I.
INTRODUCTION1.ThiscasearisesoutoftheflagrantandoutrageousactionstakenbyTheSidwellFriendsSchoolwhichalloweditsstaffpsychologisttohaveanopensexualrelationshipwiththemarriedmotherofathenfive-year-oldSidwellstudenthewastreating.Despiterepeatedobjectionsfromthehusband(whoisthechild'sfather)andfromfamilymembersandparentsofotherstudents,Sidwellofficialsmaliciouslypermittedthedamagingconducttocontinuefornearlyayear,therebydeprivingthestudentofeducationalbenefitsandcausingsevereemotionaldistresstoherand,asaconsequence,toherfather.Plaintiffsseektorecover$10millionincompensatory,punitiveandspecialdamagesfortheinjuriessufferedasaresultofDefendants'tortiousconduct.
 
II.JURISDICTION2.ThisCourthasjurisdictionoverthisactionpursuanttoD.C.Code§11-921.III.THEPARTIES3.PlaintiffL.N.isaminorchildandatalltimespertinentheretowasastudentenrolledatTheSidwellFriendsSchool("Sidwell"or"School").4.PlaintiffArthurG.Newmyer,alsoknownas"Terry,"isthefatherofL.N.5.DefendantSidwellisacorporationorganizedunderthelawsoftheDistrictofColumbiawithitsprincipalplaceofbusinessinWashington,D.C.Sidwellclaimsthatitsfacultymembers"arethestewardsofthehighstandardsandsoundvaluesthathavecharacterizedtheschoolsince[1883

andpromisesto"cultivateinallmembersofourcommunityhighpersonalexpectationsandintegrity."SidwellhaslongbeendescribedbysomeastheHarvardofWashington'sprivateschools,andhasbeennicknamedthe"presidentialprepschool"becauseofthemanychildrenintheWhiteHousewhohaveattendedtheschool,includingthechildrenofPresidentsRoosevelt,Nixon,ClintonandObama.6.DefendantJamesF.Huntington,Psy.D.("Huntington"),alsoknownas"Jack,"isaresidentoftheStateofMarylandandisapsychologistlicensedinD.C.andMaryland.HewaspreviouslyemployedastheschoolpsychologistatSidwellandprovidedpsychologicalandcounselingservicestoSidwellstudentsandtheirfamilies.IV.FACTUALALLEGATIONS7.PlaintiffTerryNewmyerandhiswife,TaraNewmyer,havetwoyoungchildren.Theolderone,PlaintiffL.N.,iscurrentlyinkindergartenatSidwell.Priortothe2009-2010schoolyear,TerryandTara,whowerelivinginFlorida,didnotagreeonwhereL.N.shouldattendpre-kindergarten.TerrywantedthefamilytostayinFloridabutTarawantedtomove2
 
backtotheWashington,D.C.areaandenrollL.N.atSidwell.Asaresult,TerryandTaraenteredintoapostnuptialagreementwhichsetforththeconditionsunderwhichtheywouldstaytogetherandhaveacommutermarriage,orseparate.ThecoupledecidedtostaytogetherandthereaftertraveledextensivelybetweenFloridaandtheWashingtonareawiththeirchildren.WhentheywereintheWashingtonarea,theylivedinarentedhouseinChevyChase.InFlorida,theylivedinthefamilyhomeinPalmBeachGardens.Inbothlocations,TerryandTaralivedandslepttogetherasmanandwife.8.AlthoughTerryhadattendedSidwellandwasthefirstmemberofhisfamilytowintheprestigiousNewmyerAwardforservicetotheSchool,hedidnotbelievethatSidwellwasthebestplaceforL.N.Asaresult,hetoldTara,whoisanattorney,thatshewouldhavetopayforL.N.toattendSidwell.HealsodidnotsignL.N.'5applicationorenrollmentcontractforSidwell,andheadvisedtheheadofadmissionsthathedidnotthinkL.N.'senrollmentattheschoolwasinherbestinterest.9.TaraneverthelessproceededwithherplanandL.N.startedinthepre-kindergartenclassatSidwellintheFallof2009.10.Inthemiddleofthe2009-2010schoolyear,Sidwellfiredoneofitsmiddleschoolteachers,RobertA."Pete"Peterson,overallegationsthathehadsexuallyabusedaminor.11.OnJanuary20,2010,inthewakeofthePetersonincident,SidwellsentanemailtoallparentsinformingthemthatpsychologicalassistancewasavailabletotheentireSidwellcommunity.Intheemail,Huntingtonwasidentifiedassomeoneparentscouldtalktoaboutreceivingcounselingservices,instructionandguidancefortheirchildren.TaraknewHuntingtonbecausehehadadaughterinL.N.'sPre-Kclass.3
