AFFIDAVIT OF SCRIVENER'S ERROR

STATE OF MICHIGAN COUNTY OF OAKLAND

Marshall R. Isaacs, being duly sworn, deposes and states as follows:

1. I am an attorney for BAC Home Loans Servicing, L.P., whose address is 400 Countrywide Way, Simi Valley, CA 90365.

2. This Affidavit is recorded to correct a scrivener's error in a certain Mortgage as identified below.

3. This affidavit relates to real property situated in the State of Michigan, County of Leelanau, of Suttons Bay, described as follows:

Lots 356,357 and 358, Block 15, of Village of Suttons Bay, as recorded in Liber 1 of miscellaneous Records, page 436, Leelanau County Records.

TAXID:

Commonly known as: 113 East Race Street

(hereinafter the "Property").

4. On March 30,2002, a mortgage in the principal amount of $76,000 was executed by Lisa Psenka, in favor of Mortgage Electronic Registration Systems, Inc., (hereinafter the "Mortgagee") whose address is P.O. Box 2026, Flint, MI 48501, which was duly recorded on, in Liber 649, Page 638, Leelanau County Records.

5. Said mortgage was last assigned to BAC Home Loans Servicing, LP FKA Countrywide Home Loans Servicing LP by assignment submitted to and recorded by the Leelanau County Register of Deeds.

6. That BAC Home Loans Servicing, L.P. is the authorized mortgage servicer for the above referenced mortgage loan.

7. That as a result of a scrivener's error, the legal description of the Property set forth in the Mortgage referred to the Property as follows:

Lots 356, 257, 358, Block 15, Village of Suttons Bay, according to the plat thereof as recorded in Liber 1 of Miscellaneous Records, Page 436.

(hereinafter "Incorrect Legal Description").

8. The legal description in the Mortgage should have read:
