice ofthis regular meeting held this 9th day of February, 2011 has been providedthrough resolution adopted by this Board at its Regular Meeting held at theAdministration and Records Building on January 5, 2011, and by mailing theresolution to the Star Ledger, the Daily Record, and the Record and by filinga copy of same with the Clerk of the Town of Morristown and the Morris CountyClerk. 
ROLL CALL 
 PRESENT:       Freeholders Douglas Cabana, Gene Feyl, Ann Grossi,Thomas Mastrangelo, John Murphy, Margaret Nordstrom,and Director William Chegwidden                   (7) ALSO PRESENT:  County Counsel Dan O’Mullan, Assistant County Counsel Randy Bush,Administrator John Bonanni, Assistant County AdministratorTom Markt and Clerk of the Board Diane M. Ketchum

County Counsel Dan O’Mullan opened the meeting with a prayer and asalute to the flag.

 All Meeting Minutes of January 26, 2011. On motion by Freeholder Nordstrom and seconded by Freeholder Cabana themeeting minutes were approved.

COMMUNICATIONS 
The Mendham Township Recreation Committee is requesting permission tohang a banner over County Route 510 in Mendham Township from June 4-18 toadvertise the Patriot’s 5K Race. On motion by Freeholder Murphy and seconded by Freeholder Nordstrom theroad closing request was approved. --  
ORDINANCESFIRST READING/INTRODUCTION
(1)Director Chegwidden stated:  “We will now consider the introductionby title an ordinance.” Freeholder Murphy  stated:  “I would like to introduce by title anordinance entitled, ‘A BOND ORDINANCE AMENDING BOND ORDINANCE NUMBER963091 FINALLY ADOPTED JUNE 13, 2007 BY THE COUNTY OF MORRIS, NEW JERSEY,IN ORDER TO PROVIDE FOR A CHANGE AUTHORIZED BY SUCH ORDINANCE.’” Freeholder Nordstrom stated:  “I second the motion.” The Clerk called and recorded the following vote: YES:  Freeholders Cabana, Feyl, Grossi, Mastrangelo, Murphy,Nordstrom and Director Chegwidden               (7)
  
Freeholder Murphy moved that the Clerk be authorized to publish theOrdinance in summary form in the local newspaper together with the noticeof public hearing and consideration of final passage of this Ordinancewhich will take place at the Freeholder meeting to be held in theAdministration and Records Building, Fifth Floor, Court Street,Morristown, New Jersey, on February 23, 2011. Freeholder Nordstrom stated:  “I second the motion,” which passedwith seven YES votes.--

PUBLIC HEARING/ADOPTION
 (1)Director Chegwidden stated:  “We will now consider for finaladoption the ordinance entitled ‘BOND ORDINANCE AMENDING BOND ORDINANCENUMBER 966150 FINALLY ADOPTED FEBRUARY 25, 2009, BY THE COUNTY OF MORRIS,NEW JERSEY, IN ORDER TO PROVIDE FOR A CHANGE AUTHORIZED BY SUCHORDINANCE.’” Clerk Ketchum read the following ordinance: BE IT ORDAINED BY THE BOARD OF CHOSEN FREEHOLDERS OF THE COUNTY OFMORRIS, NEW JERSEY (not less than two-thirds of all the members thereofaffirmatively concurring), AS FOLLOWS: Section 1.  Bond Ordinance number 966150 of the County of Morris, NewJersey (the “County”), finally adopted February 25, 2009 entitled “BONDORDINANCE OF THE COUNTY OF MORRIS, NEW JERSEY, APPROPRIATING $200,000 ANDAUTHORIZING THE ISSUANCE OF $190,000 BONDS OR NOTES OF THE COUNTY FOR THEDESIGN OF THE REPLACEMENT OF THE 24 INCH PCCP TRANSMISSION MAIN (M.C.M.U.A.WATER DIVISION) IN PLEASANT HILL ROAD IN RANDOLPH TOWNSHIP, BY AND FOR THECOUNTY OF MORRIS, NEW JERSEY” is hereby amended to read as follows: Section 2.  Section 3 (a) of said Bond Ordinance number 966150 of theCounty, finally adopted February 25, 2009, is hereby amended to provide forthe design and replacement of the 24 inch PCCP Transmission Main (M.C.M.U.A.Water Division) in Pleasant Hill Road in Randolph Township. Therefore,Section 3 (a) of said bond ordinance number 966150 shall read in the entiretyas follows: “The improvements hereby authorized and the purposes for the financingof which said obligations are to be issued are for the design andreplacement of the 24 inch PCCP Transmission Main (M.C.M.U.A. WaterDivision) in Pleasant Hill Road in Randolph Township, including allwork and materials necessary therefor and incidental thereto (all asshown on and in accordance with the plans and specifications thereforon file in the office of the Clerk of the Board of Chosen Freeholdersand hereby approved).” Section 3.  Section 4 (d) of said Bond Ordinance number 966150 of theCounty, finally adopted February 25, 2009, is hereby amended to provide for adecrease of $90,000 in the amount of interest on the obligations authorizedby Bond Ordinance number 966150, costs of issuing said obligations,engineering costs and other items of expense listed in and permitted underSection 40A:2-20 of the Local Bond Law of New Jersey. Therefore, Section 4(d) of said bond ordinance number 996150 shall read in its entirety asfollows: “An aggregate amount not exceeding $110,000 for interest on saidobligations, costs of issuing said obligations, engineering costsand other items of expense listed in and permitted under Section 40A:2-20 of said Law is included in the estimated cost of said improvements.” Section 4. All other details of the bond ordinance referred to inSection 1 hereof shall remain the same. Section 5. This bond ordinance shall take effect twenty (20) days afterthe first publication thereof after final adoption as provided by the LocalBond Law. 
 
