gradestudentthrougharobustly-fundedandmorecomprehensiveSafeRoutestoSchoolProgram;andWHEREAS,manyimpedimentsandbarrierstotransportationsafetyoccurinthepublic-right-ofway,andthePortlandPublicSchools(PPS)andCityhaveastronginterestinidentifyingandaddressingimpedimentstoensurethesafety
of
Districtstudentsandthesurroundingcommunity;andWHEREAS,barrierstosafetransportationmayincludeneededphysicalimprovementstoeliminatesafetyhazardsorlack
of
knowledge
of
alternativetransportationoptionsorroutes;andWHEREAS,schooladministration,teachers,parents,andstudentsarewellpositionedtoidentifytransportationbarriersbecausetheylivewiththeconsequences
of
thebarrierseveryday,andPortlandBureau
of
Transportationstaffpossessesexpertiserelatedtothetoolsavailabletoremovethosebarriers;andWHEREAS,reducingthenumber
of
studentsbroughttoschoolinprivatevehiclesmutuallybenefitstheCity,theDistrict,andthecommunitybydecreasingtrafficandparkingcongestion,reducingtrafficandparkingcomplaints,increasingefficiencies,reducingenvironmentalimpactsandcreatingsafertrafficflowaroundschools;andWHEREAS,PPSandtheCityintendtousetheCity'sexistingSafeRoutestoSchool(SRTS)programtoprioritizeneededtransportationimprovementsdistrict-wide;andWHEREAS,thisproposalallowsdecisions
of
whenandwheretodevotelimitedcapitalresources
to
transportationsafetyimprovementstobebasedonanevaluationandprioritization
of
neededtransportationimprovementsDistrictwide;and
 
WHEREAS,PPSandCityintendtopursue,obtain,andleverageadditionalstablefundingfortheSRI'Sprogramto
make
transportationsafetyimprovements.
NOW,THEREFORE,
BEITRESOLVEDthat
the
Memorandum
of
UnderstandingattachedisacceptedbytheCityCouncilasaframeworkfornegotiatinganIntergovernmentalAgreementwithPPS;and
BE
IT
FURTHERRESOLVED
thattheBureau
of
Transportation,withassistancefromtheBureau
of
PlanningandSustainability,andotheraffectedCitybureaus,isdirectedtoproceedwithnegotiatinganIntergovernmentalAgreementwithPPSto
be
approved
by
theCityCouncilandsignedby
both
partiesnolaterthanJune
1,
2011.

Background
In2009,theCity'sPlanningCommission(nowthePlanningandSustainabilityCommission)initiatedtheSchoolsandParksConditionalUseCodeRefinementProjecttoaddressconcernsregardingtheuse
of
publicschoolsandparksintheCity
of
Portland.Thezoningcodechangescitystaffrecommendedinthisprojectweredesignedtostreamlinecitypermittingrelatedtoschoolandfielduse,easingrequirementsforconditionalusereview
of
enrollmentfluctuations,gradelevelchange,andtheuseanddevelopment
of
sportsfields(all
of
thesereviewsrequire,expensivelandusereviews).TheCityBureaus
of
PlanningandDevelopmentServicesinitiatedtheproposedzoningcodechangeswiththePlanningCommissioninresponsetoseveralzoningcodeviolationsfiledagainstpublicschoolsintheCityforallegedmisuse
of
sportsfieldsandgradelevelchangesrelated
to
PPS'sK-8conversionprocess.Duringthepublichearingforthecoderefinementprocess,thePlanningCommissionraisedaconcernabouttheadequacy
of
transportationinfrastructurenearschoolswithyoungerstudents.Inparticular,thePlanningCommissionwantedtoknowwhetherPPSconductedanadequateassessment
of
transportationinfrastructurewhengradesK-5areaddedtoanyschoolaswasdonethroughtheDistrict'sK-8conversionprocess.
