A RESOLUTION CONCERNING PRIVACY HOURS AT FRATERNITYHOUSING
WHEREAS an IFC Fraternity house is a private residence for itsmembers, just as residence halls, Sorority houses, andcampus apartments are, and NOTING that in the Lease Agreement between the university and theIFC Chapters it expresses that SMU Officials, including theSMU police department, may only enter the home at areasonable hour, and FURTHER NOTING that in the sub-lease between an IFC fraternity and a givenIFC resident it is stated that university officials and staff may only enter a room for inspections or with a warrant for the search of a students room, andHAVING EXAMINED that the Student Code of Conduct Section 2.08(c) states thatno searches of Fraternity Houses will be conducted unlesssuch an order is issued upon reasonable cause through theDean of Student Life and Executive Director of ResidenceLife and Student Housing, andRECOGNIZING that section 2.08(c) also states that nothing herein shall beconstrued as to deny the University the right at anyreasonable hour time to conduct inspections to determinecompliance with health and safety regulations or to addressa person’s health and safety, andHAVING FURTHER EXAMINED that the SMU Student Code of Conduct also states thatuniversity staff and officials may only enter a residentsroom when there is a threat to someone’s health or at anyreasonable hour, as the leasing agreement states, andRECOGNIZING that the Student Code of Conduct Section 3.14(a) definesharassment as conduct which unreasonably impairs theprivacy of any person or persons of another member of theuniversity community, and1
