ThatNRS630.301(4)providesthatgrossmalpracticeconstitutesgroundsforinitiatingdisciplinaryactionagainstalicensee.IIIThatonoraboutMarch15,1991,RespondentperformedaprocedureforterminationofpregnancyforPatientAinWashoecounty,Nevada.IVThatRespondentperformedtheterminationofpregnancywithoutadequatelydetermininguterinesizeorgestationalage.Thatinperformingtheterminationof-pregnan~y,Respondentfailedtocompletelyremoveallproductsofconception.

Thatafterterminatingtheprocedure,RespondentrepresentedtoanotherphysicianinwhosecareheplacedPatientAthatheremovedalltheproductsofconception,hadlookedatthetissue,andhadidentifiedthefetusremoved.VIThatonMarch16,1991,PatientApresentedatWashoeMedicalcenterinReno,Nevada,approximately36hoursfollowingtheterminationofpregnancyprocedureperformedbyRespondent,wasexaminedbyaphysicianunderwhosecareRespondenthadplacedPatientA,andwasadmittedtoWashoeMedicalcenterforfurtherevaluation.-ThatanultrasoundexaminationofPatientAperformedonMarch16,1991,at

WashoeMedicalCenter,revealedanon-viable18.7weekfetus.VIIThattheterminationofpregnancyprocedurewascompletedbysaidphysicianatwhichtimesaidphysicianidentifiedaruptureoftheuterusattheleveloftheinternalcervicalosandthepathologyreportshowedannecrosisoftheentirethicknessoftheuterusatthesiteofruptureandextremethinningoftheloweruterinesegment.SaidconditionofPatientAwasaresultoftheoriginalsurgeryperformedonPatientAbyRespondent.VIIIThatRespondent'smedicaltreatmentofPatientAconstitutesalackofcarewhichraisesapresumptionofconsciousindifferencetoconsequences,andanentiredisregardforandindifferencetothesafetyandwelfareofapatient,andconstitutes"grossmalpractice",aviolationofNRS630.301(4).WHEREFORE,theInvestigativecommitteeoftheBoardofMedicalExaminersofthestateofNevadarequeststhatahearingofthisComplaintbehadbeforetheBoardofMedicalExaminersoftheStateofNevadaasprovidedbystatute,andthattheBoardofMedicalExaminersoftheStateofNevada,aftersuchhearing,takessuchactionasmaybejustandproperpursuanttoNevadaRevisedStatutes.3
