foreclosuredocketoperatesaccordingtoasetofalternativerulesandproceduresimplementedbytheTwentiethCircuitasdefactopolicy.Theclearlyestablishedpracticeofthemassforeclosuredocketistoforcecasesintoasuigenerissystemofrecurringhearingsthatrushescasestowardsummaryjudgmentortrialwithoutgivinghomeownersameaningfulopportunitytodeveloptheircasesorpresentdefenses.Widespreadexpartecommunicationsbetweenthecourtandplaintiffs,aswellasanexpresspolicyofcategoricallytreatingforeclosurecasesdifferentlythan"individualcases,"furtherdenyhomeownersanymeaningfulopportunitytodefendtheirhomesagainstforeclosure.Theproceduraldeficienciesonthemassforeclosuredocketaresystemic;theygobeyondtheoccasionalerrorsubjecttoordinaryappellatereview.Incombination,theycreateaforumthatisinconsistentwiththerequirementsofdueprocessundertheFloridaandU.S.Constitutions.PetitionerdoesnotaskthisCourttoaddressthemeritsofherforeclosurecase.Rather,sheseeksonlytheguaranteethathercasewillbeadjudicatedinaforumthataffordsherdueprocess.WithoutrelieffromthisCourt,Ms.Merriganwillbesubjecttoanovelandunauthorizedsetofjudicialproceduresthatwillsystematicallyundercutherabilitytoseekdiscovery,refutefactsprofferedagainsther,andpressherlegalarguments.Accordingly,sherespectfullyrequestsawritfromthisCourtremovinghercasefromthemassforeclosuredocket.
