Please complete the above form and submit it, together with your certificate of insurance and registration fee
payable to “Kutztown Community Partnership” as early as possible. Deadline to apply is April 15, 2011. Return this form
with full payment, to: Kutztown Community Partnership, 324 W Main Street, Kutztown PA 19530. No partial payments
permitted. Telephone 484-646-9069. All vendors are required to read and adhere to the rules pertaining to the event, a
copy of which is attached to this registration form. Your payment of the entry fee constitutes your agreement to be
strictly bound by the Festival Vendor Rules which are attached. Any vendor not adhering to the rules will be dismissed
from the event.

Kutztown Arts Bash: Details, Vendor Rules and Agreement
1. Date of Arts Bash—May 14, 2011
2. Location—the event will be held at the Kutztown Area Historical Society, located at Normal and Whiteoak
Streets in Kutztown, PA.
3. Vendor Eligibility—any individual or organization selling food or beverages is eligible to apply. All applications
will be judged by the Kutztown Arts Festival planning committee. Criteria for judging include quality, sale ability
and uniqueness of items. Approximately 10-12 food vendors will be selected.
4. Application Required—please complete the attached application. Return application and fees to “Kutztown
Community Partnership, 324 W. Main Street, Kutztown PA 19530.”
5. Deadline—deadline to apply is April 15, 2011. Vendors will be informed on a rolling basis (first come first serve)
of the committee’s decision to accept or deny.
6. Fees—checks or money orders, made payable to “Kutztown Community Partnership”. The fee is $50 if you do
not need electricity and $60 if you require electricity. For non-profit food vendors, KCP is willing to reduce the
fee based on requests. Please contact Geoff Brace directly. All vending fees are nonrefundable. No application
will be accepted without full payment.
7. Menu—a complete menu listing food and beverages to be sold including cost of items.
a. Prohibited—no alcoholic beverages will be permitted at Arts Bash, either for sale or self-consumption.
Violation of this condition will lead to your immediate dismissal.
8. Set up—set up will begin at 8 AM on May 14, 2011. Vendors with a secured trailer will be permitted to store the
trailer on site starting May 13, 2011. The Kutztown Community Partnership and Kutztown Area Historical
Society bear no responsibility for trailers stored on site before 8 AM on May 14, 2011.
a. Upon arrive, please check in at the Welcome Tent to learn where your assigned space will be.
b. At 10 AM, all vehicles must be removed from the vending areas (KCP will provide directions to a nearby
parking lot on 5/14). Vehicles will not be permitted into the vending areas until 6 PM. All vendors agree
to remain on site until 6 PM. Clean up must be complete by 8 PM.
9. Clean up—all vending materials must be removed from the site no later than 8 PM. You are responsible for
removing all debris.
10. Exclusivity—KCP is unable to guaranty any exclusivity or restrictions on the number of vendors or the type of
products sold. You will be assigned a space based upon the judgment of the planning committee and no
locations are guaranteed. We will certainly do our best to provide you with a convenient and suitable location
for the sale of your products.
11. Conduct—The Arts Bash is a family oriented event. You should refrain from selling any products which would
offend children or which would otherwise not fit the format of this type of function. You are responsible for
controlling your employees, and all vendors must conduct themselves in a courteous and polite manner. Our
image is important to use, and by following these simple procedures, you will be benefited.
12. State Laws—you are responsible for paying all appropriate sales taxes with respect to the sale of goods and for
procuring all require permits and documentation as may be required by local and state government to operate
within the Commonwealth of Pennsylvania.
13. Space—please select from one of the space configurations listed below. Please note that a limited number of 20
amp electrical services are available and will be granted on a first come first serve basis through the application
process (you are responsible for providing your own 50 foot extension cord). Also, please note that water
service will not be available, though a kitchen will be accessible on a limited basis.
a. 10x10 space (you are responsible for providing your own tables, tent and signage)

14. Indemnification, Insurance and Health—all food vendors are required to provide a certificate of insurance listing
“Kutztown Community Partnership” and “Kutztown Area Historical Society” as insured parties for May 14, 2011.
This certificate of insurance is required as part of your registration form. Applications will not be approved
without a certificate of insurance. Vendors are responsible for adherence to Commonwealth of PA food safety
regulations.
15. Release of liability—the Vendor, for herself/himself and successors, assigns, heirs, estate, employees, and all
other persons, known or unknown, being fully aware that participation will expose her/him to a risk of property,
damage, bodily injury, personal injury and/or death, hereby releases, waives, discharges and covenants not to
sue Kutztown Community Partnership/Northeast Berks Main Street Foundation or Kutztown Area Historical
Society, their officers, directors, trustees, employees, agents, representatives, volunteers and servants, and all
other persons and associates connected with the event entitled “Kutztown Arts Bash,” and any other sponsors,
individuals, or corporations associated with “Kutztown Arts Bash” whether known or unknown (HEREIN AFTER
COLLECTIVELY “SPONSORS”), from any and all liability, including for activity or passive negligence, for any and all
property damage, personal injuries, bodily injury, death and/or other claims or causes of action arising out of or
relating to your organization’s participation in the “Kutztown Arts Bash” including those claims which are known
and unknown, foreseen and unforeseen, future or contingence.
16. Covenant not to sue: The Vendor/Vendor Representative, for herself/himself and successors, assigns, heirs,
estate, employees, and all other persons known or unknown, covenants not to directly or indirectly commence
or prosecute any action, suit, claim or other proceeding against the Sponsors arising out of or related to
Kutztown Arts Bash. A general release does not extend to claims which the creditor does not know or suspect to
exist in his favor at the time of executing this release, which if known by hum must have materially affected his
settlement with the debtor.
17. Indemnity Agreement: Vendor/Vendor Representative shall not indemnify and hold harmless the Sponsors
against any and all claims, demands, causes of action, personal injuries, death, damage, costs and liabilities, in
equity, of every kind and nature, whatsoever, directly or proximately resulting or caused by the act of omission
of the Vendor/Vendor Representative, or any of its officers, agents, employees, guests, patrons, or invitees, and
the Vendor/Vendor Representative shall, at its sole risk and expense, defend any and all suits, actions or other
legal binding proceedings which may be brought or instituted against any Sponsor or any such claim, demand or
cause of action and the Vendor/Vendor Representative shall pay and satisfy any judgment or decree which may
be rendered against any Sponsor in any suit, action or other legal proceedings, and the Vendor/Vendor
Representative shall pay for any and all damaged or loss to the property of any Sponsor due to other legal
proceedings, and the Vendor/Vendor Representative shall pay for any and all damaged or loss to the property of
any Sponsor due to such loss or theft of such property, done or caused by the Vendor/Vendor Representative,
its officers, employees, guests, patrons and invitees.
