A person is guilty of'sexual assault in the second degree when: (1) Sucb person engages in sexual intercourse or sexual intrusion with another person without the person's consent, and the lack of eonsent results from 'forcible compulsion; or . (2) Such person engages in sexual intercourse or sexual intrusion with another person who ill physically helpless. (b) Any person who violates the provisions of this section shall be guilty of a felony, and, upon conviction thereof, shall be imprisoned in the penitentiary not less than ten nor morethan twenty-five years, or fined not less than one thousand dollars nor more than ten thousand dollars and Imprisoned in the penitentiary not less than ten nor lJJore than twenty-five years.

.On 05-19-11 advised her that she had been in the city of Charleston and was approached by a man that she didn't know. She needed a ride home and the male agreed to take" her home. The male did not take her home, but instead drove up to a partially secluded area off of Martins Branch Road in Kanawha County. She stated that he had held her face down on the seat of the truck, forcefully pulled her pants down, and placed his penis in her anus to have sex with her. The suspect got his truck stuck up and was able to escape at thai point. She provided law enforcement with the location and description of the suspect and his truck. Dep. Eary located the suspect and vehicle as described. The suspect was identified as Mathew D. Jarrell. The suspect did confirm that he had sex with the female, but he had initiaIIy denied haying sex with her.
