EQUIPMENTIN
OPEN
SPACEWHEREAS,thestorageofabandonedorinoperableandunregisteredmotorvehicles,motorvehiclepartsandotherunsightlymaterialinopenareashasadeleteriouseffectuponthevalueandenjoymentofpropertiesnearbyandconstitutesapotentialhealthandsafetyhazardtopersonsintheneighborhood;andWHEREAS,thestorageandownershipofunregisteredmotor

LesinopenareashavethefurthereffectofdeprivingthemunicipalauthoritiesofaneffectivemeanSofassessingandcollectingpersonalpropertytaxes;and

NOWTHEREFORE,BeitorderedbytheTownCounciloftheTown

Wolcottthat:SECTIONI
A.
Nopersonshallpermitanyabandonedorinoperablemotorvehicles,whetherregisteredorunregistered,ownedbysuchpersontoremainparkedorstoredinanopenareawithinthelimitsofthe
Town
ofWolcott.
B.
Nopersonshallpermitmorethanoneunregisteredmotorvehicle,regardlessof

ofWolcott.C.NoownerofaparcelofrealpropertyintheTownofT"Jolcottshallpermitanysuchabandonedorinoperablevehicletobeparkedorstoredinanopenareaonsaidowner'sparcelofproperty,andnoownerofaparcelofrealpropertyintheTownofWolcottshallpermitmorethanoneunregisteredmotorvehicletoremainparkedorstoredinanopenareaonsaidowner'sparcelofpropertyunlesssaidrealpropertyisusedforthesaleorrepairofmotorvehiclespursuanttoanappropriatelicenseissuedbytheStateofConnecticutorunlesssaidownerofrealpropertymaintainsorconstructs

legallylicensedjunkyard.D.Amotorvehiclewhichisintheprocessofbeingactivelyrepairedand/orrestoredshallbeexemptforaperiodofoneyearfromtheaforementionedprohibitionstotheextentofone(1)vehicleperdwellingunitand/orpropertyprovidedthepossessorhas:(1)notifiedtheWolcottPoliceDepartmentinwritingidentifyingthemotorvehiclebyowner,year,make,modelandidentificationnumber;and(2)keepssaidvehiclecoveredwithasuitabletarporvehiclecoverwhennoworkisbeingperformedthereon.

SECTION2A.Nopersonsshallstoreorkeepanyunsightlymaterialorequipment,ashereinafterdefined,ownedbysuchpersoninanopenareawithinthelimitsoftheTownofWolcott.B.NoownerofrealpropertyintheTo~rnofWolcottshallpermitanysuchunsightlymaterialorequipmenttobelocatedorstoredonsaidowner'sproperty.
c.
Anybuildingmaterialorequipmentintendedforconstructionorimprovementforwhichavalidbuildingpermitisineffectshallbeexemptfromthissectionoftheordinance.Thissectionshallfurthernotpertaintoexistingbuildingsupplyyardsordulylicensedcontractor'syards,subject,howevertoalltheprovisionsoftheWolcottZoningRegulationandtheConnecticutGeneralStatutes.SECTION3A.Theterm"inoperable"asusedhereinshallbedefinedas
that
itemofpersonalpropertywhichisinherentlyincapableofbeingoperatedorperformingthefunctionsforwhich
it
was
designedbyvirtueofmissingparts,orbrokenorseverelydamagedessentialcomponents,therebyrenderingthesameincapableofbeingregistered,withoutfurtherrepair,intheStateofConnecticnt

vehiclewhichcanbelegallydrivenonthepublichighwflYsofthisState.B.Theterm"motorvehicle"shallincludeallautomobiles,trucks,vans,camptrailers,boattrailers,housetrailers,mobilehomes,motorcycles,oranyothermotorizedvehicledesignatedorusedforhighwaypurposesandrequiredtoberegisteredbytheStateofConnecticutMotorVehicleDepartment.C.Theterm"unsightlymaterial"hereinshallbedefinedasanymaterial,including,butnotlimitedtohouseholdappliances,partsofmotorvehicles,furniture,equipment,buildingmaterials,junkandrefusewhich:(1)ishazardoustothesafetyorwelfareofpeopleorproperty;or(2)offendstheaestheticsense;(3)isundulyoffensivetotheneighborsorpublic;or(4)isunsuableand/ordiscardedand/orunsanitaryand/orcausesapublicnuisance.D.Theterm"unregisteredmotorvehicle"asusedhereinshallbedefinedasanymotorvehiclewhichisnotregisteredwiththeConnecticutDepartment
ofMotorVehicles.
 
SECTION4A.TheChiefofPoliceorhisauthorizedagent,~,henhehasdeterminedthataviolationofSection
1
ofthisordinancehasbeencommitted,shallprovidenotificationtoanowner.Suchnotificationshallconsistof:
(1)
anoticeinpersonorawrittennoticegiven
by
registeredorcertifiedmailtotheowner,ifknown,ofthemotorvehicle;
(2)
a
noticeinpersonor
a
writtennoticegivenbyregisteredorcertifiedmailtotheowneroftherealpropertyonwhichsuchmotorvehicleislocated;orinlieuthereof
(3)
apublicationofnoticetoanyandallinterestedpartiesatleastone
(1)
timeinanewspaperhavingasubstantialcirculationintheTownofWolcott.
B.
Saidnoticeshallstatethatthesaidmotorvehicleshallberemovedbytheownerofsuchmotorvehicle,or,theowneroftherealpropertyuponwhichsuchmotorvehicleislocated,asthecasemaybe,withinfifteen

daysfromthedateofreceiptofsaidnoticeorpublicationthereof.C.FailurebytheownerofthemotorvehicleorbytheowneroftherealpropertyonwhichHaidvehicleisparkedorstoredtoremovesuchvehiclewithinfifteen

theeventthatsuchmotorvehicleisnotsoremovedbyeithertheownerofthemotorvehicleortheowneroftherealpropertythenthesameshallbecausedtoberemovedimmediatelybytheChiefofPoliceorhisauthorizedagentwiththeassistanceoftheTownAttorney.
E.
Intheeventthatsuchmotorvehicleisremovedby
the
ChiefofPoliceorhisauthorizedagent,thesaidownershallbeliableforallcostsofsuchremoval,storageorsaleofthesame,andalienforsaidcostsshallexistonsuchmotorvehicleforexpenseinvolvedinitsremoval,storageandsaleasproyidedinSection
14-150
oftheConnecticutGeneralStatutes,asamended.SECTION5
A.
TheZoningEnforcementOfficer,orhisauthorizedagent,whenhehasdeterminedthataviolationofSection2ofthisordinancehasbeencommitted,shallprovidenotificationtoanoWner.Suchnotifications
