I.SUMMARY
Disbarmentisgenerallytheappropriatesanctionwhenalawyer
knowingly
convertsclientfundsandabandonsclients.Respondentfailedtocommunicatewith,neglected,andultimatelyabandonednineclients.Healsoknowinglyconvertedfundsfromeightclients.Respondenthasnotparticipatedinthedisciplinaryproceedingsbroughtagainsthim,andtheCourtisunawareofanyfactorsthatmitigatehisconduct.AfterconsideringthenatureofRespondent'smisconductanditsconsequences,theaggravatingfactors,andtheabsenceofcountervailingmitigatingfactors,theCourtfindstheappropriatesanctionisdisbarment.
II.PROCEDURALHISTORY
OnDecember4,2009,thePeoplepetitionedtheColoradoSupremeCourttoimmediatelysuspendRespondentpursuanttoC.R.C.P.251.8.6.Respondentdidnotrespond.TheColoradoSupremeCourtimmediatelysuspendedRespondentonDecember21,2009.

OnAugust3,2010,thePeoplefiledacomplaintallegingthatRespondenthadviolatedColo.RPC1.3,1.4(a),8.4(c),1.15(a),and1.150).Respondentfailedtoanswerthecomplaint,andtheCourtgrantedamotionfordefaultonOctober21,2010.Upontheentryofdefault,theCourtdeemsallfactssetforthinthecomplaintadmittedandallruleviolationsestablishedbyclearandconvincingevidence.

TheCourtherebyadoptsandincorporatesbyreferencethefactualbackgroundofthiscaseasdetailedintheadmittedcomplaint.RespondenttookandsubscribedtotheoathofadmissionandgainedadmissiontothebaroftheColoradoSupremeCourtonJune8,1995.Heisregisteredupontheofficialrecordsunderattorneyregistrationnumber25637,andisthereforesubjecttothejurisdictionoftheCourtpursuanttoC.R.C.P.251.1.

July2007andmovedtoChicago.RespondentagreedtoassumeresponsibilityforCianciolo'sexistingclients.MillanenteredintoanewfeeagreementwithRespondenttofinishtheconsularprocessingforherhusband.MillanandRespondentfirstdiscussedthismatterinMay2008.Attheendof2008,RespondentsentdocumentsconcerningMillan'smattertotheNationalVisaCenter("NVC").InMarch2009,aftertheNVCprovidednotificationthatitlackedcertaindocuments,MillanprovidedthemissingdocumentstoRespondent,andhisofficeapparentlyforwardedthemtotheNVC.AlsoinMarch2009,MillanpaidRespondent$1,000.00tocompletetheconsularprocessing.MillanlastmetwithRespondentonAugust19,2009,atwhichtimeRespondenttoldMillanhewould"correctherpapers."Onthesamedate,herequestedthestatusofherapplicationfromtheNVCandformallyenteredhisappearanceinMillan'smatterwiththefederalimmigrationservicesdepartment.ASeptember4,2009,letterfromtheNVCinformedRespondentthatinformationwasstillmissingfromMillan'sapplication.OnoraboutSeptember14,2009,Millan'ssister-in-law,whoalsowasaclientofRespondent,toldMillanthatshehadbeenunsuccessfulinherattemptstocontactRespondent.MillanthentriedtocallRespondent'soffice,buthedidnotanswerandhisvoicemailboxwasfull.ShecalledRespondent's

transferreddirectlytovoicemail.WhenMillanvisitedRespondent'soffice,noonewaspresent.MillanattemptedwithoutsuccesstocallRespondenteverydayforapproximatelyonemonth.WhenRespondentdidnotappearforhersister-in-law'scourtdateonOctober9,2009,Millancontactedanotherattorney.ThatattorneyalsotriedinvaintocontactRespondent.RespondentnevercompletedtheworkMillanhiredhimtoperform,henevercommunicatedwithMillanafterAugust2009,andheneverrefundedher$1,000.00payment.Throughthisconduct,RespondentabandonedthedutiesheowedtohisclientandviolatedColo.RPC1.3,1.4(a),and8.4(c).
TheCollado/DiazMatter
MichelleColladoDiaz("Collado")andherhusband,DomingoColladoDiaz("Diaz"),retainedRespondentonFebruary13,2009.Diazhadbeenarrestedfordrivingundertheinfluenceandwasinimmigrationremovalproceedings.Collado,Diaz,andRespondentagreedthatRespondentwoulddefendtheremovalproceedingsincourt,prepareaForm1-130relativepetition,representDiazintheinterviewconcerningthatpetition,completeconsularprocessing,andprepareahardshipwaiveronForm1-601.Inexchange,ColladoandDiazagreedtogiveRespondentaflatfeeof$6,890.00,tobepaidthroughaninitial$1,000.00depositandmonthlypaymentsof$400.00beginningonApril1,2009.ColladoandDiazpaidatotalof$4,155.00toRespondent,includinga$355.00filingfee.AmasterhearinginDiaz'sremovalproceedingwassetforApril8,2009.ColladoandDiazattended,butRespondentdidnotappear.ThejudgeprovidedDiazanextension,settingthematterforNovember18,2009.ColladocalledRespondent'sofficeandcellphonemultipletimesonApril8,2009,butshecouldnotreachhim.Laterthatday,shereachedsomeoneatRespondent'soffice,whoinformedherhewasill.RespondentalsosentColladoatextmessagetellingherhewas"verysick"but"itwillallworkout."InMayandJune2009,ColladocommunicatedwithRespondentandhisofficeseveraltimes,andsenthimdocumentsheneeded.ShedidnotspeakwithRespondentafterJune2009,thoughshedidcommunicatewithhisstafftocheckonthestatusofherhusband'smatterandtoensuretheyhadreceivedthemonthlypayments.OnOctober3,2009,ColladoemailedRespondent.seekingtodiscusstheirupcominghearing.Shealsosenthimapaymenttwodayslater.ByOctober6,2009,Colladohadnotreceivedaresponsetoheremail.ShecalledRespondent'sofficebutcouldnotleaveamessagebecausethevoicemailboxwasfull.ColladocontinuedtocallandemailRespondentwithoutsuccess.
