Whereas,thedraftrules,namelythee-waste(ManagementandHandling)Rules,2010werepublishedbytheGovernmentofIndiaintheMinistryofEnvironmentandForestsvidenumberS.O.1125(E),dated14thMay,2010intheGazetteofIndia,ExtraordinaryPartII,Section3,Sub-section(ii)dated14thMay;2010invitingobjectionsandsuggestionsfromallpersonslikelytobeaffectedthereby,beforetheexpiryoftheperiodofsixtydaysfromthedateonwhichcopiesoftheGazettecontainingthesaidnotificationweremadeavailabletothepublic;,ANDWHEREASthecopiesofthesaidGazetteweremadeavailabletothepubliconthe14thdayofMay,2010;ANDWHEREAStheobjectionsandsuggestionsreceivedwithinthesaidperiodfromthepublicinrespect
ofthe
saiddraftruleshavebeendulyconsideredbytheCentralGovernment;:NOW,THEREFORE,inexerciseofthepowersconferredbysections6,8and25oftheEnvironment(Protection)Act,'1986(29of1986),theCentralGovernmentherebymakesthefollowingrules,namely:-.
CHAPTERIPRELIMINARY

(1)Theserulesmaybecalledthee-waste(ManagementandHandling)Rules,2011.(2)Theyshallcomeintoeffectfrom1stMay,2012.2.
Application.-
Theserulesshallapplytoeveryproducer,consumerorbulkconsumerinvolvedinthemanufacture,sale,purchaseandprocessingofelectricalandelectronicequipmentorcomponents.asspecified

(a)batteriesas.coveredundertheBatteries(ManagementandHandling)Rules,2001madeunder,theAct;(b)Microandsmallenterprisesasdefinedinthe,Micro,SmallandMediumEnterprisesDevelopmentAct,2006(27of2006);and(c)radio-activewastesascoveredundertheprovisionsoftheAtomicEnergyAct,1962(33of1962)andrulesmadethereunder..3.
Definitions.-
(1)Intheserules,unlessthecontextotherwiserequires,-(a)'Act'meanstheEnvironment(Protection)Act,1986(29of1986);(b)'authorisation'meanspermissionforhandling,collection,reception,storage,transportation,dismantling,recycling,treatmentanddisposalofe-wastegrantedundersub-rule(3)ofrule9;(c)'bulkconsumer'meansbulkusersofelectrical.andelectronicequipmentsuchasCentralGovernmentorStateGovernmentDepartments,publicsectorundertakings,banks,educationalinstitutions,multinationalorganizations,internationalagenciesandprivatecompaniesthatareregisteredundertheFactoriesAct,1948andCompaniesAct,1956;(d)'centralpollutioncontrolboard'meanstheCentralPollutionControlBoardconstitutedundersub-section(1)ofsection3oftheWater(PreventionandControlofPollution)Act,1974(6of1974);(e)'collectioncentre'meansacentreestablished,individuallyorjointlyoraregisteredsocietyoradesignatedagencyoracompanyoranassociationtocollecte-waste;.(f)'consumer'meansanypersonusingelectricalandelectronicequipmentexcludingthebulkconsumers;(g)'dismantler'meansanypersonorregisteredsocietyoradesignatedagencyoracompanyoranassociationengagedindismantlingofusedelectricalandelectronicequipmentintotheircomponents;(h)'disposal'meansanyoperationwhichdoesnotleadtorecycling,recoveryorreuseandincludesphysico-chemicalorbiologicaltreatment,incinerationanddepositioninsecuredlandfill;(i)'environmentallysoundmanagementofe-waste'meanstakingallsteps.requiredtoensurethate-wastearemanagedinamannerwhichshallprotecthealthandenvironmentagainstanyadverseeffects,whichmayresultfromhazardoussubstancecontainedinsuchwastes;

'electricalandelectronicequipment'meansequipmentwhichisdependentonelectriccurrentsorelectro-magneticfieldstobefullyfunctional;(k)'e-waste'meanswasteelectricalandelectronicequipment,wholeorinpartorrejectsfromtheirmanufacturingandrepairprocess,whichareintendedtobediscarded;(I)'extendedproducerresponsibility'meansresponsibilityofanyproducerofelectricalorelectronicequipment,fortheirproductsbeyondmanufacturinguntilenvironmentallysoundmanagementoftheirend-of-lifeproducts.(m)'facility'meansanylocationwhereintheprocessincidentaltothecollection,reception,storage,segregation,refurbishing,dismantling,recycling,treatmentanddisposalofe:-wastearecarriedout;(n)'Form'meansformappendedtotheserules;

'historicale-waste'meanse-wastegeneratedfromelectrical,and'electronic.equipmentasspecifiedinScheduleI,whichwasavailableonthedatefromwhichtheserulescomeintoforce;(p)'orphaned'products'meansnonbrandedorassembledelectricalandelectronicequipmentasspecifiedinScheduleIorthoseproducedb{acompany,whichhascloseditsoperationsorhasstoppedproductsupport;(q)'producer'meansanypersonwho,irrespectiveofthesellingtechniqueused;(i)manufacturesandofferstoseUelectricalandelectronicequipmentunderhisownbrand;or'(ii)offerstosellunderhisownbrand,assembledelectricalandelectronicequipmentproducedbyothermanufacturersorsuppliers;or(iii)offerstosellimportedelectricalandelectronicequipment;(r)'recycler'-meansanypersonwhoisengagedinrecyclingorreprocessingofusedelectricalandelectronicequipmentorassembliesortheircomponent;(s)'Schedule'meanstheScheduleappendedtotheserules;(t)'StateGovernmentinrelation'toaUnionterritory'means,theAdministratorthereofappointedunderarticle239oftheConstitution;(u)'statepollutioncontrolboard'-meanstheconcernedStatePollutionControlBoardorthePollutionControlCommitteeoftheUnionTerritoriesconstitutedundersub-section(1)ofsection4oftheWater(PreventionandControlofPollution)Act,1974;(v)'transporter'meansapersonengagedintheoff-sitetransportationofe-wastebyair,rail,roadorwater(2)WordsandexpressionsusedintheserulesandnotdefinedbutdefinedinthemActshallhavethemeaningsrespectivelyassignedtotheminthatAct.CHAPTERII
RESPONSIBILITIES
4.
Responsibilitiesof
the
producer.-,
TheproducerofelectricalandelectronicequipmentlistedinScheduleIshall
be
responsiblefor,-(1)collectionofe-wasteqeneratedduringthemanufactureofelectricalandelectronicequipmentandchannelizingitforrecyclingordisposal;(2)collectionofe-wastegeneratedfromthe'endoflife'oftheirproductsinlinewiththeprincipleof'ExtendedProducerResponsibility'andtoensurethatsuche-wastesarechannelizedtoregistereddismantlerorrecycler.Producershall,asnecessary,ensurecollection'and,channelizationbyauthorizingcollectionagencies;(3)settingupcollectioncentersortakebacksystemseitherindividuallyorcollectively;(4)financingandorganizingasystemtomeetthecostsinvolvedintheenvironmentally"soundmanagementofe-wastegeneratedfromthe'endoflife'ofitsownproductsandhistoricalwasteavailableonthedatefromwhichtheserulescomeintoforce.Thefinancingarrangementofsuchasystemshallbetransparent.Theproducermaychoosetoestablishsuchasystemeitherindividuallyorbyjoiningacollectivescheme:
