This Notice of Noncompliance is issued to you because of the non permitted earth deposit and/or
removal and/or processing operation in a Rural (RU-2) District at the above address. This
activity constitutes a violation of the following Section(s) of the Zoning Regulations of the Town
ef Madison: 2.1, 5.1, 5.2, 9, and Book IIL
Therefore, you ase hereby ordered to CEASE AND DESIST from the preceding violation, and
you must do so immediately on the receipt of this order, per Connecticut General Statutes
Section 8-12. Additionally, the site must be stabilized and remediated in accordance with
Sections 9.3.2 and 9.3.3 and Book III of the Regulations. Stabilization and remediation shall be
completed by June 15, 2011.
Failure to comply with this CEASE AND DESIST ORDER may result in the Town of Madison
taking additional action against you in order to bring your property into compliance, which may
result in the levy of fines in the amount of $150.00 per day per violation, and/or injunctive
orders of the Superior Court, attorney’s fees, and/or civil penalties authorized by the Connecticut
General Statutes and/or formal complaint to the Housing Division of the Office of the State’s
Attomey for criminal prosecution,
If you feel that I have issued this order in error, you have the right to appeal it to the Zoning
Board of Appeals within thirty (30) days of receipt of this order. Failure to appeal will constitute
a waiver of any defenses which were capable of being heard and decided by the Board.
