Fairhope,Alabama.2.ThePlaintiff,DorseyHenderson,wenttoinvestigatetheautomobileaccident.ThePlaintiff,Dorsey
Henderson,
thenwent
intohis
house
to
call
the911
dispatchlineandinform
the
FairhopePoliceDepartmentthattherehadbeenanautomobileaccidentand
that
hehadplacedthedriverundercitizen'sarrestandneededanofficerdispatched
immediately,

Whenthe
Plaintiff,DorseyHenderson,
approached
thedriverof
the
automobilethat
wasinvolvedin
the
accident,
heappeared
angty
andwasapparently
intoxicated.Becauseof
this
the
PlAintiff,
DorseyHenderson,toldthedriverthathewas
placing
him
under
citizen'sarrestandthatheneededto
stay
onthesceneuntiltheFairhopePoliceDepartmentarrived,Thedriverofthevehicletoldthe
Plaintiff,
DotseyHenderson,thathewas
getting
arideandwas
going
to
leavethe
scene.4.When
the
FairhopePoliceOfficer,

he
hadplaced

driver

citizen's

OfficerTrentScottinformedthePlaintiff,DorseyHenderson,thattherewas"nosuch
thing
asacitizen'sattest
in
Alabaman
andsaid

man",Then,
thePlaintiff,DorseyHenderson,triedtoinformOfficerTrentScottthathehadonlybeen
trying
tohelp
by
placingthedriverundercitizen'sarrest,
and
atthispointtheOfficerTrentScottputthePlaintiff,
DorseyHenderson.

extremely
painful

driveway.6.When
they
gotacrossthestreettothePlaintiffDorseyHenderson's,house,OfficerTrentScottslammed

down,facefirst,breaking

Henderson,onthebackofhishead,neck,andarms

anattempttosubdue
him.

Henderson,neverresistedOfficerTrentScottandthe
Plaintiff
DotseyHenderson,wasneverchargedwithanycrime.
9.l'hePlaintiff,DorrisL.Henderson,
watched
theentire
incidentfrom
her
wheelchair:atthefrontdoorwindowoftheirhouse,atadistanceofonlyeighteen(18)feetaway.ThePlaintiff,
DorrisL.
Henderson,calledthe911dispatcherandinformedthemthattheofficerwas"beatingthehelloutof
my
husband"andtosendmore
officere,

Henderson,up.12.OnceOfficerTrentScottwasfinishedbeatingonthePlaintiff,DorseyHenderson"and
finally
let
him
up,anambulance
had
beendispatchedtoattendto
his
many
obviousinjuries.13.ThePlaintiff,DorseyHenderson,wasbleedingfrom
his
head,neck,andarms,andheobviouslyneededmedicalattention.14.Whenanambulancedid
arrive,
withinten(10)minutes,thePlaintiff,
DOnley
Henderson,wasstillbeingdetained
in
thePoliceCar.15.ThePlaintiff,Dorsey
Headeeeon,
washandcuffedso
tightly
thatthecuffscutinto
his
wrists.AtnotimehadthePlaintiff,DorseyHenderson,everbeenplacedunderattest,ortoldthathehadbeendetainedfat
any
crime.16.Whentheambulancedidarrive,OfficerTrentScott,toldtheEMTthatwas
