ThisnoticeamendsandsupersedestheAmendedNoticeofProposedLicenseCancellationandProposedRefusaltoRenewLicensedatedJune26,2008.Substantivechangesfromthatletterappearunderlinedafterthe(*).
I.LICENSECANCELLATION
PursuanttoORS471.315,theCommissionmaycancelorsuspendyourlicenseorassessacivilpenaltyforanyviolation.ThePublicSafetyProgramproposesthattheCommissioncancelyourlicenseforthefollowingviolations:ViolationNumberOneThereisahistoryofseriousandpersistentproblemsinvolvingdisturbances,lewdorunlawfulactivitiesornoiseeitherinthepremisesorinvolvingpatronsoftheestablishmentintheimmediatevicinityofthepremises,includingbutnotlimitedtoexcessivenoise,publicdrunkenness,fights,altercations,harassmentandpublicurination.ThisaviolationofORS471.315(1)(c).Theproblemsincludethefollowing:OnJune18,2006atabout3:00AM,therewasaverbalaltercationbetweentwofemalepatrons,followedbyaphysicalaltercation.Onefemalepatrongrabbedanotherfemalepatron'shair,andthenaphysicalaltercationtookplaceonthedancefloor.Atleastoneofthepatronswasvisiblyintoxicated.Oneofthefemaleswasbittenonherhandandkickedinthehead,andsustainedbruisesonherhands,armsandthighs.OnNovember18,2006atabout2:38AM,BPDofficersrespondedtoacomplaintofafemalepatronassaultinganotherfemalepatroninthepremisesbathroom.Thepatronhadaswolleneyeandscratchesonherfaceandstatedthatemployeeswerenotbeingcooperativewithher.

He
reportedthatunderagefemaleswereatthelicensedpremises.
The
dispatcherwhotookthecallnotedthatthemalesoundedintoxicated.OnFebruary11,2007atabout2:17AM,afemalepatroncalledpolicetoreportthatsecuritywasattemptingtoevictapproximatelyeighttotenmalepatronswhohadbeendrinking.
The
confrontationbecamephysicalwhilethecallerwasonthephonewithpolice.OnMarch4,2007atabout1:23AM,amalepatronapproachedafemalepatroninsidethepremisesandyelledather.Anothermalepatron,thefemalepatron'sfiance,engagedinaphysicalaltercationwithhim.Oneofthemalepatronsreceivedableeding1-inchcutnearhisrighteyebrowandaquarter-sizedbumpnearhislefttemplewhiledefendingthefemalepatron,whowasslappedintheface.
The
malepatronwhoinitiatedtheconfrontationwasarrestedforAssaultIVandHarassment.OnMarch31,2007atabout2:12AM,apatroncalledpolicetoreportthatanotherpatron,whowasvisiblyintoxicated,waspunchedinthefaceinsidethepremises.

officerslocatedthepatrononthefloorofthelicensedpremisesbleedingfromhisfaceandhead.
The
patronhadsustainedacuttohisfaceandthebackofhishead.Premisesstafftoldpolicethattwogroupsofmales,manyofwhomwerevisiblyintoxicated,werefightingwitheachotherandthatstaffwereunsuccessfulinseparatingthem.OnMay12,2007atabout2:00AM,aphysicalaltercationoccurredbetweenthreedifferentgroupsofpatrons,totalingabout15people.Onefemalepatronwasbleedingfromherheadafterbeingpunchedandhitintheheadwithabeerbottlebyamalepatronfollowingaverbalaltercationwithanotherfemalepatron.
BPD
officersarrivedtofindchaosintheparkinglotandnopremisesstaffoutsidetryingtocontrolthesituation.Premisesstaffwereuncooperativewith
BPD
officers.Multiplepatronswerevisiblyintoxicated.Somepatronstoldpolicethatpremisesstaffwereallowingpatronstobringgunsontothepremises.OnJune24,2007atabout2:40AM,apatroncalledpoliceandreportedthatsecuritystaffweredetainingapatronwhohadagun.
The
patronstatedthathehadbeenthreatenedwiththeguninthebathroomofthepremises.
He
alsoreportedthatthesamepersonhadthreatenedtoshootothers.OnJuly8,2007atabout1:52AM,aniratepatronwhostatedhewasintoxicatedcalledpoliceclaiminghewasoverservedand/oroverchargedandthatpremisesstaffrefusedtogethimacab.
The
callerrefusedanofferfrompolicetocallacab.

February6,2009Page3OnJuly8,2007atabout3:12AM,averbalargumentoccurredbetweenpatronsinsidethelicensedpremises.Oneofthepatrons,whowasvisiblyintoxicated,calledpoliceandreportedthathercarwasbrokeninto.OnJuly21,2007atabout5:54AM,a
BPD
dispatcherreceivedacallfromahospitalreportingthatapatronwasstabbedatthelicensedpremisesandrequiredemergencysurgeryforapuncturedintestine.
The
injuredpatrontold
BPD
officersthataphysicalaltercationoccurredinsidethelicensedpremisesbetweenhiscousinandanothermalepatronaroundclosingtime.Alargephysicalfighteruptedandsecuritystaffforcedallofthepatronsintotheparkinglot.Whiledrivingawayfromthepremises,theinjuredpatronrealizedhehadbeenstabbedduringthealtercation.OnJuly31,2007atabout12:13AM,avisiblyintoxicatedminorpatronenteredthelicensedpremisesandadmittedtodrinkingalcoholinside.Afterbeingtoldtoleave,heinstigatedaphysicalaltercationintheparkinglotandthenwaspunchedinthefacebyanothermalepatron.
BPD
officersarrestedthesecondpatronforaprobationviolationforbeingonthepremisesandconsumingalcohol.OnAugust12,2007atabout12:02AM,apersoncalledpolicetoreportthatamalewasurinatingintheparkinglotofthelicensedpremises.OnSeptember8,2007atabout12:53AM,apatroncalledpolicetoreportaphysicalfightatthepremises.Approximatelytenmalepatronswereinvolvedinaphysicalaltercationinsidethepremisesandonemalepatronwasbleedingfromacutabovehiseye.
The
calleralsoreportedthatasecuritystaffmemberkickedapatronintheheadwhileattemptingtoevictthepatrons.OnSeptember22,2007atabout2:42AM,
BPD
receivedacalltorespondtothelicensedpremisesonareportofgangactivityandphysicalaltercationsinvolvingapproximately150peopleoccurringbothinsideandoutsidethelicensedpremises,includingpatronsstandingonthetopsofcars.Whenpoliceresponded,witnesseswerenotcooperative.OnOctober6,2007atabout3:06AM,afemalepatroncalledpoliceandreportedthatanotherfemalepatronpunchedherinthefaceandamalepatronreachedunderherskirt.OnOctober20,2007atabout2:53AM,thepremisesmanagercalledpolicetoreportthatnumerouspatronswerehangingoutintheparkinglotandaskedpolicetorespondtothepremisesinordertomakethepatronsleave.
