Page3Nuisance,Waste.Grantorshallnotcause,conductorpermitanynuisancenorcommit,permit,orsufferanystrippingoforwasteonortothePropertyoranyportionoftheProperty.Withoutlimitingthegeneralityoftheforegoing,Grantorwillnotremove,orgranttoanyotherpartytherighttoremove,anytimber,minerals(includingoilandgas),coal,clay,scoria,soil,gravelorrockproductswithoutLender'spriorwrittenconsent.RemovalofImprovements.GrantorshallnotdemolishorremoveanyImprovementsfromtheRealPropertywithoutLender'spriorwrittenconsent.AsaconditiontotheremovalofanyImprovements,LendermayrequireGrantortomakearrangementssatisfactorytoLendertoreplacesuchImprovementswithImprovementsofatleastequalvalue.lender'sRighttoEnter.LenderandLender'sagentsandrepresentativesmayenterupontheRealPropertyatallreasonabletimestoattendtolender'sinterestsandtoinspecttheRealPropertyforpurposesofGrantor'scompliancewiththetermsandconditionsofthisMortgage.CompliancewithGovernmentalRequirements.Grantorshallpromptlycomplywithalllaws,ordinances,andregulations,noworhereafterineffect,ofallgovernmentalauthoritiesapplicabletotheuseoroccupancyoftheProperty,includingwithoutlimitation,theAmericansWithDisabilitiesAct.Grantormaycontestingoodfaithanysuchlaw,ordinance,orregulationandwithholdcomplianceduringanyproceeding,includingappropriateappeals,solongasGrantorhasnotifiedLenderinwritingpriortodoingsoandsolongas,inLender'ssaleopinion,Lender'sinterestsinthePropertyarenotjeopardized.LendermayrequireGrantortopostadequatesecurityorasuretybond,reasonablysatisfactorytoLender,toprotectLender'sinterest.DutytoProtect.GrantoragreesneithertoabandonorleaveunattendedtheProperty.Grantorshalldoallotheracts,inadditiontothoseactssetforthaboveinthissection,whichfromthecharacteranduseofthePropertyarereasonablynecessarytoprotectandpreservetheProperty.DUEONSALE·CONSENTBYLENDER.Lendermay,atLender'Soption,declareimmediatelydueandpayableallsumssecuredbythisMortgageuponthesaleortransfer,withoutLender'spriorwrittenconsent,ofalloranypartoftheRealProperty,oranyinterestintheRealProperty.A"saleortransfer"meanstheconveyanceofRealPropertyoranyright,titleorinterestintheRealProperty;whetherlegal,beneficialorequitable;whethervoluntaryorinvoluntary;whetherbyoutrightsale,deed,installmentsalecontract,landcontract,contractfordeed,leaseholdinterestwithatermgreaterthanthree(3)years,lease-optioncontract,orbysale,assignment,ortransferofanybeneficialinterestinortoanylandtrustholdingtitletotheRealProperty,orbyanyothermethodofconveyanceofaninterestintheRealProperty.IfanyGrantorisacorporation,partnershiporlimitedliabilitycompany,transferalsoincludesanychangeinownershipofmorethantwenty-fivepercent(25%)ofthevotingstock,partnershipinterestsorlimitedliabilitycompanyinterests,asthecasemaybe,ofsuchGrantor.However,thisoptionshallnotbeexercisedbyLenderifsuchexerciseisprohibitedbyfederallaworbyIllinoislaw.TAXESANDLIENS.ThefollowingprovisionsrelatingtothetaxesandliensonthePropertyarepartofthisMortgage:Payment.Grantorshallpaywhendue(andinalleventspriortodelinquency)alltaxes,payrolltaxes,specialtaxes,assessments,waterchargesandsewerservicechargesleviedagainstoronaccountoftheProperty,andshallpaywhendueallclaimsforworkdoneonorforservicesrenderedormaterialfurnishedtotheProperty.GrantorshallmaintainthePropertyfreeofanylienshavingpriorityoverorequaltotheinterestofLenderunderthisMortgage,exceptforthoseliensspecificallyagreedtoinwritingbyLender,andexceptforthelienoftaxesandassessmentsnotdueasfurtherspecifiedintheRighttoContestparagraph.RighttoContest.Grantormaywithholdpaymentofanytax,assessment,orclaiminconnectionwithagoodfaithdisputeovertheobligationtopay,solongasLender'sinterestinthePropertyisnotjeopardized.Ifalienarisesorisfiledasaresultofnonpayment,Grantorshallwithinfifteen(15)daysafterthelienarisesor,ifalienisfiled,withinfifteen(15)daysafterGrantorhasnoticeofthefiling,securethedischargeofthelien,orifrequestedbyLender,depositwithLendercashorasufficientcorporatesuretybondor
