LoudounWaterrequiresaccesstothesubjectpropertytoconductsuchtestsourclientiswillingtograntsuchaccessconsistentwiththefollowingcustomaryrequirementsforarightofentry:•TherightofentryshouldrequireLoudounWatertoindemnify,defendandholdtheownerofthesubjectpropertyharmlessfromanyriskoflossarisingoutofexerciseoftheentry.Inparticular,therightofentryshouldstatetheownerofthesubjectpropertywillbeheldharmlessfromanyliabilitythatmayresultfromexerciseoftheentry.•LoudounWatershouldnamethesubjectpropertyownerasaninsuredunderanacceptableVirginiapolicyofliabilityinsuranceinanamountsufficienttocoverthelosspotentialthatmayarisefromexerciseoftherightofentry.•Therightofentryuponthesubjectpropertyshallbelimitedtonon-vehicularaccesstothewater-fallareaandwaterimpoundmentareaonthesubjectpropertyandnootherportionsofthesubjectproperty,withtheexceptionofthemostdirectpedestrianaccessfromthepublicrightofwaytothedyetestingarea.
