ANKRUPTCY COURT JURISDICTION
:
The term "court jurisdiction" refers to the power of a court to oversee a certaincase and to issue any rulings or orders associated with the case. The UnitedStates district courts have original and exclusive jurisdiction of all cases undertitle 11 (see 28 U.S.C.§ 1334(a)). However, each such district court may, byorder, refer bankruptcy matters to the bankruptcy court (see 28U.S.C.§ 157(a)).In general, the bankruptcy case is filed in the District in which the domicile,residence, principal place of business or principal assets in the United States of the debtor have been located for the 180 days preceding the filing, or for alonger portion of such 180-day period.(28 U.S.C. § 1408)See also Broady v.Harvey (In re Broady), 247 B.R. 470(B.A.P. 8th Cir. 2000); In re Fishman, 205B.R. 147(Bankr. E.D. Ark. 1997);Bankruptcy is always the federal jurisdiction subject matter. Bankruptcy casesare not filed in state courts. It is always filed in the federal bankruptcy districtcourts. Filing of the bankruptcy depends on the county where the debtor(s)has/have stayed for most of the 180 days or carried out the principle place of business. It also depends on the county where the most of debtor(s) assets aresituated.Proceedings that may arise in bankruptcy cases are classified into threecategories: (28 U.S.C. §157)(i) core proceedings: The bankruptcy court can enter the final orders under thecore proceedings(ii)non-core, related to proceedings: Unless the parties consent to be bound bythe bankruptcy court's decision, bankruptcy judges may only submit proposedfindings of fact and conclusions of law to the district court for thoseproceedings.(iii) non-core, unrelated proceedings: the bankruptcy court lacks anyjurisdictionThe US has been divided into 13 circuit courts for the federal court Jurisdictionpurpose. Even seven states form the one circuit court.
