In this order Rajasthan High Court directed Jaipur Municipal Corporation to clean the city in six months. The High Court disagreed the argument of the Corporation that it did not have funds and staff to do the cleaning. The High Court ruled that it is the function of the corporation and no excuse can be accepted for not performing the duties.

isahappysignthatthecitizensofJaipur,throughthepresentpetitionerMr.

K.KoolwalhasmovedtothisCourtinthematterofsanitationofJaipurCity.GoodnumberofaffidavitshavebeenfiledbythecitizensofJaipurrelatingtoeachofthelocalityreferredtointhewritpetitiontoshowthatthesanitationproblemisacuteinJaipurwhichishazardoustothelifeofthecitizensofJaipur.Insanitationleadstoaslowpoisoningandadverselyaffectsthelifeofthecitizenandinvitesthedeathatanearlierdatethanthenaturaldeath.2.Article51AoftheConstitutionhasbeeninsertedintheConstitutionofIndiavide42ndAmendmentin1976.WecancallArticle51Aordinarilyasthedutyofthecitizens,butinfactitistherightofthecitizensasitcreatestherightinfavourofthecitizentomovetotheCourttoseethattheStateperformsitsdutiesfaithfullyandtheobligatoryandprimarydutiesareperformedinaccordancewiththelawofland.OmissionsorcommissionsarebroughttothenoticeoftheCourtbythecitizenandthus,Article51AgivesarighttothecitizentomovetheCourtfortheenforcementofthedutycastonState,instrumentalities,agencies,departments,localbodiesandstatutoryauthoritiescreatedundertheparticularlawoftheState.

providesparticularlyunderClause(g)thattheStateanditsinstrumentalitiesandagenciesshouldstrivetoprotectandprovethenaturalenvironment.UnderClause

andachievement.Parliamentinitswisdomhascorrectlyusedthewordcitizeninsteadofthewordsubjecttocreateafeelingofcitizenshipamongstthemassesandalsotoseethatthepersonslivinginthecountrydonotfeelthattheyaresubjects.Wewereusedtobethesubjectspriortoindependence,butnowwehaveceasedtobethesubjectandnowwearethecitizensoftheCountry.TherequirementofthetimeisthatweshouldberealcitizensoftheCountry.ThatcanonlybeachievedifwestrivetowardstheachievementofthegoallaiddowninthePreambleoftheConstitution.ChapterIVdirectstheprinciplesoftheConstitutionandArticleSlAofChapterIVA.Priorto1976everyoneusedtotalkoftherightsbutnonecaredtothinkthatthereisadutyalso.TherightcannotexistwithoutadutyanditisthedutyofthecitizentoseethattherightswhichhehasacquiredundertheConstitutionasacitizenarefulfilled.3.CitizenhasarighttoknowabouttheactivitiesoftheState,theinstrumentalities,thedepartmentsandtheagenciesoftheState.TheprivilegeofsecrecywhichexistedintheoldtimesthattheStateisnotboundtodisclosethefactstothecitizensortheStatecannotbecompelledbythecitizenstodisclosethefacts,doesnotsurvivenowtoagreatextent.UnderArticle19(a)oftheConstitutionthereexiststherightoffreedomofspeech.Freedomofspeechisbasedonthefoundationofthefreedomofrighttoknow.TheStatecanimposeandshouldimposethereasonablerestrictionsinthematterlikeotherfundamentalrightswhereitaffectsthenationalsecurityandanyotheralliedmatteraffectingthenation'sintegrity.ButthisrightislimitedandparticularlyinthematterofsanitationandotheralliedmattereverycitizenhasarighttoknowhowtheStateisfunctioningandwhytheStateiswithholdingsuchinformationinsuchmatters.Mr.KoolwalhasapproachedthisCourtinexerciseofrightsvestedinhimunderArticleSlA,thoughitis
