Louis Dear Judge Price: I wish to file a formal complaint against Judge David c. Mason for failure to perform his official duties Judge Mason constantly sleeps thru the majority, if not all of, the trials in his court. I witnessed this on two occasions when my son was on trial. The Judge slept thru all of the arguments and did not hear any of the evidence presented. Nor did he hear testimony from any of the witnesses called I was shocked to see a judge sleep during a trial. I spoke to a woman familiar with Judge Mason sleeping. She said Judge Mason has slept in court for years and that he has a sleeping disorder. Many people have complained about this, to no avail Yo substantiate my complaint, all one has to do is interview the many persons familiar with Judge Mason asleep at the bench. Ask the courtroom personnel. Ask the bailiff. Ask the prosecutors. Ask the defense attorneys. Ask jurors or witnesses. All will tell you about Judge Mason continuously and constantly sleeping during trials. How can justice be served to any defendant when the trial judge sleeps? april 4, 2011 William Ray Price, Jr., Esq. Page 2 If this was a rare occurrence I wouldn’t complain. But since there is a long and continuing pattern of behavior of Judge Mason sleeping during trials, someone needs to intervene and insure Judge Mason stays awake during trial. If not, he should be removed from the bench on September 1, 2010 The Bar Association of Greater st. Louis recommended the exit of Judge David C. Mason whose composite score only totaled 3.07 and was the lowest score among any of the judges in the 22" Judicial Circuit of st. Louis If Judge Mason truly suffers from a sleep disorder and cannot perform his duties, he should apply for medical disability and retire Is Justice Blind or is Justice Asleep?
