Officer Todd Tranter, being duly swom, floes depose and state that he is a member of State Sapitol Police Department and has been a member of said department since 07/18/2006. At all times Mentioned herein he was acting as a member of said department, The following facts and circumstances are stated from personal knowledge and observations as well as information received from other police officers acting in their official capacity and from official police reports and statements made by prudent and credible witnesses. THAT on 03/28/2011 State Representative Linda M.Gentile and her aid Alison Blancato reported to the State Capitol Police that they had received threatening voicemails from a constituent of Gentiles. The hffiant, was assigned to investigate the case. THAT the man leaving the messages identifies himself as John Matika and includes his contact information, phone number 203-735-2059. In his messages Matika talks about his opinions on SB1004, a I that would limit the number of rounds which could be carried in a gun magazine in Connecticut. Matika is concerned about the bill and how Rep. Gentile is planning on voting on it. 'T a'check of motor vehicles files showed a John Matika, D.O.B 01/01/1944 residing at 40 Edgehill Rd, 'sonia, Ct. A reverse telephone directory check revealed that telephone number 203-735-2059 was igned to a John Matika of the same address. A check of the Connecticut Department of Public Safety rearms and Permit investigation System shows that John H. Matika of 40 Edgehill Road, Ansonia nnecticut has 11 registered guns, including rifles and handguns. There is no criminal history on file for hn Matika. \T on 03/24/2011 at 1339 hours, Matika leaves his first message telling Rep. Gentile about the prior ban assault rifles in Connecticut and how he was stupid to have registered his assault rifle. Matika makes jany references to why he feels this new bill "better not" pass. Matika then states." If you pass another gun like this... it better get rejected... or else." Matika then says " give me a call let me know how your gonna te on this... because I've got other options... and baby, you don't wanna know about them". IAT on 03/25/2011 at 1326 hours, Matika leaves a similar message for Rep. Gentile, again expressing his rong opposition to SB1094. In this message Matika states again that if this bill passes " there's gonna be a {tof trouble in this state". He also says in a heated and urgent tone that " I want her to vote against this bill 94... they already pulled one mistaké on our gun owners in this state... if this bill passes you better duck pur heads." Matika also says " I'm not even gonna say the state... Southwest, you know what happened it there? Its gonna happen here." Then atthe end of Matika's message he says " This bill better not pass... else... they better duck their heads. All | gotta say is one thing... woman out in Arizona." This is an obvious ference to the mass shooting that occurred in Arizona on 01/08/2011, where United States Representative labrielle Giffords was shot and critically injured, along with nineteen others and resulting in six deaths. The male identified himself as John Matika. > admitted that he had left the messages for Representative Gentile. When asked what he intended by ome of the quotes from his messages, Matika said that it was not directed to her personally and that he ljould have worded it differently. Matika went on to explain his stance on the gun bill at length. When asked nether he had any inténtion of harming anyone Matika said he only had guns to protect himself and that he {d not intend to shoot anyone except to protect himself. Matika stated that he had guns in his home at 40 Agehill Road in Ansonia. He said that he had millitary rifles and hand guns. ‘Matika further stated that he »eps his guns locked in a safe, except for one handgun that he keeps in his recliner in his living room here he usually sits. Matika stated that he lives in the house alone. AT the affiant investigated a prior case(10-900) involving John H. Matika. On 07/28/2010, Matika called lison Blancato expressing concer over the direction of the Petit murder trial, particularly over whether the ath penalty would be applied in that case. According to Blancato, Matika wanted to know how Rep. fantile had voted on the Death Penalty Bill that was voted on during that years legislative session. Blancato lated that during their conversation Matika said that if he was ever attacked in his house he has guns and lould be able to defend himself, and that he'd probably be invaded by Ansonia Police for doing so. scording to Blancato, Matika then stated that if he was invaded by police he would be able to respond with ‘mor piercing bullets, which he claims to have purchased through the intemet. That information was passed ) to Ansonia Police Department. /HEREFORE, the affiant believes that there is probable cause to effect the arrest of John H. Matika, for olation of section 53a-183, Harassment in Second Degree, in accordance with the General Statutes of The tate of Connecticut.
