I.INTRODUCTIONA.Purpose
The County of San Bernardino, hereafter referred to as the “County,” is seekingproposals from interested and qualified firms to provide Fair Housing andTenant/Landlord Mediation Services. The County’s service area (Service Area)includes the unincorporated areas of San Bernardino County and thecooperating cities of Adelanto, Barstow, Big Bear Lake, Colton, Grand Terrace,Highland, Loma Linda, Montclair, Needles, Twentynine Palms, Yucaipa and theTown of Yucca Valley. This Request for Proposals (RFP) is being released toidentify, pre-qualify, and establish Contracts with an experienced individual(s) or organization(s) to provide 1) Fair Housing Services and/or 2) Tenant/LandlordMediation Services within the County’s Service Area.The requirements for each of these services are described in subsequentsections. Applicants may submit proposals for any or all Services. Applicantssubmitting proposals for more than one (1) service must submit separate pricesand qualifications for each type of service.
B.
Program Background
The United States Department of Housing and Urban Development (HUD) iscommitted to eliminating racial and ethnic segregation and other discriminatorypractices in housing. The goal of HUD’s fair housing policy is to make
housing choice
a reality for all persons.Fair housing is a long-standing component of HUD’s Community Planning andDevelopment (CPD) programs. These programs include:Community Development Block Grant (CDBG)HOME Investment Partnership (HOME)Emergency Solutions Grant (ESG)Housing Opportunities for Persons with AIDS (HOPWA)HUD program regulations require CPD grantees to certify that they willaffirmatively further fair housing as part of the obligations assumed when HUDprogram funds are accepted. The CDBG program contains regulatoryrequirements to affirmatively further fair housing based upon HUD’s obligationunder Section 808 of the Fair Housing Act.HUD also requires CPD grantees to document actions that affirmatively further fair housing in annual performance reports that are submitted to HUD. Eventhough a grantee’s fair housing obligation arises in connection with the receiptof Federal funds, the fair housing obligation extends to all housing and/or housing-related activities within the grantee’s jurisdiction, whether publicly or privately funded.

C.Definition of Affirmatively Furthering Fair Housing
Title VIII of the Civil Rights Act of 1968 (Fair Housing Act) formally establishedpolicies to provide for fair housing and prohibit discrimination in the sale, rental,and financing of housing, or in any way making unavailable or denying adwelling to any person based on race, color, religion, sex, or national origin.The Fair Housing Amendments Act of 1988, expands the coverage of Title VIIIto prohibit discriminatory practices based on handicap (disability), age, or familial status [including children under the age of eighteen (18) living withparents or legal custodians, pregnant women, and people securing custody of children under the age of eighteen (18)]; provides administrative enforcementprocedures for discrimination cases that cannot be resolved informally; providesfor monetary penalties in cases where housing discrimination is found, andcreated design and construction requirements to allow for handicappedaccessibility for certain new multifamily dwellings occupied after March 31,1991.HUD’s Fair Housing Planning Guide provides this interpretation:

Update (as needed) an Analysis of Impediments to Fair Housing ChoiceStudy (AI) within the jurisdiction.
2.
Take actions to overcome the effects of any impediments to fair housingchoice.3.Promote fair housing choice for all persons.
4.
Provide opportunities for racially and ethnically inclusive patterns of housing occupancy.5.Promote housing that is physically accessible to and usable by, allpersons, and particularly persons with disabilities.6.Foster compliance with the nondiscrimination provisions of the Fair Housing Act.The County’s Fair Housing and Tenant/Landlord Mediation Program will be operatedand administered in a manner consistent with this definition.
II.PROPOSAL REQUIREMENTSA.Period of Contract
The term of the Contract(s) for Fair Housing Services and Tenant/LandlordMediation Services shall be for three (3) years, beginning July 1, 2011, andending June 30, 2014, unless terminated earlier as provided in this section.1.The County reserves the right to negotiate an extension of the Contractperiod, in one (1) year increments, for two (2) additional years, solelywithin its discretion.
