WHITE, ROBBINS,EICHELBERGER, STACK, WAUGH, GREENLEAF AND RAFFERTY,MARCH 25, 2011REFERRED TO EDUCATION, MARCH 25, 2011AN ACTAmending the act of March 10, 1949 (P.L.30, No.14), entitled "Anact relating to the public school system, including certainprovisions applicable as well to private and parochialschools; amending, revising, consolidating and changing thelaws relating thereto," further providing for definitions andfor concurrent enrollment agreements; repealing provisionsrelating to charter schools; and providing for charterschools and cyber charter schools.The General Assembly of the Commonwealth of Pennsylvaniahereby enacts as follows:Section 1. The definitions of "concurrent student" and"school entity" in section 1602-B of the act of March 10, 1949(P.L.30, No.14), known as the Public School Code of 1949, addedJuly 13, 2005 (P.L.226, No.46), are amended to read:Section 1602-B. Definitions.The following words and phrases when used in this articleshall have the meanings given to them in this section unless thecontext clearly indicates otherwise:* * *"Concurrent student." A student who is enrolled in a school

district, a charter school, a cyber charter school, an areavocational-technical school, a nonpublic school, a privateschool or a home education program under section 1327.1 and whotakes a concurrent course through a concurrent enrollmentprogram.* * *"School entity." A school district, a charter school, acyber charter school or an area vocational-technical school.* * *Section 2. Section 1613-B of the act is amended by adding asubsection to read:Section 1613-B. Concurrent enrollment agreements.* * *(c) Charter schools and cyber charter schools.--Charterschools and cyber charter schools shall have the power andauthority to enter into a concurrent enrollment agreement withan institution of higher education, and appropriate credit shallbe awarded to students concurrently enrolled under theagreement.Section 3. Article XVII-A heading, Subdivision heading (a),sections 1701-A and 1702-A, added June 19, 1997 (P.L.225,No.22), are repealed:[ARTICLE XVII-A.CHARTER SCHOOLS.(a) Preliminary Provisions.Section 1701-A. Short Title.--This article shall be knownand may be cited as the "Charter School Law."Section 1702-A. Legislative Intent.--It is the intent of theGeneral Assembly, in enacting this article, to provide pupilsand community members to establish and maintain schools that20110SB0904PN0919

operate independently from the existing school districtstructure as a method to accomplish all of the following:(1) Improve pupil learning.(2) Increase learning opportunities for all pupils.(3) Encourage the use of different and innovative teachingmethods.(4) Create new professional opportunities for teachers,including the opportunity to be responsible for the learningprogram at the school site.(5) Provide parents and pupils with expanded choices in thetypes of educational opportunities that are available within thepublic school system.(6) Hold the schools established under this act accountablefor meeting measurable academic standards and provide the schoolwith a method to establish accountability systems.]Section 3.1. Section 1703-A of the act, amended June 29,2002 (P.L.524, No.88), is repealed:[Section 1703-A. Definitions.--As used in this article,"Appeal board" shall mean the State Charter School AppealBoard established by this article."At-risk student" shall mean a student at risk of educationalfailure because of limited English proficiency, poverty,community factors, truancy, academic difficulties or economicdisadvantage."Charter school" shall mean an independent public schoolestablished and operated under a charter from the local board ofschool directors and in which students are enrolled or attend. Acharter school must be organized as a public, nonprofitcorporation. Charters may not be granted to any for-profitentity.20110SB0904PN0919
