InsupportofhisComplaint,Plaintiffstatesasfollows:1.PlaintiffhasfiledthisComplainttoreviewthefinaldecisionoftheVILLAGEOFOAKBROOKBOARDOFFIREANDPOLICECOMMISSIONERS.AcopyofsaiddecisionisattachedheretoasExhibit"A".andincorporatedhereinbyreference.2.Atalltimesmaterialherein,Defendant,VILLAGEOFOAKBROOKBOARDOFFIREANDPOLICECOMMISSIONERS,wasinexistenceandactingunderthepublicgovernmentalauthorityofDefendant,VILLAGEOFOAKBROOK.3.Defendant,VILLAGEOFOAKBROOKBOARDOFFIREANDPOLICECOMMISSIONERS,anadministrativeagencyoftheDefendant,VILLAGEOFOAKBROOK,ILLINOIS,waschargedwithconductingafairhearingandfairlydecidingthechargesagainstPlaintiffincompliancewiththeevidenceandthelaw.
4.Defendant,THOMASSHEAHAN,wastheChiefofPolicewhowasresponsibleforthepreparationandfilingofandoneoftheindividualsresponsiblefortheprosecutionoftheparticularchargesinvolvedherein.DefendantSHEAHAN'Sactionsinfilingandprosecutingthechargeswerevindictive,retaliatory,unfounded,excessiveandpartofapatternofharassmentofthePlaintiff.AcopyoftheChargesareattachedasExhibit"B"andincorporatedhereinbyreference.5.Defendants,JOHNPIRCON,FREDRICKCAPPETTAandEDWARDH.NIELSENwereatalltimesmentionedherein,membersoftheDefendant,VILLAGEOFOAKBROOKBOARDOFFIREANDPOLICECOMMISSIONERSandarejoinedasDefendantshereinintheircapacitiesassuchcommissionmembers.6.Plaintiff,STEPHENPETERSON,atalltimesmentionedhereinwasaresidentoftheCountiesofKaneandofWill,StateofIllinois,andemployedasapoliceofficerinthepolicedepartmentoftheDefendant,VILLAGEOFOAKBROOK,locatedintheCountyofDuPage.7.OnoraboutFebruary19,2011,DefendantVILLAGEOFOAKBROOKBOARDOFFIREANDPOLICECOMMISSIONERSissuedafinaldecisiontoterminatePlaintiff,effectiveuponentryofthatOrder.AcopytheOrderisattachedasExhibit"A"andincorporatedhereinbyreference.8.Theproceduralrulings,conclusionsoflawandfactualfindingsoftheDefendant,VILLAGEOFOAKBROOKBOARDOFFIREANDPOLICECOMMISSIONERSwithregardstoguiltareagainsttheweightoftheevidence,erroneous,arbitraryandcapricious,unfair,contrarytolaw]andcontrarytofacts.9.ThepunishmentimposeduponPlaintiff,STEPHENPETERSON,bytheDefendant,VILLAGEOFOAKBROOKBOARDOFFIREANDPOLICE

COMMISSIONERSiscontrarytotheevidence,excessive,politicallymotivated,unjust,baseduponinadmissibleevidence,baseduponevidencetakeninviolationofhisconstitutionalrightsandcontrarytolaw,andthepunishmentexceedsthelawfulauthorityanddiscretionoftheDefendant,VILLAGEOFOAKBROOKBOARDOFFIREANDPOLICECOMMISSIONERSunderlawandunderthefactsandcircumstancesofthiscase.

TherulingsoftheVILLAGEOFOAKBROOKBOARDOFFIREANDPOLICECOMMISSIONERSonPlaintiff'sMotiontoContinueandMotiontoDismisswerecontrarytotheevidenceandthelaw,contrarytotheprinciplesofjudicialeconomyandfairness,andclearlyerroneous.SaidmotionsareattachedasExhibits"C"and"0"andincorporatedhereinbyreference.
