21Itismyduty,asaninventorofasignificantnumberofthepatentsthatarepartoftoday's2discussions,tomakeknowntopotentialpurchasers,thepatentofficesandinterestedparties3thattherearesomeimportantirregularitiesthataffectthemerchantabilityofthesepatents.4QuiteproperlyasIamtheirinventor,thesepatentshavemynameonthem.Noneoftheother5partiestotoday'sdiscussionhavethatimportantdistinction.Asatrueinventorofthepatents,6thepatentswouldbeinvalidwithoutmynamebeingincluded.Inventorsdohavecontinuing7responsibilitiestowardstheirinventions.Oneoftheseistogiveconsentforanylitigationthat8mayariseconcerningtheinvention,forexample,asuitforinfringement.Alloftheinventorsofa9patentmustagreetosuchlitigationbeforeitcanproceed".Interestedpartieswillrecognisethat10litigationmaybeblockedifevenasingleinventorindicatesthattheydonotconsent.

example,clearlyindicatesthattherightsofformeremployees,includingtheinventors,arenot15respected.Furthermore,additionalclauses"instructgovernmentofficialstostrikeallofthese16encumbrancesfromtheirrecordsanddatabases.Whilevictorsoftenpresumetheywillrewrite17historytotheiradvantage,suchStalinesquemisdirectionseemsinappropriateinthiscase.18Quiteapartfromanytidyingofdatabases,thepurchaser,otherpotentialbiddersandother19interestedpartieswillrecognisethattherecordofthiscourtanditsmotionswillremainwithits20directionthattheinventor'sassignmentcontractswereunilaterallyterminated.21Theinventors,bybeingunilaterallyorderedoutoftheircontracts,havenoobligationtoNortelor22toanysuccessfulpurchaser.Theinventorsmay,iftheyaremadeawareofanypotentialsuitfor23infringementwithrespecttotheirinventions,andiftheychose,indicatetoanycourtthattheydo24notconsenttosuchaction.Inmostcasessuchanindicationoflackofconsentwouldblockany25legalproceedingsforanallegedinfringement.Evenifasuitforinfringementweretoproceed,26theinventorsmay,iftheychoose,assistthedefenceofthosewhoareallegedtobeinfringing.27Thosefamiliarwithsuchproceedingswillrecognisethattheinventor'stechnicalknowledgeand28theirknowledgeofthepatent'sprosecutiondevelopmentwillrendersuchaninfringementsuit29veryunlikelytobesuccessful.Thecurrentwordingofthemotionwhichexcludesthepossibility30ofagreementfromtheinventorswillinfluenceinterestedpurchasersastothepracticalutilityof
