GUJARAT ELECTRICITY REGULATORY COMMISSION(Terms and Conditions of Intra-State Open Access) Regulations, 2010Draft Notification No.____of 2010
- In exercise of the powers conferred by section 181, of the ElectricityAct, 2003 (36 of 2003), and all other powers enabling it in this behalf, and afterprevious publication, the Gujarat Electricity Regulatory Commission hereby makesthe following Regulations, namely-
Short Title, Extent and Commencement
These regulations may be called the Gujarat Electricity RegulatoryCommission (Terms and Conditions of Intra-State Open Access)Regulations, 2010.(2)
These regulations shall come into force on the date of publication in theGovernment Gazette.(3)
These regulations extend to the whole state of Gujarat.
These regulations shall apply to open access for use of intra-Statetransmission system and distribution systems in the State of Gujarat,including when such system is used in conjunction with inter-Statetransmission system.
In these regulations, unless the context otherwise requires(a)
"Act" means the Electricity Act, 2003 (36 of 2003);
―Allotted Capacity‖ means the power transfer in MW between the
specified point(s) of injection and point(s) of drawal allowed to along-term/medium-term customer on the intra-State transmissionsystem and the expression "allotment of capacity" shall be construedaccordingly;(c)
―Applicant‖ means a consumer, trader,
distribution licensee or aGenerating company who has applied seeking connectivity or openaccess as the case may be(d)
―Central Commission‖ means the Central Electricity Regulatory
Commission referred to in Section 76 of the Act;(e)
"Commission" means the Gujarat Electricity Regulatory Commissionreferred to in Section 82 of the Act;(f)
'Consumer' shall carry the same meaning as in the Act, but shall berestricted to such consumers within the State of Gujarat to whomthese regulations will apply.(g)
―Contracted load‖ means the load in kW/HP/kVA (kilo
Watt/Horse Power/kilo Volt Ampere) which the distributionlicensee has agreed to supply from time to time subject to thegoverning terms and conditions and is different from the connectedload;(h)
―Day‖ means a day starting at 00.00 hours and ending at 24.00
―Distribution licensee‖ mea
ns any person licensed under Part IV ofthe Act for distribution and retail supply of electricity in the State ofGujarat;(j)
―IEGC‖ means Indian Electricity Grid Code Specified by Central
Electricity Regulatory Commission under clause (h) of sub-section(1) of section 79 of the Act, and as amended from time to time;
―Imbalance‖ in a time block
for a generating station means its totalactual generation minus its total scheduled generation and for aconsumer or buyer means its total drawal minus its total scheduleddrawal.(l)

-Statetransmission system or distribution system for a period exceeding 12years but not exceeding 25 years.(m)
term open access‖ means the open access for a period
exceeding three months but not exceeding three years(n)
―Month‖ means a calendar month as per the Gregorian calendar;
"Nodal agency" means the nodal agency defined in Regulation 12 ofthese regulations;(p)
―Open access‖ means the non
-discriminatory provision for the useof transmission lines or distribution system or associated facilitieswith such lines or system by any licensee or consumer or a personengaged in generation in accordance with these regulations andincludes long-term access, medium-term open access and short-termopen access.(q)
"Open access customer" means a consumer, trader, distributionlicensee or a generating company who has been granted open accessunder these regulations.(r)
―Reserved Capacity‖ means the power transfer in MW between the
specified point(s) of injection and point(s) of drawal allowed to ashort-term customer on the transmission/distribution systemdepending on availability of transmission/distribution capacity andthe expression "reservation of capacity" shall be construedaccordingly;(s)
term open access‖ means open access for a period upto one
month at a time.
