Summary
MayorAmiconeandCouncilPresidentLesnickeachallegethattheotherinappropriatelyusedhisofficetohelpafavoredtowcompanyearnaCityimpoundcontract.AsdiscussedattheEthicsBoardmeetingofApril14,2011,wehaveinvestigatedtheallegationsandoutlinedtherelevantfactsandissuessothattheEthicsBoardcanjudgewhetherthereareEthicsCodeviolationsand/orappearancesofimpropriety.However,manyofthechargesinvolvequestionsofintentthatcan'tberesolvedwiththeavailableevidence.Futureimpoundcontractsshouldinvolvecompanybiddingandpubliclydisseminatedobjectiveanalysisofcompetingcompaniesinordertoreducethepotentialforimproperconduct,and/oritsappearance.AttherequestoftheEthicsBoard,thisreportwillnotbereleasedpubliclyuntilMay20

Background
OnMarch15,2011,theIGissuedareportentitled"YonkersVehicleTowsandImpounds"(AttachedExhibit1)thatreviewedtheCity'sadministrationoftowcompanyservicesandrelatedfinancialandcontractualissues.Thereportconcluded,inpart,thattheCity"recentlytookpositivestepstowardsimprovingitsproceduresforawardingtowandimpoundcontracts."However,werecommendedseveralimprovements,suchas"havingCityemployeeswhointeractwiththecompaniesprovidewrittenperformanceevaluationspriortothenextcontract"and"requiringtowcompaniestobidonthepriceofimpoundingvehicles"inordertoprovideadditionalimportantobjectivecriteriaandpotentiallybringincreasedfundstotheCity.Onepurposeoftheserecommendationswastoprovidemorepublicclaritytotheselectionprocessinordertominimizeallegationsoffavoritism,suchasthosethatarethesubjectofthisreport.Inresponsetothereport,CouncilPresidentLesnickissuedapressstatementlaterthatdayinwhichhecriticizedtheprocessforawardingsuchcontracts.Heconcludedbycommenting,"WhilethisIGreportvalidatesthoseconcerns,itdoesnotgofarenoughtoexaminepossibleconflictsbetweentheadministrationandthewinningvendorsandtheprocessbywhichtheCitycircumventedstatelawwithrespecttoappropriatelicenses."Thefollowingday,March16

MayorAmiconesentalettertotheIGandtheEthicsBoardrequestinga"reviewofCouncilPresidentChuckLesnick'sconnectiontoTransitAutoTowing"(AttachedExhibit2).TransitAutoTowing(Transit),whichhadpreviouslyheldacontractwiththeCitytoimpoundvehicles,wasnotawardedanewcontractinearly2010whenthreecompaniesweregiventwoyearcontracts.Instead,A.P.O.W.Towing(A.P.O.W.)wasawardedthecontractpreviouslyheldbyTransit.MayorAmicone'sletterstatedthat"[a]numberofdisturbingoccurrencesinvolvingMr.LesnickandTransitAutoTowinghavecometolightthat,ataveryminimum,whentakentogether,morethanjustsuggestanappearanceofimpropriety.Therearequestionsandconcernsthatneedtobereviewed,answered,andaccountedfor."TheletterthenoutlinedspecificallegationsagainstCouncilPresidentLesnick,whichwillbediscussedinthisreport.OnMarch1

CouncilPresidentLesnickrespondedbyissuingalettertotheIGandtheEthicsBoardthatrequestedareviewof"theconnectionsbetweentheMayorandthoseinhisadministrationtoeachofthecompaniesthatrespondedtothetowingRFP"(AttachedExhibit3).Heallegedintheletterthat"theseconnections,alongwiththeMayor'sintenttopunishTransitAutoTowingforpoliticalreasons,resultedintheAdministration'sflagrantandwillfuldisregardofstatelawregulatingtowingandaflawedprocessinawardingthetowingcontracts."CouncilPresidentLesnickwassubsequentlyaskedtoprovidespecificconcernsregardingtheseissues,whichwillalsobeaddressedinthisreport.Theobjectivesofthereviewwereto:1.InvestigateandevaluateallegationsmadebyMayorAmiconeandCouncilPresidentLesnickregardingallegedimproprietiesinconnectionwiththeawardingoftheimpoundcontractandrelationshipswithtowcompanies2.Resolveoutstandingquestionsoffactregardingtheseallegations

3.ProvidetheEthicsBoardwithrelevantfactsandissuessothatitcandeterminewhetherthereareanyviolationsoftheCityCodeofEthicsandlorappearanceofimpropriety4.MakerecommendationsfortheawardingoffutureimpoundcontractsinordertominimizethepotentialforfutureethicalquestionsanddisputesInthecourseofourreview,wetookswornstatementsfromMayorAmicone,CouncilPresidentLesnick,andallCityCouncilmembers.Inaddition,weinterviewedallimpoundcontractselectioncommitteemembersandspokewithotherswithknowledgeoftheselectionprocess,suchasPeterKischak,PresidentofServiceStationDealersofGreaterNewYork,andtheownersofA.P.O.W.andTransit.Wealsoreviewedrecordingsofrelevantmeetings,suchasthoseheldbytheBoardofContractandSupply,theCityCouncil,andCityCouncilcommittees.

TheMayor'sletterassertsthatTransitdonated$150toCouncilPresidentLesnick's2009re-electioncampaignandprovided"anin-kindcontribution...byusingoneormoreoftheircompanytrucksasacampaignvehiclebyadorningitwithLesnickcampaignsignsanddrivingitthroughoutYonkers,"sometimeswithCouncilPresidentLesnickstandingwithsupportersonthetruck.TheletterfurtherallegesthatCouncilPresidentLesnickfailedtoreportthis"in-kind"donationonhiscampaignfinancialdisclosureforms.CouncilPresidentLesnickacknowledgesthiscampaignsupportfromTransit(totalmonetarydonationsof$200)andpointsoutthattowingcompanieshavesupportedvariousYonkerspoliticalcandidates,includinga$100donationfromA.P.O.W.toMayorAmiconeduringhis2007re-electioncampaign.Regardingthe"in-kind"contribution,werequestedanopinionfromtheEnforcementCouncilfortheNewYorkStateBoardofElections,whoruledthatCouncilPresidentLesnickshouldhavereportedthiscampaignsupportinhis2009financialdisclosurereports.Failuretoreport"in-kind"contributionsisaviolationof§6200.6oftheRulesandRegulationsoftheStateBoardofElections.WeinformedCouncilPresidentLesnickabouttheBoardofElections'positionandhiscampaigntreasurersubsequentlyamendedhisfilingstoincludethe"in-kind"supportfromTransit.
