ABSTRACT
El informe que se presenta entrega los resultados del proyecto de investigación
“Derecho Penal del enemigo y la criminalización de las demandas mapuche”. Su
objetivo central ha sido comprender las formas que asume el biopoder del Estadorespecto de las demandas territoriales mapuche, interviniendo en las comunidadesa través del control social,
y reaccionando en contra de las “resistencias” a través
del control punitivo. Tratándose de este último se examina el control penal queactualmente asume una forma expansionista y se concreta a través del derechopenal del enemigo.La investigación tiene un carácter multidisciplinario que abarca aspectos dederecho penal, derechos humanos, criminología, psicología y antropología. Se haarticulado desde los conceptos de control social y control punitivo, biopolitica ybiopoder, derecho penal simbólico, punitivismo y derecho penal del enemigo yexamina los efectos psicosociales del derecho penal del enemigo y la violenciapolicial en algunas comunidades mapuche de la IX Región.La metodología empleada combina aspectos teóricos y empíricos, empleandofuentes documentales (bibliográficas, legislativas, jurisprudenciales) ymetodologias cualitativas, en las que se privilegia la recolección de datos enterreno rescatando la voz de los propios actores del conflicto.

The report that present us give
the results of the research project called “PenalRights of the Enemy and the Criminalization of Mapuche Petitions”. The main goal
is to understand the diverse forms that the biopower of the State assumes respectto the territorial petitions, interfering the communities through the social controls
and reactioning against the “resistances” through the punitive control. In relation
these last one examine us the penal control at present assumes an expansionistform and its concret through the penal right of the enemy.The research has a multidisciplinary characteristic that include aspects from thepenal right, the human rights, the criminology, the psychology and anthropology. Itis articulated from the concepts of social control, biopolitics and biopower, symbolicpenal right, punitiveness, and penal right of the enemy. Also it examines thepsychosocial effects of the penal right of the enemy and the police violence in thesome Mapuche communities of the IX RegionThe methodology was used combine theoricals aspects and empirical aspects,employing documental fountains (bibliographicals, legislatives, jurisprudentialsfountains) and qualitative methodologies, where privileges the recollection of data
at field to rescueing the actors‟ voice in the conflict.
