 Be it enacted by the Senate and House of Representa-

SECTION 1. SHORT TITLE.

This Act may be cited as the ‘‘License Plate Political
4
Slush Fund Prevention Act of 2011’’.

SEC. 2. LICENSE PLATE SALES AND POLITICAL ACTIVITY.

ENERAL
.—Chapter 1 of title 23, United
2
States Code, is amended by adding at the end the fol-
3
lowing:

ITHHOLDING OF

COMPLIANCE
.—The Secretary shall withhold 15 percent of 
7
the amount required to be apportioned to any State under
8
each of paragraphs (1), (3), and (4) of section 104(b) on
9
October 1 of the first fiscal year beginning after the date
10
of enactment of this Act, and on October 1 of each fiscal
11
 year thereafter, if the State does not meet the requirement
12
of subsection (b) on that date.

‘‘(b) R
EQUIREMENT
.—A State meets the requirement
14
of this subsection if the chief executive of the State cer-
15
tifies to the Secretary that the State, as of the date of 
16
the certification, does not provide to an organization that
17
engages in covered political activity any proceeds resulting
18
from the sale of a license plate in that State.

‘‘(c) E
FFECT OF
N
ONCOMPLIANCE
.—Funds withheld
20
from a State under subsection (a) shall lapse and shall
21
 be deposited in the Treasury and used for deficit reduction
22
(or, if there is no Federal budget deficit, for reducing the
23
Federal debt, in such manner as the Secretary of the
24
Treasury considers appropriate).
