Terrorism, organized crime and other transnational crimes posefundamental challenges to the rule of law, peace and security and must be foughtat the national, regional and international level.Since such crimes transcend “classical” borders of criminal law and in orderfor States to effectively address the challenges posed by such crimes, they need acoordinated and coherent response through, among others, internationalcooperation in criminal matters, including extradition and mutual legalassistance.This Compendium has been elaborated by the United Nations Office onDrugs and Crime (UNODC) Regional Office for Eastern Africa and theTerrorism Prevention Branch of UNODC, in cooperation with the Office of theDirector of Public Prosecutions of the Republic of Kenya to strengtheninternational cooperation between Kenya and other countries. It aims atproviding Kenyan practitioners and other actors involved in internationalcooperation in criminal matters with a practical tool to assist them in cooperatingwith other countries. It contains bilateral, regional and international agreementsthat are likely to serve as bases for extradition and mutual legal assistance incriminal matters applicable to the Republic of Kenya.This technical assistance tool is part of a two year Cooperation Planbetween UNODC and the Office of the Attorney General, which entails capacitybuilding activities to enhance the skills of Kenyan criminal justice officials toeffectively deal with terrorism offences; and to strengthen judicial cooperationbetween Kenya and other countries through regional and sub-regionalspecialized thematic training workshops.The elaboration and dissemination of this Compendium is aimed atfacilitating the implementation of the universal instruments against terrorism,the United Nations Convention against Transnational Organized Crime

, and theUnited Nations Global Counter-Terrorism Strategy adopted on 8 September2006 by the United Nations General Assembly, in which States including theRepublic of Kenya, resolved to “cooperate fully in the fight against terrorism[…] in order to find, deny safe haven and bring to justice, on the basis of theprinciple of extradite or prosecute, any person who supports, facilitates,participates or attempts to participate in the financing, planning, preparation orperpetration of terrorist acts or provides safe havens” and “to conclude and
