RECOMMENDATION:DISBARMENT
1.Respondenthastakenandsubscribedtheoathofadmission,wasadmittedtothebarofthiscourtonApril22,1999,andisregisteredasanattorneyupontheofficialrecordsofthiscourt,registrationno.30518.RespondentissubjecttothejurisdictionofthiscourtandthePresidingDisciplinaryJudgeintheseproceedings.

2.Respondententersintothisstipulationfreelyandvoluntarily.Nopromiseshavebeenmadeconcerningfutureconsideration,punishment,orlenienceintheabove-referencedmatter.
It
isRespondent'spersonaldecision,andRespondentaffirmstherehasbeennocoercionorotherintimidatingactsbyanypersonoragencyconcerningthismatter.3.ThismatterhasbecomepublicundertheoperationofC.R.C.P.251.31(c)asamended.However,Respondentspecificallyacknowledgesthat,ifthePresidingDisciplinaryJudgeshoulddecidetoacceptthisstipulation,andimposetheagreed-todisciplinecontainedherein,thenthisstipulationandthedisciplineimposedwillbemattersofpublicrecord.4.RespondentisfamiliarwiththerulesoftheColoradoSupremeCourtregardingtheprocedurefordisciplineofattorneysandwiththerightsprovidedbythoserules.Respondentacknowledgestherighttoafullandcompleteevidentiaryhearingontheabove-referencedcomplaint.Atanysuchhearing,Respondentwouldhavetherighttoberepresentedbycounsel,presentevidence,callwitnesses,andcross-examinethewitnessespresentedbythecomplainant.Atanysuchformalhearing,thecomplainantwouldhavetheburdenofproofandwouldberequiredtoprovethechargescontainedinthecomplaintwithclearandconvincingevidence.Nonetheless,havingfullknowledgeoftherighttosuchaformalhearing,Respondentwaivesthatright.5.RespondentandthecomplainantspecificallywaivetherighttoahearingpursuanttoC.R.C.P.251.22(c)(1).6.RespondenthasreadandstudiedthecomplaintfiledinlOPDJ129,andisfamiliarwiththeallegationstherein.Atrueandcorrectcopyofthecomplaintisattachedtothisstipulationas
