To amend sections 3313.482, 3314.08, 3317.01,3326.11, and 3327.02 and to enact section 3313.88of the Revised Code to excuse up to five, insteadof three, calamity days for the 2010-2011 schoolyear, to broaden schools' authority to make upcalamity days by lengthening remaining days in theschool year, to waive the number of hours acommunity school is closed for a public calamityif it meets certain requirements, to allow publicand chartered nonpublic schools to make up excesscalamity days via lessons posted online, toprohibit school districts from declaring itimpractical to transport nonpublic or communityschool students solely on days scheduled by theschools to make up calamity days, and to declare123456789101112131415

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:
Section 1.
That sections 3313.482, 3314.08, 3317.01, 3326.11,and 3327.02 be amended and section 3313.88 of the Revised Code beenacted to read as follows:171819
Sec. 3313.482.
(A) Annually, prior to the first day ofSeptember, the board of education of each city, local, andexempted village school district shall adopt a resolutionspecifying a contingency plan under which the district's studentswill make up days on which it was necessary to close schools forany of the reasons specified in division (A)(2) of section 3306.01and division (B) of section 3317.01 of the Revised Code, if anysuch days must be made up in order to comply with the requirementsof that section and sections 3306.01, 3313.48 and, 3313.481, and3317.01 of the Revised Code. The resolution plan shall provide inthe plan for making up at least five full school days. The planmay provide for making up some or all of the days a school isclosed by increasing the length of other school days in the mannerauthorized in division (B) of this section. No resolution adoptedpursuant to this division shall conflict with any collectivebargaining agreement into which a board has entered pursuant toChapter 4117. of the Revised Code and that is in effect in thedistrict.202122232425262728293031323334353637(B) Notwithstanding the content of anything to the contraryin the contingency plan it adopts under division (A) of thissection, if a school district closes or evacuates any schoolbuilding for any of the reasons specified in division (A)(2) ofsection 3306.01 and division (B) of section 3317.01 of the RevisedCode, or as a result of a bomb threat or any other report of analleged or impending explosion, and if, as a result of the closing38394041424344

or evacuation, the school district would be unable to meet therequirements of sections 3306.01, 3313.48, 3313.481, and 3317.01of the Revised Code regarding the number of days schools must beopen for instruction or the requirements of the state minimumstandards for the school day that are established by thedepartment of education regarding the number of hours there mustbe in the school day, the school district may increase the lengthof one or more other school days for the school that was closed orevacuated, in increments of one-half hour, to make up the numberof hours or days that the school building in question was soclosed or evacuated for the purpose of satisfying the requirementsof those sections regarding the number of days schools must beopen for instruction or the requirements of those standardsregarding the number of hours there must be in the school day.4546474849505152535455565758(C) If a school district closes or evacuates any schoolbuilding for any of the reasons specified in division (B) ofsection 3317.01 of the Revised Code, and if for that school thetotal number of full school days specified in the district'scontingency plan adopted under division (A) of this section isinsufficient to enable the school district to meet therequirements of sections 3313.48, 3313.481, and 3317.01 of theRevised Code regarding the number of days schools must be open forinstruction or the requirements of the state minimum standards forthe school day that are established by the department of educationregarding the number of hours there must be in the school day, theschool district may increase the length of one or more otherschool days for the school that was closed or evacuated, inincrements of one-half hour, to make up the number of hours ordays that the school building in question was so closed orevacuated for the purpose of satisfying the requirements of thosesections regarding the number of days schools must be open forinstruction or the requirements of those standards regarding thenumber of hours there must be in the school day.
