BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 101.01.
That sections 122.075, 125.11, 127.12,164.04, 164.08, 4163.07, 4301.62, 4501.02, 4501.06, 4501.21,4501.81, 4503.03, 4503.031, 4503.04, 4503.521, 4503.62, 4503.94,4505.06, 4505.09, 4506.08, 4507.05, 4507.23, 4510.43, 4511.108,4511.53, 4511.69, 4513.24, 4517.01, 4517.02, 4517.33, 4582.12,4582.31, 4905.802, 5501.51, 5501.55, 5502.011, 5525.15, 5577.042,and 5751.01 be amended, section 4905.802 (4905.801) be amended forthe purpose of adopting a new section number as shown inparentheses, and sections 4503.037, 4517.16, 4517.17, 4517.171,4517.18, and 4749.031 of the Revised Code be enacted to read asfollows:2122232425262728293031
Sec. 122.075.
(A) As used in this section: 32(1) "Alternative fuel" means blended biodiesel, blendedgasoline, or compressed air used has the same meaning as inair-compression driven engines section 125.831 of the RevisedCode.33343536(2) "Biodiesel" means a mono-alkyl ester combustible liquidfuel that is derived from vegetable oils or animal fats, or anycombination of those reagents, and that meets American society fortesting and materials specification D6751-03a for biodiesel fuel(B100) blend stock distillate fuels.3738394041(3) "Diesel fuel" and "gasoline" have the same meanings as insection 5735.01 of the Revised Code.4243

(4) "Ethanol" has the same meaning as in section 5733.46 ofthe Revised Code.4445(5) "Blended biodiesel" means diesel fuel containing at leasttwenty per cent biodiesel by volume.4647(6) "Blended gasoline" means gasoline containing at leasteighty-five per cent ethanol by volume.4849(7) "Incremental cost" means either of the following: 50(a) The difference in cost between blended gasoline andgasoline containing ten per cent or less ethanol at the time thatthe blended gasoline is purchased;515253(b) The difference in cost between blended biodiesel anddiesel fuel containing two per cent or less biodiesel at the timethat the blended biodiesel is purchased.545556(B) For the purpose of improving the air quality in thisstate, the director of development shall establish an alternativefuel transportation grant program under which the director maymake grants to businesses, nonprofit organizations, public schoolsystems, or local governments for the purchase and installation ofalternative fuel refueling or distribution facilities andterminals, for the purchase and use of alternative fuel, and topay the costs of educational and promotional materials andactivities intended for prospective alternative fuel consumers,fuel marketers, and others in order to increase the availabilityand use of alternative fuel.5758596061626364656667(C) The director, in consultation with the director ofagriculture, shall adopt rules in accordance with Chapter 119. ofthe Revised Code that are necessary for the administration of thealternative fuel transportation grant program.