Director Chegwidden stated: “The Public Hearing is now open.” There were no public comments, and the Director declared the PublicHearing closed. Freeholder Murphy moved that the ordinance under consideration beadopted on the second and final reading.  Freeholder Nordstrom secondedthe motion. The Clerk called and recorded the following vote: 
 
YES: Freeholders Cabana, Feyl, Grossi, Mastrangelo, Murphy,Nordstrom, and Director William Chegwidden         (7) --

 Freeholder Murphy presented the following resolutions: (1)BE IT RESOLVED, by the Board of Chosen Freeholders of the County ofMorris in the State of New Jersey as follows; 1. That the County of Morris hereby awards a grant not to exceed $375,000from the FY10 Open Space and Farmland Preservation Trust Fund to theTownship of Denville for a project entitled Fels Property. 2. That the Board of Chosen Freeholders hereby accepts the dedicationOf any facilities under County jurisdiction, including but not limitedto sight triangle easements, bridge maintenance easements and roadwaydedications (per official map) as required by the grant agreement. 3. That the Treasurer issue a Certificate of Availability of Fundsindicating that funds are available from the Morris County DedicatedOpen Space Account #13-290-56-580552-888 and process payment to thegrantee or its designated agent as directed by the Office of theDepartment of Planning & Development, all in accordance with thisresolution.-- (2)NOW, THEREFORE, BE IT RESOLVED, by the Board of Chosen Freeholders ofthe County of Morris in the State of New Jersey as follows: 1. That the Director of the Board of Chosen Freeholders is herebyauthorized to sign and execute the Deed of Easement between the Countyof Morris and Constellation Solar I, LLC for an underground conduitunder Morris County property. 2. A copy of this agreement is on file in the Office of the Division ofTransportation and made a part hereof by reference, is hereby approvedand entered into by this Board. 3. This resolution shall take effect immediately. -- (3)BE IT RESOLVED, by the Board of Chosen Freeholders of the County ofMorris in the State of New Jersey as follows: 1. That the County of Morris hereby awards a grant not to exceed$1,622,000 from the FY10 Open Space and Farmland Preservation TrustFund to the Township of Mount Olive & The Land Conservancy of NewJersey for a project entitled South Branch Preserve Additions. 2. That the Board of Chosen Freeholders acknowledges the grant recipientsmay share ownership of all or portions of the subject property with theNew Jersey Water Supply Authority, while the project still beingencumbered by Chapter 24 (P.L. 1997). 3. That the Board of Chosen Freeholders hereby accepts the dedication ofany facilities under County jurisdiction, including but not limited tosight triangle easements, bridge maintenance easements and roadwaydedications (per official map) as required by the grant agreement. 4. That the Director of the Board of Chosen Freeholders is herebyauthorized to sign and execute an agreement for the aforesaid grant,and the Clerk to attest to the same a copy of which is on file in theOffice of the Department of Planning & Development made a part hereofby reference. 5. That the Treasurer issue a Certificate of Availability of Fundsindicating that funds are available from the Morris County Dedicated
