Ms.FionaAlexanderMarch31,2011PageTwoItisnosurprisethatNTIAwouldundertakeacomprehensivereviewofthelANAfunctions;giventhelANAfunctionsareanessentialpieceoftheoverallfoundationoftheInternet.NoonewoulddisagreethattheInternethasgrownandevolvedsignificantlysincethefirstlANAfunctionscontractin2000.Withthissuccesscomesamorediverseglobalcommunityofstakeholderswithnewconcernsandexpectations.InordertocontinuetobuildconfidenceintheInternet,itiscriticalthatthelANAfunctionsbemanagedinawaythatisopen,transparent,andgloballyaccountable.ThiscomprehensivereviewisjustonestepintheeventualinternationalizationofoversightofthelANAfunctions.
1.ThelANAfunctionshavebeenviewedhistoricallyasasetofinterdependenttechnicalfunctionsandaccordinglyperformedtogetherbyasingleentity.Inlightoftechnologychangesandmarketdevelopments,shouldthelANAfunctionscontinuetobetreatedasinterdependent?Forexample,doesthecoordinationoftheassignmentoftechnicalprotocolparametersneedtobedonebythesameentitythatadministerscertainresponsibilitiesassociatedwithrootzonemanagement?Pleaseprovidespecificinformationtosupportwhyorwhynot,takingintoaccountsecurityandstabilityissues.
DuetotheinterconnectednatureoftheInternet'sinfrastructureservices,thevarioustechnicaltaskscoveredbythelANAfunctionscontractbenefitfrombeingperformedby
a
singleentity.Whileindividualtechnicaltasks(such
as
rootzonechanges,DNSprotocoichanges,androutinginfrastructurechanges)maytheoreticallybeperformedindependently,thepotentialconsequencesofconflictingchangessuggestthatjointcoordinationofchangestothesecriticalfunctionswouldminimizerisk.Whilejointcoordinationdoesnotrequirejointdeliveryby
a
singleentity,theNT/Ashouldnotseparateperformanceofthesefunctions.Thesynergiesachievedthroughjointperformance
of
technicalfunctionsmayalsoincludetasksnotcoveredbythelANAfunctionscontract.InanysubsequentlANAagreement,theNT/AshouldclearlystatethatthelANAcontractormayperformadditionalrelatedtasksattherequest
of
otherpartiesonbehalfoftheInternetcommunity(e.g.performanceofIN-ADDR.ARPAzonemaintenance,
or
RPKfpublication
of
digitally-signednumberresourceinformation.)Additionally,theNT/Ashouldexpresslyprovideassurancesthatanysuchactivitieswillnotbeconstruedtobe

theydonotspecificallyconflictwithexistinglANAcontracttasks.Moregenerally,thescope
of
theNT/AlANAfunctionsagreementandtaskscontainedthereinshouldnotbeexpandedbyNT/Aunderanycondition.Additionally,giventheon-goingevolutionoftheUSGoversightinthisarea,webelievethat
a
cooperativeagreementforlANAfunctionswouldbe
a
moreappropriatestructurethanthepresentcontractingapproach.Whileweappreciatethehistoricalrole
of
theUSGovernmentinprovidingoversight
of
theseimportantfunctions,itiscrucialthattheInternetcommunityworktoenhancemulti-stakeholderinternationalmechanismsforthedevelopment
of
thepoliciesusedtoguidetheadministration
of
thesetechnicaltasks.Inparticular,theICANNmodel
(a
privately-led,not-for-profitandcommunity-drivenorganization)appearsmostsuitabletoensureaneffectiveInternetgovernanceschemeaccountabletoallitsmultiplestakeholders(public,private,andcivilsociety).TheInternettechnicalcommunityisquitecapable
of
directlyworkinginpartnershipwithICANN
soas
toprovideoversight
of
thepolicydevelopmentorganizations
as
wellastheprovisionoftherelatedtechnicalfunctions.
2.TheperformanceofthelANAfunctionsoftenreliesuponthepoliciesandproceduresdevelopedbyavarietyofentitieswithintheInternettechnicalcommunitysuchastheIETF,theRIRsand
ccTlO
operators.ShouldthelANAfunctionscontractincludereferencestotheseentities,thepoliciestheydevelopandinstructionsthatthecontractorfollowthepolicies?Pleaseprovidespecificinformationastowhyorwhynot.Ifyes,pleaseprovidelanguageyoubelieveaccuratelycapturestheserelationships.
ThelANAfunctionscontractshouldexplicitlynote,byname,theorganizationsthatareservedbylANA.Forexample,"lANAshouldperformnumberresourcemanagementaccordingtotheglobalpoliciesthatarecollectivelydevelopedbytheRegionalInternetRegistries(AfriNIG,APNIC,ARIN,LAGNIC,RIPENCG)"or"lANAshouldperformtechnicalparametermanagementaccordingtothetechnicalstandardguidanceprovidedbytheIETF"Furthermore,thelANAfunctionscontractshouldrequirethatthefuturecontractoroflANAfunctionsenterintoagreementswiththeselANA-servedorganizationsregardingappropriateservicemanagementinterfaces,includingservicelevelsandescalationprocesses.
