DespitethefactthatAANtoldtheIRSonlyaminorportionofitsactivitieswouldbepolitical,AANextensivelyparticipatedinpoliticalcampaignsthroughoutthe2010campaigncycle.Becauseoftheseriousnatureofthetaxlawviolations,theIRSshouldconsiderrevokingAAN'stax-exemptstatusand/orimposeappropriateexcisetaxesandpenaltiesontheorganization.Underthelaw,section

(c)(4)organizationssuchasAANmustbeprimarilyengagedinthepromotionofsocialwelfare,"whichdoesnotinclude"directorindirectparticipationorinterventioninpoliticalcampaignsonbehalfoforinoppositiontoanycandidateforpublicoffice.:"TheCodedoesnotstatepreciselywhatconstitutespoliticalactivity,butsomeactivitiesunquestionablyarepolitical,suchasexplicitlyadvocatingtheelectionordefeatofacandidateforpublicoffice."Forotheractivities,theIRScurrentlyappliesafactsandcircumstancestesttodeterminewhetheranorganizationhasintervenedinapoliticalcampaign.
